Their bootloader code was stolen from two open source projects which they repackaged and relabeled without attribution or source. That's pretty shitty IMHO.
I assume they'll be able to fix it via a microcode patch. Intel had to learn that the hard way...

At some point in the future they will regret removing the community. Much like today when we look back at how the BBC taped over the original tapes for (or just threw out) tons of Doctor Who episodes. Gone forever are 108 episodes just to save a few bucks...
They've got to get these things in every retail outlet possible. The 3DS is one of those situations where seeing the system will help sell it. A skeptical public who hears "3D" might think it is a poorly implemented gimmick like the 3D of the 1950s.
