newtley writes: "Michelle Santangelo and her brother Bobby, victims of the RIAA MI>sue 'em all campaign, say Sharman Networks and AOL together owe them almost $8 million, plus legal fees and expenses. The two recently asked for leave to serve a third party complaint against Kazaa owner Sharman Networks and Time Warner's AOL, as well as a former friend whom they say installed Kazaa software. The amended complaint (pdf) claims Sharman Networks, though not itself guilty of copyright infringement, "authorized" users of its Kazaa software to illegally share copyrighted music files. It also claims AOL, "entrapped and created a dangerous condition for the children, Defendants and Third-Party Plaintiffs herein, which became the source of the Plaintiffs claim in the form of alleged infringement.""

newtley writes: "It's virtually unheard of for a judge to request an amicus brief. But in 2004 noted liberal activist judge Nancy Gertner did so in Capitol Records vs Noor Alaujan, with Harvard Law School's Berkman Center responding. Equally unusually, briefs were handed in by the Motion Picture Association of America and a group comprising musician and songwriters' societies. Now in the Alaujan case, judge Gertner has denied the RIAA demand for Summary Judgment, ruling it served notices to admit prematurely. "I've never had a situation like this before, where there are powerful plaintiffs and powerful lawyers on one side and then a whole slew of ordinary folks on the other side," said Gertner of other RIAA lawsuits at the time."

Now, the $35,000 default judgment against her out of the way, it's her turn and she's showing the same kind of grit and determination displayed by Patti, calling for a trial by jury. In Elektra v Santangelo II, she's filed papers opposing the RIAA's motion for attorneys fees; and, filed her answer, counterclaims, and jury demand."

newtley writes: "Last year the IFPI (International Federation of Phonographic Industry) succeeded in persuading VISA and MasterCard to ban payments to Russian music download site allTunes, using alleged copyright infringement as the excuse. However, a Moscow court has ruled the action was illegal, reports p2pnet. The decision on whether or copyrights have been infringed, "can only be taken by [a] court based on a suit filed by exclusive copyright holders, but neither IFPI nor VISA own such rights", according to the court decision, says allTunes owner Internet-Audit."

newtley writes: "Tanya Andersen, the disabled Oregon mother who for three years has been living a nightmare, is suing RIAA and its so-called settlement center for malicious prosecution, says Recording Industry vs The People. "They made life horrible and did a lot of damage," she told p2pnet. "People need to fight back. It's really wrong they can abuse their power like this. It was three years — two years for the lawsuit and a year when they were harassing me. It's really important for me to tell people what they've done and I'm really thankful that I'm able to do that.""

Last year, the entertainment cartels claimed counterfeiting and file sharing were prime causes of deteriorating world economies. But, quoting from the Havocscope global index of illicit markets, movie and music piracy were way down the list at 16th and 20th respectively, said p2pnet. Despite these earlier spurious claims, things have worsened dramatically. Right? Wrong. Havocscope says movies have moved up only four notches to the 12th position, and music is now two steps further down, not up, at position # 22."

newtley writes: "The RIAA was demanding the identities of University of New Mexico students, but Magistrate Judge Lorenzo F. Garcia refused to cooperate, denying the RIAA's ex parte motion, reports Recording Industry vs The People. "I'm very gratified to see that there are judges out there who can see through the RIAA smokescreen, and who will apply the American principles of justice to deny the RIAA's fascistic interpretation of the law," says the site's Ray Beckerman, one of the first lawyers to start seriously defending RIAA victims. "Judge Garcia also notes that there is 'no reasonable way' to ensure that prospective defendants are made aware of the lawsuits and requests for disclosure — which is exactly how the RIAA wants it," says Ars Technica. "He wants to ensure that the John Does are notified and 'are given a reasonable opportunity to intervene in order to stop the disclosure of sensitive information'.""
