Innocent until proven guilty. A good point to bring up. Unfortunately for your post, Microsoft has been FOUND GUILTY of being a Monopoly by a preponderance of the evidence by the Honorable Thomas Penfield Jackson. A Finding of Fact is posted at http://usvms.gpo.gov/findfact.html

According to the attorneys in the office where I work, there is almost NO CHANCE of Microsoft even getting PART of the Findings of Fact overturned. A Judge's Finding of Fact are questions of Fact, not of Law, and therefore stand unless there is direct contrary evidence to the opposite. And since there were over 400 Findings of Fact, I don't that Microsoft has much of a chance for overturning them, especially considering how Microsoft made at least 3 false tapes of removing Internet Explorer. (I believe the correct number of false tapes was 4, but I may be wrong because the final one may have actually been a true one.)

Personally, I would like to see two punishments imposed for Illegal Use of a Monopoly.
1. Open all of Microsoft's source code for all versions of Windows.

2. Split Microsoft into several branches, such as OS, Games, Internet-Related, and Business Programs. This could make or break the companies. Also force Mr. Gates to sell all but 20% of his Microsoft stock and stock options, with an Order not allowing him to invest in Operating System software ever again. (I know that that would be pretty nasty punishment, but he would still be gaining money from a 20% share in each Microsoft stock, but he would then not have controlling interest...)

Also, while Microsoft is under scrutiny, companies should take the opportunity to get out from under the dominating influence of M$.

The only reason I stuck with M$ for so long is the fact that it has the most programs written for it. I'd much rather use the infinitely-more-reliable Linux than the bug-and-crash-prone Windows (IMO, WinBlows). Now, since a broad spectrum of programs are becoming available for Linux, I am in the process of building a Linux machine (again!).
