Modded Xbox Bans Prompt EFF Warning About Terms of Service 254

Last month we discussed news that Microsoft had banned hundreds of thousands of Xbox users for using modified consoles. The Electronic Frontier Foundation has now pointed to this round of bans as a prime example of the power given to providers of online services through 'Terms of Service' and other usage agreements. "No matter how much we rely on them to get on with our everyday lives, access to online services — like email, social networking sites, and (wait for it) online gaming — can never be guaranteed. ... he who writes the TOS makes the rules, and when it comes to enforcing them, the service provider often behaves as though it is also the judge, jury and executioner. ... While the mass ban provides a useful illustration of their danger, these terms can be found in nearly all TOS agreements for all kinds of services. There have been virtually no legal challenges to these kinds of arbitrary termination clauses, but we imagine this will be a growth area for lawyers."

Spirit Stuck In Soft Soil On Mars 160

cheros writes "NASA reports that the Spirit Mars lander is presently stuck in soft soil. The lander's wheels are halfway sunk into the soil and they are planning simulation tests to see if they can get it out again. I hope they can get it out of there because it's picking up enough new energy to operate; however, it only has 5 wheels left to get around on — one of the wheels hasn't been working for years. Fingers crossed."

Obama Says 3% of GDP Should Fund Science Research And Development 753

tritonman writes "Obama wants to set a goal that the US spend 3% of its GDP on scientific research and development. 'I believe it is not in our character, American character, to follow — but to lead. And it is time for us to lead once again. I am here today to set this goal: we will devote more than 3 percent of our GDP to research and development,' Obama said in a speech at the annual meeting of the National Academy of Sciences."

2009 ACM Programming Contest Results and Webcast 49

Jon Larsson writes "Yesterday, the 33rd World Finals of the ACM International Collegiate Programming Contest were held at KTH — The Royal Institute of Technology in Stockholm, Sweden. World Champions, for the second consecutive year, are the Saint Petersburg State University of IT, Mechanics and Optics. They won in competition with 99 other teams from all six continents — the best of the over 7000 teams participating in the qualifying rounds during the past half year. The full results can be found here and the contest problem set is available here (PDF). For the first time ever, the whole event was broadcast live, both on the web and on national TV in Sweden. The broadcast was produced by media students of KTH and the Lillehammer University College in Norway. The webcast in its entirety (over 7 hours) can be viewed here."

Smart Grid Computers Susceptible To Worm Attack 98

narramissic writes "Researchers with security consultancy IOActive have created a worm that could quickly spread among Smart Grid devices, small computers connected to the power grid that give customers and power companies better control over the electricity they use. '[The worm] spread from one meter to another and then it changed the text in the LCD screen to say "pwned,"' said Travis Goodspeed, an independent security consultant who worked with the IOActive team. In the hands of a malicious hacker, this code could be used to cut power to Smart Grid devices that use a feature called 'remote disconnect,' which allows power companies to cut a customer's power via the network. The robustness of US power networks has been a hot-button issue after a technical glitch in 2003 caused a cascading power failure in the eastern United States and Canada that affected 55 million people."

Exactly right regarding the supposed failure of trickle down. You can't call it a failure, if it was never tried.

While tax side was implemented, the spending side was never kept in check. With the increase in tax revenues, Congress only saw the chance to write bigger checks and expand the reach of government.

Actually, the Obamas wanted to move into Blair House _earlier_ than other President-Elects had used it, due to their daughters starting school. Traditionally, the incoming President will stay there from the 15-20th.

Unfortunately, for the Obamas, the rooms had already been spoken for and were being used by the people wanting to visit with President Bush during his last month in Office.
