Will Microsoft Beat Facebook to the Metaverse? (venturebeat.com) 45

"When comparing Meta — formerly Facebook — and Microsoft's approaches to the metaverse, it's clear Microsoft has a much more grounded and realistic vision," argues an analyst at data analytics/consultancy company GlobalData: Meta is set to grab a large portion of the $51 billion revenues from VR that GlobalData expects will be generated by 2030. Facebook led the consumer VR headsets market in 2020 and registered 255 VR-related patents between 2016 and 2020. And, as Meta, the company also plans to launch an enterprise-grade headset in Q4 2021. However, VR hardware and software have not been widely adopted. This is attributable to several issues, including latency, nausea, high prices, privacy concerns, and a lack of compelling content. While technologies such as 5G, cloud services, and motion tracking should help to address latency and nausea issues, improving content and developing effective data privacy practices will be paramount for VR's success (more on data privacy in a moment). For these reasons VR is not yet ready to take on the task of the metaverse.

Microsoft seems to have understood better than Meta how people actually use technology. All you need to use Mesh — Microsoft's so-called gateway to the metaverse — is your current smartphone or laptop. No clunky headsets or expensive tech setups are needed. With this approach, Microsoft is keeping its focus on available capabilities and enterprise applications over Meta's vision of total lifestyle adoption. Microsoft Teams also currently has over 145 million daily active users, whereas the total cumulative installed base of VR headsets is less than 17 million. From these numbers alone, Mesh for Microsoft Teams has a possible user base of more than eight times the number of users Meta could hope to reach with its VR headsets.

Facebook's promises of protecting data's privacy in the metaverse "will not be enough to reassure most future users," the article argues.

"Microsoft, on the other hand, is a market leader in data privacy and, when ranked by the 10 themes that matter most to the social media industry, is in second place overall, according to GlobalData's Social Media Thematic Scorecard. Meta is ranked 21st overall out of 35 companies on the scorecard, and its activity with regards to data privacy will be highly detrimental to its future performance."

Besides new issues like hyper-personalized ads, the metaverse will still face the old problem of content moderation, the article suggests — only now spread across a massive scale. And the article ultimately argues that "The metaverse will suffer from the same issues that plague the current version of the internet unless the right actions are taken by those that end up with control..."

Global Temperatures Over Last 24,000 Years Show Today's Warming 'Unprecedented' (phys.org) 155

An anonymous reader quotes a report from Phys.Org: A University of Arizona-led effort to reconstruct Earth's climate since the last ice age, about 24,000 years ago, highlights the main drivers of climate change and how far out of bounds human activity has pushed the climate system. The study, published this week in Nature, had three main findings:

1.) It verified that the main drivers of climate change since the last ice age are rising greenhouse gas concentrations and the retreat of the ice sheets.
2.) It suggests a general warming trend over the last 10,000 years, settling a decade-long debate about whether this period trended warmer or cooler in the paleoclimatology community.
3.) The magnitude and rate warming over the last 150 years far surpasses the magnitude and rate of changes over the last 24,000 years.

There are different methods for reconstructing past temperatures. The team combined two independent datasets -- temperature data from marine sediments and computer simulations of climate -- to create a more complete picture of the past. The researchers looked at the chemical signatures of marine sediments to get information about past temperatures. Because temperature changes over time can affect the chemistry of a long-dead animal's shell, paleoclimatologists can use those measurements to estimate temperature in an area. It's not a perfect thermometer, but it's a starting point. Computer-simulated climate models, on the other hand, provide temperature information based on scientists' best understanding of the physics of the climate system, which also isn't perfect. The team decided to combine the methods to harness the strengths of each. This is called data assimilation and is also commonly used in weather forecasting. The emails -- unsealed in the state of Mississippi's lawsuit against J&J over its refusal to add a safety warning -- show J&J and its talc supplier chose the scientists hired by their trade association, the Personal Care Products Council, to write the 2009 report assessing talc-based powders' health risks. They also show the researchers changed the final version of their report at the companies' behest. The U.S. Food and Drug Administration said it relied in part on the report in its decision to forgo a warning for the product.

The emails among executives of J&J and Rio Tinto Minerals, its supplier at the time, provide a behind-the-scenes glimpse of dealings between companies and their industry group that successfully fended off a cancer warning on talc-based powders for nearly 40 years. Now, almost 39,000 users and their families are suing J&J, most claiming their ovarian cancers and those of loved ones were linked to asbestos, the potent carcinogen in the products pulled from U.S. and Canadian shelves in May 2020. Dependence on industry data creates a situation that's ripe for lobbyists to exert pressure on the FDA. The unsealed emails pull back the curtain on how such efforts get launched, who pays for them, and who has a hand in delivering the final product to regulators.

While the practice of companies having a say in industry group submissions to the FDA isn't new or illegal, the emails reveal just how involved J&J got in a report meant to assess product safety -- down to selecting individual scientists to produce it and having them write an executive summary. J&J denied any wrongdoing in its decision not to acknowledge its input to the report that the PCPC lobbying group sent to the FDA. [...] FDA officials acknowledged they weighed the PCPC's response to the citizens' petitions demanding a warning for talc-based powders before finding there was "inconclusive evidence" the mineral caused ovarian and other forms of cancer. Is Modern Software Development Too Complex? (infoworld.com) 273

"It has never been more difficult to be a software developer than it is today," says Nigel Simpson, a former director of enterprise technology strategy at Walt Disney.

And they're not the only one who thinks so, writes the U.K. Group editor of InfoWorld: "Complexity kills," Lotus Notes creator and Microsoft veteran Ray Ozzie famously wrote in a 2005 internal memo. "It sucks the life out of developers; it makes products difficult to plan, build, and test; it introduces security challenges; and it causes user and administrator frustration."

If Ozzie thought things were complicated back then, you can't help but wonder what he would make of the complexity software developers face in the cloud-native era. The shift from building applications in a monolithic architecture hosted on a server you could go and touch, to breaking them down into multiple microservices, packaged up into containers, orchestrated with Kubernetes, and hosted in a distributed cloud environment, marks a clear jump in the level of complexity of our software. Add to that expectations of feature-rich, consumer-grade experiences, which are secure and resilient by design, and never has more been asked of developers. "There is a clear increase in complexity when you move to such a pervasive microservices environment," said Amazon CTO Werner Vogels during the AWS Summit in 2019. "Was it easier in the days when everything was in a monolith? Yes, for some parts definitely."

Or, as his colleague, head of devops product marketing at AWS, Emily Freeman, said in 2021, modern software development is "a study in entropy, and it is not getting any more simple."

On the other hand, complex technologies have never been easier to consume off the shelf, often through a single API — from basic libraries and frameworks, to image recognition capabilities or even whole payments stacks. Simply assemble and build your business logic on top. But is it really that simple?

The article also cites a critical 2020 blog post by RedMonk analyst Stephen O'Grady. "The process of application development is simply too fragmented at this point," O'Grady wrote. "The days of every enterprise architecture being three-tier, every database being relational, and every business application being written in Java and deployed to an application server are over.

N.L. Health-Care Cyberattack Is Worst In Canadian History (www.cbc.ca) 24

One cybersecurity expert says the cyberattack on the Newfoundland and Labrador health-care system may be the worst in Canadian history, and has implications for national security. CBC News reports: David Shipley, the CEO of a cybersecurity firm in Fredericton, said he's seen similar breaches before, but usually on a smaller scale. "We've never seen a health-network takedown this large, ever," Shipley said in an interview with CBC News. "The severity of this is what really sets it apart." Discovered on Saturday morning, the cyberattack has delayed thousands of appointments and procedures this week, including almost all non-emergency appointments in the Eastern Health region. After refusing to confirm the cause of the disruption for days, Health Minister John Haggie said Wednesday the system has been victim of a cyberattack. Sources have told CBC News the security breach is a ransomware attack, a type of crime in which hackers gain control of a system and hand back the reins only when a ransom has been paid. [...]

Shipley said he normally argues against giving in to ransom demands but the provincial government might have to pay up in this instance since lives are at stake. The government has not confirmed there has been a ransom demand. On Thursday morning, staff at the Health Sciences Centre in St. John's were told the system used to manage patient health and financial information at the hospital is back online. The system -- called Meditech -- only has information from before last weekend, and will need to be updated. It isn't yet clear what the restoration of the system will mean for services at the hospital, or if the system is back online in other parts of the province.

John Carmack Issues Some Words of Warning For Meta and Its Metaverse Plans (arstechnica.com) 48

But the id Software co-founder spent a good chunk of his wide-ranging Connect keynote Thursday sounding pretty skeptical of plans by the newly rebranded Meta (formerly Facebook) to actually build that metaverse. "I really do care about [the metaverse], and I buy into the vision," Carmack said, before quickly adding, "I have been pretty actively arguing against every single metaverse effort that we have tried to spin up internally in the company from even pre-acquisition times." The reason for that seeming contradiction is a somewhat ironic one, as Carmack puts it: "I have pretty good reasons to believe that setting out to build the metaverse is not actually the best way to wind up with the metaverse."

Today, Carmack said, "The most obvious path to the metaverse is that you have one single universal app, something like Roblox." That said, Carmack added, "I doubt a single application will get to that level of taking over everything." That's because a single bad decision by the creators of that walled-garden metaverse can cut off too many possibilities for users and makers. "I just don't believe that one player -- one company -- winds up making all the right decisions for this," he said. The idea of the metaverse, Carmack says, can be "a honeypot trap for 'architecture astronauts.'" Those are the programmers and designers who "want to only look at things from the very highest levels," he said, while skipping the "nuts and bolts details" of how these things actually work.

These so-called architecture astronauts, Carmack said, "want to talk in high abstract terms about how we'll have generic objects that can contain other objects that can have references to these and entitlements to that, and we can pass control from one to the other." That kind of high-level hand-waving makes Carmack "just want to tear [his] hair out... because that's just so not the things that are actually important when you're building something." "But here we are," Carmack continued. "Mark Zuckerberg has decided that now is the time to build the metaverse, so enormous wheels are turning and resources are flowing and the effort is definitely going to be made."

From a report: The architect likened it to a "social and psychological experiment with an unknown impact on the lives and personal development of the undergraduates the university serves" in his resignation letter. The building in question is the planned Munger Hall on the university's beachside campus, which the university's website says "will fulfill visions for both UC Santa Barbara and the donor, Charles Munger," a billionaire investor often described as Warren Buffet's "right-hand man." Munger has also financed the construction of graduate residences on the University of Michigan and Stanford campuses fashioned on his architectural ideas to promote collaboration and bonhomie. While the Stanford residences are essentially normal apartments, the Michigan hall resembles its UCSB sibling in that "most bedrooms don't have windows," according to VeryApt.com. From a report: U.S. officials have met leaders of local semiconductor firms, Sandra Oudkirk, director of the American Institute in Taiwan, told reporters Friday in Taipei, adding that they had "excellent safeguards" to protect proprietary information. "The Commerce Department's request for information is designed to better understand the semiconductor supply chain," Oudkirk, who is the U.S.'s de facto ambassador in the absence of official ties, said at her first news conference since being appointed in July. She added that the drive was designed to enable the department make regulations to "improve or alleviate the disruptions to the supply chain." How Facebook Plans To Build Its Metaverse (axios.com) 38

Facebook unveiled a series of new moves in augmented and virtual reality on Thursday, as part of its longer-term effort to help build a "metaverse" that will bring physically distant people closer together. From a report: Facebook has said this is its next major push, but it comes as the company is under intense scrutiny for how it is managing the impact of its existing services. The company is using its annual Facebook Connect conference to outline a series of new features and products, as well as some investments to spur adoption of the technologies. Among them:

Horizon Home: Facebook is making the home screen on Oculus Quest more social, allowing friends to gather, watch videos together and dive into games and apps.
Messenger calling in VR: This will start with being able to call from VR and eventually that will be a launch point for hanging out in virtual reality.
Bringing more 2D apps to VR: More than 20 apps are coming to Horizon Home, with the ability to be placed on a virtual screen. Apps include productivity titles like Slack and Dropbox as well as Facebook's own services, including Instagram. Developers will also be able to offer their own progressive web apps for use in VR.
Horizon Marketplace: The company plans to operate its own marketplace where creators and developers can sell their own virtual goods.
On the augmented reality front, Facebook is adding hand and body tracking to its Spark AR developer tools as well as Polar, a new app that allows people to create augmented reality filters without needing to code.

$28B Startup Says Companies Were Refusing Their Free Open-Source Code as 'Not Enterprise-Ready' (forbesindia.com) 49

"Ali Ghodsi was happily researching AI at Berkeley when he helped invent a revolutionary bit of code — and he wanted to give it away for free," remembers Forbes India. "But few would take it unless he charged for it.

"Now his startup is worth $28 billion, and the career academic is a billionaire with a reputation as one of the best CEOs in the Valley." (Literally. VC Ben Horowitz of Andreessen Horowitz calls him the best CEO in Andreessen Horowitz's portfolio of hundreds of companies.) Inside a 13th-floor boardroom in downtown San Francisco, the atmosphere was tense. It was November 2015, and Databricks, a two-year-old software company started by a group of seven Berkeley researchers, was long on buzz but short on revenue. The directors awkwardly broached subjects that had been rehashed time and again. The startup had been trying to raise funds for five months, but venture capitalists were keeping it at arm's length, wary of its paltry sales. Seeing no other option, NEA partner Pete Sonsini, an existing investor, raised his hand to save the company with an emergency $30 million injection...

Many of the original founders, Ghodsi in particular, were so engrossed with their academic work that they were reluctant to start a company — or charge for their technology, a best-of-breed piece of future-predicting code called Spark, at all. But when the researchers offered it to companies as an open-source tool, they were told it wasn't "enterprise ready". In other words, Databricks needed to commercialise. "We were a bunch of Berkeley hippies, and we just wanted to change the world," Ghodsi says. "We would tell them, 'Just take the software for free', and they would say 'No, we have to give you $1 million'."

Databricks' cutting-edge software uses artificial intelligence to fuse costly data warehouses (structured data used for analytics) with data lakes (cheap, raw data repositories) to create what it has coined data "lakehouses" (no space between the words, in the finest geekspeak tradition). Users feed in their data and the AI makes predictions about the future. John Deere, for example, installs sensors in its farm equipment to measure things like engine temperature and hours of use. Databricks uses this raw data to predict when a tractor is likely to break down. Ecommerce companies use the software to suggest changes to their websites that boost sales. It's used to detect malicious actors — both on stock exchanges and on social networks.

Ghodsi says Databricks is ready to go public soon. It's on track to near $1 billion in revenue next year, Sonsini notes. Down the line, $100 billion is not out of the question, Ghodsi says — and even that could be a conservative figure. It's simple math: Enterprise AI is already a trillion-dollar market, and it's certain to grow much larger. If the category leader grabs just 10 percent of the market, Ghodsi says, that's revenues of "many, many hundred billions."

ISPs Want More Money Because So Many People Are Streaming Squid Game (vice.com) 127

ISPs around the world claim the unprecedented bandwidth demands Netflix's Squid Game is placing on their broadband networks means they should be getting more money. From a report: But experts say that's not how telecom networks work, suggesting that already cash-flush telecom giants are just positioning themselves for an underserved hand out. The popular South Korean thriller, a not so thinly-veiled critique of late-stage capitalism, tracks a group of indebted people who compete in deadly children's games for cash. According to Netflix, Squid Game is the most popular show in company history, the number one program in 94 countries, and has been watched by 142 million households. ISPs around the world also claim the show's popularity is driving a massive surge in bandwidth consumption, and they want their cut.

In South Korea, Internet service provider SK Broadband sued Netflix earlier this month, claiming that between May and September the ISP's network traffic jumped 24 times to 1.2 trillion bits of data processed every second. This surge is Netflix's fault, the ISP insists, and Netflix should be held financially responsible. In the UK, British Telecom executives have been making similar complaints, insisting that Netflix should be forced to help pay for the surge in network traffic caused by the show. But broadband experts say that's not how broadband networks actually work. "It makes no sense for ISPs to cry victim because they provide a popular service, and are expected to provide it," John Bergmayer, telecom expert at consumer group Public Knowledge told Motherboard. "People subscribe to broadband to do things like stream video, and it's broadband customers who are requesting all these Squid Game streams. They are not somehow imposed on ISPs by Netflix."

Credit Card PINs Can Be Guessed Even When Covering the ATM Pad (bleepingcomputer.com) 58

An anonymous reader quotes a report from BleepingComputer: Researchers have proven it's possible to train a special-purpose deep-learning algorithm that can guess 4-digit card PINs 41% of the time, even if the victim is covering the pad with their hands. The attack requires the setting up of a replica of the target ATM because training the algorithm for the specific dimensions and key spacing of the different PIN pads is crucially important. Next, the machine-learning model is trained to recognize pad presses and assign specific probabilities on a set of guesses, using video of people typing PINs on the ATM pad.

For the experiment, the researchers collected 5,800 videos of 58 different people of diverse demographics, entering 4-digit and 5-digit PINs. The machine that ran the prediction model was a Xeon E5-2670 with 128 GB of RAM and three Tesla K20m with 5GB of RAM each. By using three tries, which is typically the maximum allowed number of attempts before the card is withheld, the researchers reconstructed the correct sequence for 5-digit PINs 30% of the time, and reached 41% for 4-digit PINs. The model can exclude keys based on the non-typing hand coverage, and deduces the pressed digits from the movements of the other hand by evaluating the topological distance between two keys. The placement of the camera which captures the tries plays a key role, especially if recording left or right-handed individuals. Concealing a pinhole camera at the top of the ATM was determined to be the best approach for the attacker. If the camera is capable of capturing audio too, the model could also use pressing sound feedback which is slightly different for each digit, thus making the predictions a lot more accurate.

The Mega65: A Modernization of the Canceled Commodore 65 Computer From 1991 113

Slashdot reader TommyROM writes: The Commodore 65 was a never-released computer slated to follow the fabled Commodore 64 from 1982. Developed between 1990 and 1991, it would have been the most powerful 8-bit computer on the market with 128K RAM, high-resolution graphics (up to 1280x400), and stereo sound. A few prototypes were made before Commodore canceled the project in 1991.

Now an updated version of the Commodore 65 has been realized. Project founder Paul Gardner-Stephen began working on recreating the C65 in 2014, and eventually teamed up with the non-profit Museum of Electronic Games & Art to create the FPGA-based Mega65, a modernization of the original Commodore 65 featuring a custom main board, mechanical keyboard, and injection molded case. It uses the original C65 ROMs but improves on the design with SD card support, Ethernet, and HDMI output. It is about 40 times faster than a C64 and backwards compatible, including cartridge and joystick ports. The design is open-sourced for long-term compatibility. Additionally, there is a hand-held version in the works that is also a cellphone. They are currently taking pre-orders for the Mega65 at a price of 666.66 euros ($742 plus shipping).

Sam Biddle writes via The Intercept: To ward off accusations that it helps terrorists spread propaganda, Facebook has for many years barred users from speaking freely about people and groups it says promote violence. The restrictions appear to trace back to 2012, when in the face of growing alarm in Congress and the United Nations (PDF) about online terrorist recruiting, Facebook added to its Community Standards a ban on "organizations with a record of terrorist or violent criminal activity." This modest rule has since ballooned into what's known as the Dangerous Individuals and Organizations policy, a sweeping set of restrictions on what Facebook's nearly 3 billion users can say about an enormous and ever-growing roster of entities deemed beyond the pale. [...] The Intercept has reviewed a snapshot of the full DIO list and is today publishing a reproduction of the material in its entirety, with only minor redactions and edits to improve clarity. It is also publishing an associated policy document, created to help moderators decide what posts to delete and what users to punish.

The list and associated rules appear to be a clear embodiment of American anxieties, political concerns, and foreign policy values since 9/11, experts said, even though the DIO policy is meant to protect all Facebook users and applies to those who reside outside of the United States (the vast majority). Nearly everyone and everything on the list is considered a foe or threat by America or its allies: Over half of it consists of alleged foreign terrorists, free discussion of which is subject to Facebook's harshest censorship. The DIO policy and blacklist also place far looser prohibitions on commentary about predominately white anti-government militias than on groups and individuals listed as terrorists, who are predominately Middle Eastern, South Asian, and Muslim, or those said to be part of violent criminal enterprises, who are predominantly Black and Latino, the experts said.

The materials show Facebook offers "an iron fist for some communities and more of a measured hand for others," said Angel Diaz, a lecturer at the UCLA School of Law who has researched and written on the impact of Facebook's moderation policies on marginalized communities. Facebook's policy director for counterterrorism and dangerous organizations, Brian Fishman, said in a written statement that the company keeps the list secret because "[t]his is an adversarial space, so we try to be as transparent as possible, while also prioritizing security, limiting legal risks and preventing opportunities for groups to get around our rules." He added, "We don't want terrorists, hate groups or criminal organizations on our platform, which is why we ban them and remove content that praises, represents or supports them. A team of more than 350 specialists at Facebook is focused on stopping these organizations and assessing emerging threats. We currently ban thousands of organizations, including over 250 white supremacist groups at the highest tiers of our policies, and we regularly update our policies and organizations who qualify to be banned."

Neuroscientists Claim To Have Pinpointed the Brain States Unique To 'Team Flow' (sciencealert.com) 49

An anonymous reader quotes a report from ScienceAlert: At some point in life, you have probably enjoyed a 'flow' state -- when you're so intensely focused on a task or activity, you experience a strong sense of control, a reduced awareness of your environment and yourself, and a minimized sense of the passing of time. It's also possible to experience 'team flow,' such as when playing music together, competing in a sports team, or perhaps gaming. In such a state, we seem to have an intuitive understanding with others as we jointly complete the task at hand. An international team of neuroscientists now thinks they have uncovered the neural states unique to team flow, and it appears that these differ both from the flow states we experience as individuals, and from the neural states typically associated with social interaction.

Researchers found increased beta and gamma brain wave activity in the left middle temporal cortex. This region of the brain is typically associated with information integration and key functions like attention, memory, and awareness, which are "consistent with higher team interactions and enhancing many flow dimensions," the team writes. However, what was unique about team flow, was that participants' neural activity appeared to synchronize. When participants were performing the task as a unit, their brains would mutually align in their neural oscillations (beta and gamma activity), creating a "hyper-cognitive state between the team members." If brains can be functionally connected through inter-brain synchrony, does this mean it is not only our brain that contributes to our consciousness? It's a curious question, but the authors warn it is much too soon to tell. "Based on our findings, we cannot conclude that the high value of integrated information correlates with a modified form of consciousness, for instance, 'team consciousness'," they write. "Its consistency with neural synchrony raises intriguing and empirical questions related to inter-brain synchrony and information integration and altered state of consciousness."

Credit-Card Firms Are Becoming Reluctant Regulators of the Web (economist.com) 97

Social networks spend billions moderating content posted on their platforms, but are still criticized either for not removing enough toxic material or for stifling free speech. They are not the only ones to grapple with the problem. Banks and credit-card companies too are finding themselves playing a bigger role in what is said and done in the public square -- to their, and their customers', discomfort. Now the boundary of censorship is being extended further, into the pornography business. From October 15th adult websites worldwide will have to verify the age and identity of anyone featured in a picture or video, as well as the ID of the person uploading it. They will need to operate a fast complaints process, and will have to review all content before publication. These requirements are being imposed not by regulators but by Mastercard, a credit-card giant. Websites can always choose not to work with Mastercard. But given that the company handles about 30% of all card payments made outside China, to do so would be costly. Visa, which manages a further 60% of payments, is also taking a firmer line on adult sites. And the trend goes beyond porn. In the shadier corners of the web, and in industries where the law is unclear or out of date, financial firms are finding themselves acting as de facto regulators.

Visa and Mastercard's near-duopoly on card payments makes their decisions more powerful -- and the firms prime targets for protesters. In 2019 SumOfUs, a left-wing pressure group, tabled a proposal at Mastercard's annual meeting meant to stop payments to far-right groups. (The proposal was defeated.) Thirty-four women are suing Visa along with the owners of Pornhub, an adult site which they say hosted unconsenting footage of them. Illegal-porn sites "care a lot more about their finances than they do about the law," says Laila Mickelwait, whose Justice Defense Fund helps sex-abuse victims litigate. And, she adds, when financial firms change their policies it applies globally. Last year Visa and Mastercard cut off Pornhub over its hosting of potentially unlawful material. Payment companies in particular face a philosophical dilemma. "On one hand they try to be very open, accepting, willing to facilitate payments for whomever. They're not taking any sort of political or moral stance," says Lisa Ellis of MoffettNathanson, a research firm. "But on the other hand, they also feel like they have a very strong responsibility in making sure that they're not aiding and abetting any sort of crime."

Visa and Mastercard both say that, as global companies, their guiding principle is local legality. (This can throw up some surprises: one executive recalls being informed by clients from a Scandinavian country that bestiality was legal there at the time.) Things are not always black and white. In 2017, after a far-right march in Charlottesville, Virginia, Mastercard shut down the use of its cards on websites that had made "specific threats or incite[d] violence," but kept dealing with other sites labelled hate-groups. "Our standard is whether a merchant's activity is lawful, even when we disagree with what they say or do," the company said at the time. In grey areas they have reason to err on the side of caution. Payment networks' risk of liability tends to be low, since they operate at one remove from the merchants. But being named in a sex-trafficking complaint or accused of helping Nazis does not look good. In working with a borderline adult site, for instance, there's "not a lot of upside and a lot of downside", says Ms Ellis. And in legally tricky areas it can be cheaper to issue a blanket ban than pick through every difficult case. Banks may steer clear of countries that are not embargoed but which have a lot of people on the banned list, "to minimize the burden of determining whether every transaction is compliant," says Jonathan Cross of Herbert Smith Freehills, a law firm. [...] For as long as legislation lags behind, financial institutions will be left in a difficult position: either accused of being the "moral police," as one executive puts it, or of enabling wrongdoing. As Richard Haythornthwaite, then Mastercard's chairman, told the protesters at the firm's annual meeting in 2019: "If it is lawful, then we need to respect that transaction. If it is something that is swimming against the tide of society, it's for the society to rise up and change the law."
