The non-techies in most families who actually use computers and smart phones are typically already accustomed to a particular OS/device. It's much easier to support their occasional need than to spend countless hours explaining how to make this new thing do what the old thing did. Just because someone is looking at their lap doesn't mean that they're texting. I would personally fight it in court. If the State wants to waste time and money getting phone and email records to prove out a $150 ticket, so be it. My guess is that they'll cave.

1. Putting your car in Park at a red light does not constitute having your car "legally parked" as required by the law. O.C.G.A. 40-6-241.2
2. Technically, he's wrong about the GPS issue. The law exempts use of a GPS device and does not define what a GPS device is. Due to lack of a definition, one could argue in court that the phone IS a GPS device and was being used as such at the time of the supposed violation.
