I couldn't find the video of Alan Keyes being arrested on YouTube, so I added it. Update I should have been clear: this is from 1996. It's not recent. :-)

        I think he was implying you may be violating someone's copyright by posting that video to youtube. Unless of course you own the copyright or have reason to believe that posting it falls under fair use.

        (note that I personally take a rather broad view fair use and believe the current copyright system is broken so I tend not to get upset over anything except blatant commercial violations.)

          Yes, it quite clearly falls under fair use. The historical/news value of the video, the short excerpt, the fact that it doesn't detract from the potential commercial value of the copyrighted work ... there's no question this falls under fair use. You don't need a broad view of fair use to see this posting as acceptable, you need to completely gut fair use to think it is unacceptable.

            Again I'm inclined to agree. Unfortunately some take such a narrow view of fair use as to all but eliminate it. Among them many of our large media firms who have the resources to wage PR campaigns, lobby lawmakers, and use barristry to achieve their goals.
