With the updates, Uber's HackerOne bug bounty policies more thoroughly outline "good-faith vulnerability research and disclosure," and contain language defining what constitutes unacceptable behavior, stating that the company wants researchers "to hunt for bugs, not user data."

One newly outlined policy makes it clear that Uber won't take legal action against researchers -- as long as they report vulnerabilities with no strings attached. "You should never illegally or in bad faith leverage the existence of a vulnerability or access to sensitive or confidential information, such as making extortionate demands or ransom requests, or trying to shake us down. In other words, if you find a vulnerability, report it to us with no conditions attached," the policy said. Uber has made additional changes to its program to offer researchers an additional $500 if they include a fully scripted proof-of-concept (PoC) in their original report.

Everyone from Uber to PayPal is facing a backlash against their impenetrable legalese. From a report: Personal finance forums online are brimming with complaints from hundreds of PayPal customers who say they've been suspended because they signed up before age 18. PayPal declined to comment on any specific cases, but says it's appropriate to close accounts created by underage people "to ensure our customers have full legal capacity to accept our user agreement." While that may seem "heavy-handed," says Sarah Kenshall, a technology attorney with law firm Burges Salmon, the company is within its rights because the users clicked to agree to the rules -- however difficult the language might be to understand.

Websites have long required users to plow through pages of dense legalese to use their services, knowing that few ever give the documents more than a cursory glance. In 2005 security-software provider PC Pitstop LLC promised a $1,000 prize to the first user to spot the offer deep in its terms and conditions; it took four months before the reward was claimed. The incomprehensibility of user agreements is poised to change as tech giants such as Uber Technologies and Facebook confront pushback for mishandling user information, and the European Union prepares to implement new privacy rules called the General Data Protection Regulation, or GDPR. The measure underscores "the requirement for clear and plain language when explaining consent," British Information Commissioner Elizabeth Denham wrote on her blog last year.

Uber Drivers Are Independent Contractors, Not Employees, Judge Rules (reuters.com) 192

Uber drivers are independent contractors, not full-time employees of the ride-hailing company, a federal judge in Philadelphia ruled in what is said to be the first classification of Uber drivers under federal law. Reuters reports: U.S. District Judge Michael Baylson on Wednesday said San Francisco-based Uber does not exert enough control over drivers for its limo service, UberBLACK, to be considered their employer under the federal Fair Labor Standards Act. The drivers work when they want to and are free to nap, run personal errands, or smoke cigarettes in between rides, Baylson said. Jeremy Abay, a lawyer for the plaintiffs, said he would appeal the ruling to the Philadelphia-based 3rd U.S. Circuit Court of Appeals. The 3rd Circuit would be the first federal appeals court to consider whether Uber drivers are properly classified as independent contractors.

An anonymous reader quotes a report from Bloomberg: A data breach in 2016 exposed the names, phone numbers and email addresses of more than 20 million people who use Uber's service in the U.S., authorities said on Thursday, as they chastised the ride-hailing company for not revealing the lapse earlier. The Federal Trade Commission said Uber failed to disclose the leak last year as the agency investigated and sanctioned the company for a similar data breach that happened in 2014. "After misleading consumers about its privacy and security practices, Uber compounded its misconduct," said Maureen Ohlhausen, the acting FTC chairman. She announced an expansion of last year's settlement with the company and said the new agreement was "designed to ensure that Uber does not engage in similar misconduct in the future."

In the 2016 breach, intruders in a data-storage service run by Amazon.com Inc. obtained unencrypted consumer personal information relating to U.S. riders and drivers, including 25.6 million names and email addresses, 22.1 million names and mobile phone numbers, and 607,000 names and driver's license numbers, the FTC said in a complaint. Under the revised settlement, Uber could be subject to civil penalties if it fails to notify the FTC of future incidents, and it must submit audits of its data security, the agency said.

The Uber-For-Bikes Startup Is Now Officially Part of Uber (qz.com) 51

Uber's first acquisition under CEO Dara Khosrowshahi is of Jump Bikes, a startup that rents out shared electric dockless bikes in San Francisco and Washington DC. "The deal comes two months after Uber partnered with Jump in San Francisco to make bike rentals available through the Uber app," reports Quartz. From the report: TechCrunch reports that the deal was valued at close to $200 million. Jump, which launched in 2008 as Social Bicycles, had raised about $15 million in funding. In January the company became the first in San Francisco to receive a permit for a dockless e-bike program. Jump's team will stay "independent and focused on growth vs. integration," with CEO Ryan Rzepecki reporting directly to Khosrowshahi, Uber's CEO told his company in an email this morning (April 9). In a post on Medium, Rzepecki said Khosrowshahi's leadership made Jump feel more comfortable with the deal. "We could see the shift in the company once Dara was named CEO as he began leading with humility and in a way that we felt reflected our values," Rzepecki wrote.

It is a big step forward for autonomous car developers, especially as the industry faces heightened scrutiny over safety concerns. In 2017 firms worldwide spent around $21.8bn on mergers and acquisitions related to AI, according to PitchBook, a data provider, about 26 times more than in 2015. They are doing this partly to secure talent, which is thin on the ground. Startups without revenue are fetching prices that amount to $5m-10m per AI expert.

As AI spreads beyond the tech sector, it will fuel the rise of new firms that challenge incumbents. This is already happening in the car industry, with autonomous-vehicle startups and ride-hailing firms such as Uber. But it will also change the way other companies work, transforming traditional functions such as supply-chain management, customer service and recruitment. The path ahead is exhilarating but perilous. Around 85% of companies think AI will offer a competitive advantage, but only one in 20 is "extensively" employing it today, according to a report by MIT's Sloan Management Review and the Boston Consulting Group. The company predicts it will give 1 million robot-taxi rides a day by 2020. Waymo, the industry pioneer, logged millions of autonomous miles as it perfected self-driving technology. But over the years, engineers defected out of frustration that it was not commercializing the technology. Now with former auto executive John Krafcik at the helm, Waymo appears poised to launch a self-driving taxi service that could conceivably dominate that field, at least early on, the way Uber does now with human-driven cars.

Uber reached the settlement with the daughter and husband of Elaine Herzberg, who died at age 49 after being hit by the Uber vehicle in Tempe, Arizona. The settlement presumably includes a cash payment, but no details were provided by either Uber or the family's attorney. "The matter has been resolved," said Christina Perez Hesano, an attorney for Herzberg's family, according to reports by Reuters and NPR.

Uber Will Not Re-Apply For Self-Driving Car Permit In California (techcrunch.com) 101

Uber's current permit in California expires March 31. "We proactively suspended our self-driving operations, including in California, immediately following the Tempe incident," an Uber spokesperson told TechCrunch. "Given this, we decided to not reapply for a California permit with the understanding that our self-driving vehicles would not operate in the state in the immediate future."

Uber's decision not to reapply comes in tandem with a letter the DMV sent to Uber's head of public affairs, Austin Heyworth, today. The letter pertains to the fatal self-driving car crash that happened in Tempe, Arizona last week. "In addition to this decision to suspend testing throughout the country, Uber has indicated that it will not renew its current permit to test autonomous vehicles in California," DMV Deputy Director/Chief Counsel Brian Soublet wrote in the letter. "By the terms of its current permit, Uber's authority to test autonomous vehicles on California public roads will end on March 31, 2018." This comes following Arizona's decision to block Uber's self-driving cars in its city.

The survey -- conducted using the anonymous app Blind -- found that nearly a third of those questioned were planning to delete their Facebook accounts. In all, over 2,600 people were surveyed between March 20, 2018 and March 24, 2018, so it neatly took in the peak of the controversy. Broken down by company, the numbers make for interesting reading:

Doug Ducey of Arizona wrote in a letter sent to Dara Khosrowshahi, Uber's chief executive. "Arizona must take action now." The New York Times reports: Uber had already suspended all testing of its cars in Arizona, San Francisco, Pittsburgh and Toronto. "We proactively suspended self-driving operations in all cities immediately following the tragic incident last week. We continue to help investigators in any way we can, and we'll keep a dialogue open with the governor's office to address any concerns they have," said Matt Kallman, an Uber spokesman. The rebuke from the governor is a reversal from what has been an open-arms policy by the state, heralding its lack of regulation as an asset to lure autonomous vehicle testing -- and tech jobs. "I can say with some confidence that in situations like that one with pedestrians -- in this case a pedestrian with a bicycle -- we have a lot of confidence that our technology would be robust and would be able to handle situations like that," Krafcik said Saturday when asked if a Waymo car would have reacted differently than the self-driving Uber.

In explaining its since-settled lawsuit against Uber last year, Google charged that Uber was "using key parts of Waymo's self-driving technology," and added it was "seeking an injunction to stop the misappropriation of our designs." In announcing the settlement of the lawsuit last month, Uber CEO Dara Khosrowshahi noted, "we are taking steps with Waymo to ensure our LIDAR and software represents just our good work." A Google spokesperson added, "We have reached an agreement with Uber that we believe will protect Waymo's intellectual property now and into the future. Waymo, formerly the self-driving car project of Google, said that in tests on roads in California last year, its cars went an average of nearly 5,600 miles before the driver had to take control from the computer to steer out of trouble. As of March, Uber was struggling to meet its target of 13 miles per "intervention" in Arizona (Warning: source may be paywalled; alternative source), according to 100 pages of company documents obtained by The New York Times and two people familiar with the company's operations in the Phoenix area but not permitted to speak publicly about it. Yet Uber's test drivers were being asked to do more -- going on solo runs when they had worked in pairs. Experts Say Video of Uber's Self-Driving Car Killing a Pedestrian Suggests Its Technology May Have Failed (4brad.com) 325

Ever since the Tempe police released a video of Uber's self-driving car hitting and killing a pedestrian, experts have been racing to analyze the footage and determine what exactly went wrong. (If you haven't watched the video, you can do so here. Warning: it's disturbing, though the actual impact is removed.) In a blog post, software architect and entrepreneur Brad Templeton highlights some of the big issues with the video:
1. On this empty road, the LIDAR is very capable of detecting her. If it was operating, there is no way that it did not detect her 3 to 4 seconds before the impact, if not earlier. She would have come into range just over 5 seconds before impact.
2.On the dash-cam style video, we only see her 1.5 seconds before impact. However, the human eye and quality cameras have a much better dynamic range than this video, and should have also been able to see her even before 5 seconds. From just the dash-cam video, no human could brake in time with just 1.5 seconds warning. The best humans react in just under a second, many take 1.5 to 2.5 seconds.
3. The human safety driver did not see her because she was not looking at the road. She seems to spend most of the time before the accident looking down to her right, in a style that suggests looking at a phone.
4.While a basic radar which filters out objects which are not moving towards the car would not necessarily see her, a more advanced radar also should have detected her and her bicycle (though triggered no braking) as soon as she entered the lane to the left, probably 4 seconds before impact at least. Braking could trigger 2 seconds before, in theory enough time.)

To be clear, while the car had the right-of-way and the victim was clearly unwise to cross there, especially without checking regularly in the direction of traffic, this is a situation where any properly operating robocar following "good practices," let alone "best practices," should have avoided the accident regardless of pedestrian error. That would not be true if the pedestrian were crossing the other way, moving immediately into the right lane from the right sidewalk. In that case no technique could have avoided the event.
The overall consensus among experts is that one or several pieces of the driverless system may have failed, from the LIDAR system to the logic system that's supposed to identify road objects, to the communications channels that are supposed to apply the brakes, or the car's automatic braking system itself. According to Los Angeles Times, "Driverless car experts from law and academia called on Uber to release technical details of the accident so objective researchers can help figure out what went wrong and relay their findings to other driverless system makers and to the public."

Herzberg's death is the first major test of a nascent autonomous vehicle industry that has presented the technology as safer than humans who often get distracted while driving. For human driving in the U.S., there's roughly one death every 86 million miles, while autonomous vehicles have driven no more than 15 to 20 million miles in the country so far, according to Morgan Stanley analysts. "As an ever greater number of autonomous vehicles drive ever an ever greater number of miles, investors must contemplate a legal and ethical landscape that may be difficult to predict," the analysts wrote in a research note following the Sunday collision. The video footage does not conclusively show who is at fault. However, it seems to confirm initial reports from the Tempe police that Herzberg appeared suddenly. It also showed the vehicle operator behind the wheel intermittently looking down while the car was driving itself.

Police Chief: Uber Self-Driving Car 'Likely' Not At Fault In Fatal Crash (arstechnica.com) 527

An anonymous reader quotes a report from Ars Technica: The chief of the Tempe Police has told the San Francisco Chronicle that Uber is likely not responsible for the Sunday evening crash that killed 49-year-old pedestrian Elaine Herzberg. "I suspect preliminarily it appears that the Uber would likely not be at fault in this accident," said Chief Sylvia Moir. Herzberg was "pushing a bicycle laden with plastic shopping bags," according to the Chronicle's Carolyn Said, when she "abruptly walked from a center median into a lane of traffic." After viewing video captured by the Uber vehicle, Moir concluded that "it's very clear it would have been difficult to avoid this collision in any kind of mode (autonomous or human-driven) based on how she came from the shadows right into the roadway." Moir added that "it is dangerous to cross roadways in the evening hour when well-illuminated, managed crosswalks are available." The police said that the vehicle was traveling 38 miles per hour in a 35 mile-per-hour zone, according to the Chronicle -- though a Google Street View shot of the roadway taken last July shows a speed limit of 45 miles per hour along that stretch of road.
