I think Alito should be confirmed. While I have some misgivings, as I did with Roberts, about the tilt of the court from conservative appointees, I think that Alito, like Roberts, is respectful, well considered, and is as impartial as one can expect any human to be.
And on the other side, I'm really really sick of the Democratic Senators harping on such minor and easily explained "problems" with Alito's record. If I hear one more Senator say "Vanguard" or "CAP" or "percentage of results" I'm going to smack 'em.
So there you go. Confirm him, get it over with, and move on to the next battle. If that's all the ammunition you can dig up, you haven't got a case against him other than "we don't like him because he's >gasp< a conservative!" Which is horsehockey.

I dunno, I listened, and those sure as hell sounded like answers to me. So sorry that if he won't answer to say he's going to be the second coming of your favorite liberal justice that you can't hear

Care to elaborate? The only case I've heard that leans this way at all is the whole CAP BS. And I think I've already indicated that I think that's a load of it.
Anyone that might want to argue that our country keeps all power in the hands of wealthy old white men now has a lot of ammunition.

Sure, the case I'm thinking of is Bray vs. Marriott Hotels. [findlaw.com] Alito dissented in this case. The majority explained that Alito would have protected racist employers by "immuniz[ing] an employer from the reach of Title VII if the employer's belief that it had selected the 'best' candidate was the result of conscious racial bias."

I'm not really sure why, but these hearings come during a time of war, huge uncertainty about the power of the executive, and growing concern about the culture of corruption that has become "the K street project"; Jack Abramoff, Tom Delay, etc.
