The difference is that the former directly puts people in harm's way, whereas the latter are just words being spoken publicly. For example, Eminent sticking a gun to his ex-wife's head and screaming "Imma kill dis bitch!" would be felony assault, but him saying he would do that to a killer rap beat is a multi-platinum record.

Pretty obvious, since if you actually break down the "people shot" statistic you find the vast majority were felons to begin with.

'Course, when you look below the surface, you'll discover that when it comes to the truly important things - indefinite detention of Americans without charges, militarizing police, justifying the murder of innocents abroad, justifying executions of Americans without trial, etc. - D and R couldn't agree more.
