Pepper spray is not all that safe. It can cause a pretty serious elevation in blood pressure and if you're prone, this can lead to a stroke. This stroke occurred hours after he was pepper sprayed.

The autopsy specifically stated that there is no evidence of bear spray contributing to the stroke that killed Sicknick.

No. It is not illegal to, for example, not make a monthly credit card payment (which violates the contract you signed with the credit card company). The company can, in turn, do various things (including sue you in civil court), but it can't have the local police arrest you.

The big problem in most of the coverage of the decision is the misguided notion that the *court* should be relying on science. It absolutely, utterly, should not.

The court should be relying on the law, and does not get to decide for itself what is "best," nor how to interpret it.

Correct. Which is why Brown v. Board of Education should have outlawed segregated schools based on the 14th Amendment, as opposed to citing psychological studies on the harms of segregation.

Yes, Clinton won more popular votes than Trump. But neither won a majority of the popular vote.

As discussed elsewhere in this thread, Justin Trudeau's Liberals won fewer popular votes than the Conservatives in Canada. His party did win the most seats in Parliament (not a majority of seats), so he remained Prime Minister.

In the US, Trump did win a majority of electoral college votes, thus became President.
