From my point of view, it's not that the comments here are pro-Apple, the majority are pro-employees.
The way I look at it, if your company's future is dependent on these employess, you are definitely underpaying them if Apple (or any other big company) can poach them away. If your company is going bust without these people, maybe you can offer them ownership in the company, so if you make it big everyone wins.
But, like most said here, most companies would rather sue, and treat their employees like a resource that can be abused, rather than compensate them fairly.
