MS can't enforce that condition because they monopolize the OS market.

Familiarity with the toolset could be one of the reasons.
There are less Windowses out there than there are Linuxes. I would think that's one thing that makes it "inherently good".

It's traceable, but it's not easy to trace. I remember there was a paper on the traceabilty of bitcoin transactions. Google it if you're interested.
