Then it's up to ScarJo to prove OpenAI's guilt, not on OpenAI to prove their own innocence? You know, as basic lawfulness dictates?
I think you're thinking of criminal law.
Basic lawfulness in a civil dispute (i.e. ScarJo sues OpenAI) aspires to judge based on the "preponderance of evidence" where ScarJo wants to show that it's more than 50% likely that OpenAI used her voice, and OpenAI wants to show it's less than 50% likely.
Despite the lack of need for either side to prove anything, if OpenAI really did hire another actress (e.g. the rumored Rashida Jones) then they'll be able to prove it. And since proving their case will be so easy (if they're innocent), then failure to prove it will make it seem like they probably used ScarJo's voice.
So I think we're in an amusing situation where civil law will result in the opposite of criminal law's "innocent until proven guilty." OpenAI will prove they're innocent or else they'll be presumed guilty.
