Jack Thompson's Violent Game Bill Signed Into Law 368

simoniker writes "Louisiana Democratic Representative Roy Burrell's HB1381 bill, covering violent videogames, has been signed into law by Governor Kathleen Blanco. The law takes effect immediately, the latest in a very long line of video game-related bills specific to one U.S. State. The measure proposed by HB 1381, which was drafted with the help of controversial Florida attorney and anti-game activist Jack Thompson, allows a judge to rule on whether or not a videogame meets established criteria for being inappropriate for minors and be subsequently pulled from store shelves. A person found guilty of selling such a game to a minor would face fines ranging from $100 to $2,000, plus a prison term of up to one year. Needless to say, the ESA will likely be mounting a legal challenge to this bill in the very near future."

Games Seized Following Murder 354

GamePolitics reports that M-rated games have been taken as evidence a case involving the death of a 55-year old man in Louisiana. The connection? Jack Thompson says: "Nobody shoots anybody in the face unless you're a hitman or a videogamer." GP goes on to point out the lunacy of this claim. From the site: "Funny, that. A quick Google search on 'shot in the face' turns up 921,000 entries."

Jack Thompson's Game Bill Moves Forward 272

Gamespot reports that the Jack Thompson-penned anti-games bill currently being considered by the Louisiana Senate Judiciary Committee has been approved, and will now go to the full Senate for debate. From the article: "According to the text of the bill, it would be illegal to sell, rent, or lease a game to a minor if it met the following three conditions: (1) The average person, applying contemporary community standards, would find that the video or computer game, taken as a whole, appeals to the minor's morbid interest in violence. (2) The game depicts violence in a manner patently offensive to prevailing standards in the adult community with respect to what is suitable for minors. (3) The game, taken as a whole, lacks serious literary, artistic, political, or scientific value for minors."

A press release announcing his availability speaks of Take Two not having 'learned its lesson' over the Hot Coffee scandal, before continuing to detail the issues surrounding Oblivion's re-rating, in particular regarding nudity - concluding that the game content will spawn 'an even worse disaster' than occurred during Hot Coffee."

Jack Thompson Sues Florida Bar 71

Gamasutra reports that Jack Thompson has sued the Florida Bar Association, for "hector[ing] plaintiff Thompson for 19 months with SLAPP Bar complaints filed by opposing counsel (Strategic Litigation Against Public Participants). Continually, during that time, Thompson and his counsel in these Bar matters have repeatedly asked The Florida Bar to sit down with him and his counsel to try to resolve, once and for all, this dispute, which goes back more than 18 years when other baseless SLAPP Bar complaints were filed, resulting in the payment of money damages to plaintiff Thompson."

Last Thursday we mentioned the misreporting of a gamer's suicide, the death of a young man who frequented a Metal Gear Solid forum. This week, GamePolitics tries to clear things up by talking with one of the forum admins and giving gamers a place to air their reactions to related events, such as Jack Thompson's callous disregard for the young man's life. The Guardian Gamesblog comments on the unreality of the situation: "According to Gaminghorizon, AFP, the international newswire service that picked up on the Bulgarian story, has corrected its take on the events, although news sites that picked up on AFP's original version, including CNN and Yahoo have apparently yet to make alterations to their reports. Pluvius writes "For the past few weeks, gaming website Netjak has corresponded with infamous anti-video-game lawyer Jack Thompson in reference to his well-publicized proposal to donate money to a charity if someone created a violent game in which a grieving father murdered members of the video-game industry. This has culminated in an interview in which the unusually cordial attorney gives surprisingly viable reasons for not following through on his donation after such a game was created. Unfortunately, Thompson doesn't quite make it to the end of the interview without taking at least one cheap shot towards gamers: '[P]ut down the controller and get a life. Video gaming is an escapist activity and you're being exploited by these companies. It's not healthy; I worry about someone who would play Grand Theft Auto for ten hours a day. It's a masturbatory activity, and it would be better if people put down the controller and went outside.'"

It reveals a bit about Nintendo's old strong-arm tactics, the origin of the third party developer, Electronic Art's employee abuse, and of course plenty of violent games being 'linked' to violent behavior. A young man has been charged after reportedly threatening Jack Thompson with torture and death, reports Gamespot. Thompson claims the boy is already in custody for his crime. While previously he stated that he had withdrawn, details have now come out that the judge actually pulled his temporary license to practice law in Alabama. The reason for all this? Thompson's behavior." Game Politics reports that Jack Thompson has removed himself from the Alabama court case against members of the games industry. From the post: "Thompson's flamboyant profile, take-no-prisoners style of communication, and frequent press releases and media appearances were the subject of a defense motion on behalf of video game industry clients to revoke his Pro Hac Vice (visiting) admission to the Alabama bar. The motion to remove Thompson from the case occupied much of last Thursday's hearing before Judge Moore in Fayette County. By day's end the judge asked both sides to submit opinions on the Pro Hac Vice revocation motion as well as another defense motion to dismiss the case on a summary judgment for lack of merit." Industry Leaders Frustrated With Game Culture 50

Well known designer Warren Spector let his opinions fly in a keynote at the Montreal Game Summit, reports Edge Online. From the article: "While admitting that the largest part of the criticism stemmed from general ignorance and misunderstanding of videogaming by the 'cultural gate-keepers,' he noted that simply staying the course and waiting for mainstream acceptance to catch up could lead not only to political intervention, but a 'coarsening of our culture,' and 'eventual cultural irrelevance.' Instead, he joined a growing chorus in the development community by strongly advocating the diversification of games to be more inclusive of women, older gamers, and traditionally excluded ethnicities." Next Generation is covering a similar statement by ESA President Doug Lowenstein about his views on the gaming industry's image. Unfortunately, societal parasite Jack Thompson took Spector's remarks to be validation of his viewpoint. GamePolitics has that story.

Jack Thompson Calls The Feds On PA 85

Gamespot is reporting that Jack has taken his beef to the Feds regarding the dangerous pixelantes over at Penny Arcade. From the article: "In a letter addressed to John McKay, US Attorney for the Western District of Washington, and sent to media outlets, Thompson this morning said the site was using a variety of means 'to encourage and solicit criminal harassment' of him. Thomspon wrote to McKay, 'Please help me if you can,' but did not include specific actions he wished to have taken against the site. McKay's office prosecutes cases investigated by several law enforcement agencies in Western Washington, including the FBI." PvP is also running a parody indicating that Jack has appealed to the Justice League for assistance with Gabe and Tycho.

A bunch of people from the Penny-Arcade forums then went and sent letters to the FBA asking for them to check up on Thompson's current actions and review his license to practice law. The fact that even the National Institute on Media and the Family distance themselves from Thompson doesn't help his case either." The lesson here? There are many nerds in the world. Jack Thompson Calls Cops on Penny-Arcade 913

Anon1001 sent us the latest developments in the ongoing saga between Miami Attorney Jack Thompson and Penny-Arcade. So far the story goes that Jack has filed a wrongful death suit against Rock Star, claiming that GTA is a cop killing training simulator responsible for the murder of a pair of cops. He also offered $10k to charity if anyone who would develop some ridiculous murder spree game. When someone did it, and he changed his mind and Penny-Arcade donated the cash instead. All of this is being documented on the Penny Arcade website, in phone calls, rants and comics, as well as an 'I Hate Jack Thompson' T-Shirt. (Note, Slashdot's parent company owns ThinkGeek). He has now called the cops claiming harassment. Update: 10/18 17:40 GMT by Z : It seems like this confrontation has been brewing all summer. The most recent altercation is just another link in the chain made by Thompson's reaction to Hot Coffee and his crusade against the Sims 2. Further, PA has put up the scan of the letter to the cops, and a photo of the check.

Jack Thompson Rescinds Offer 430

Goalmaster3000 writes to tell us Joystiq.com is reporting that Jack Thompson has rescinded his offer of a $10,000 donation to charity if a video game were made to fit his model. Recently a group of GTA modders cooked up a scenario to fit the bill but apparently Thompson is claiming that his piece 'A Modest Video Game Proposal' was intended as satire that the video game community was not bright enough to grasp. Perhaps Thompson was just afraid he was going to have to sue himself? Update: 10/17 20:02 GMT by SM: It appears that the Penny Arcade crew has taken the next step by donating the promised $10,000... in Jack Thompson's name.
