This discussion in Ezra's 'blog prompted me to dredge up the Montag Marriage Amendment.

The only difference is that I finally came up with a catchy title!

Entering into a second marriage, without a pre-nup, after a divorce may be used as evidence of insanity.

That filing status wasn't in the original tax code and everybody had to file a separate return. MFJ came in in the 1940s, I believe, a good 30 years after the income tax was first implemented.
