Amazon Fined In Poland For Dark Pattern Design Tricks (techcrunch.com) 16

Poland has fined Amazon close to $8 million for misleading consumers about the conclusion of sales contracts on its online marketplace. The sanction "also calls out the e-commerce giant for deceptive design elements which may inject a false sense of urgency into the purchasing process and mislead shoppers about elements like product availability and delivery dates," reports TechCrunch. From the report: The country's consumer and competition watchdog, the UOKiK, has been looking into complaints about Amazon's sales practices since September 2021, following complaints from shoppers, including some who did not receive their purchases. The authority opened a formal investigation into Amazon's practices in February 2023. Wednesday's sanction is the conclusion of that probe. The UOKiK found consumers who ordered products on Amazon could have their purchases subsequently cancelled by the tech giant as it does not treat the moment of purchase as the conclusion of a sales contract, despite sending consumers confirmation of their order -- even after consumers have paid for the product. For Amazon, the conclusion of a sales contract only occurs once it has sent information about the actual shipment. [...]

Its enforcement also calls out Amazon for using deceptive design to encourage shoppers to click buy by presenting misleading information about product availability and delivery windows -- such as by listing how many items were in stock to be purchased and providing a countdown clock to order an item in order to get it on a particular delivery date. Its investigation found Amazon does not always meet these deadlines for orders, nor ship products immediately as they may be out of stock despite claims to the contrary shown to consumers. "Amazon treats the data it provides on availability and shipping date as indicative but the way it is presented does not indicate this," the UOKiK noted, adding: "Consumers can only find out about this in the terms of sale on the platform."

While Amazon does offer a delivery guarantee -- offering a refund if items do not ship within the stated time -- the authority found it failed to provide consumers with information about the rules of this service before placing an order. It only offers details at the order summary stage. And then only "if the consumer decides to read the subsequent links specifying delivery details." Shoppers who did not follow the link to read more may not have been aware of their right to apply for and receive a refund from Amazon if there is a delay in shipment. It also found the e-commerce giant failed to provide information about the "Delivery Guarantee" in the purchase confirmation sent to shoppers.
Amazon said it will appeal the fine. The company also writes: "Fast and reliable delivery across a wide selection of products is a top priority for us, and Amazon.pl has millions of items available with fast and free Prime delivery. Since launching Amazon.pl in 2021, we have continuously invested and worked hard to provide customers with a clear, reliable delivery promise at check out, and while the vast majority of our deliveries arrive on time, customers can contact us in the rare event that they experience a delay or order cancellation, and we will make it right.

Over the last year, we have collaborated with the Office of Competition and Consumer Protection (UOKiK), and proposed multiple voluntary amendments to continue to improve the customer experience on Amazon.pl. We strictly follow legal standards in all countries where we operate and we strongly disagree with the assessment and penalty issued by the UOKiK. We will appeal this decision."

Hackers Trick Venture Capital Firm Into Sending Them $1 Million (vice.com) 26

Security researchers at Check Point say the company has uncovered evidence that Chinese hackers managed to hijack $1 million in seed money during a wire transfer between a Chinese venture capital firm and an Israeli startup -- without either side realizing anything was wrong. From a report: The VC firm and the startup, whose names Check Point hasn't released, reached out to the security firm after the funds failed to arrive. Once Check Point dug into the details, it discovered a man in the middle attack that took a lot of planning and plenty of patience. After analyzing the server logs, emails, and the computers involved in correspondence between the companies, Check Point noticed some abnormalities. Some of the emails, analysts discovered, had been modified. Others hadn't even been written by either organization. After seeing the original email thread announcing the upcoming multi-million dollar seeding fund, the hacker took action. Instead of monitoring subsequent emails by creating an auto forwarding rule (standard practice in traditional attacks), the hacker started by creating two lookalike domains.

Making Trains Run on Time (economist.com) 117

Plamen Angelov of the University of Lancaster, in Britain, has an idea that he hopes will make train delays rarer. From a report: Often, Dr Angelov observes, the problem is not the inefficiency of operators but the behaviour of passengers -- the "platform-train interface", to use railway parlance. When trains arrive, passengers crowd around the doors waiting to board, restricting the flow of those getting off. When they are about to depart, people often hold doors open, delaying that departure. (A recent study by Japan's Railway Bureau found that passengers attempting to board trains after their scheduled departure times accounted for almost 50% of delays.) Passengers also frequently stand too close to the carriages for safety. Waiting for malefactors to move back behind the yellow safety line on a platform might hold a train up for less than a minute. But over the course of a journey those minutes add up. Even a slight delay is compounded if it causes a train to slip out of its running order and be held at a subsequent station, or be required to follow a slower service.

Dr Angelov thinks that applying artificial intelligence to the problem might help. And that is what he and his team are doing. Using images from the cctv cameras already mounted in carriages and on platforms, their system employs algorithms that have been trained to detect objects such as people, luggage, pushchairs and bicycles. It then measures the movements and positions of these objects relative to areas such as the train doors or the yellow safety line and uses this information to predict problems. The cameras in the carriages detect how busy particular doors are getting as passengers leave their seats and gather next to the exits when the train approaches a station. At the same time, the station cameras monitor the numbers waiting for the train to arrive, whereabouts they are standing along the platform, and how encumbered they are. The two sets of data can then be compared, providing warning of likely areas of congestion. This permits passengers -- particularly those on the platform -- to be directed to doors that will be less busy.

Tesla Delays Launch of Model X Until Q3 2015 111

An anonymous reader writes "Tesla on Wednesday announced that it was pushing back the release of its highly anticipated Model X until the third quarter of 2015. Explaining the delay, Tesla relayed the following in its quarterly shareholder letter: "Work continues on the finalization of Model X with the testing of Alpha prototypes and initial builds of the first Beta prototypes. Model X powertrain development is almost complete with the early introduction of Dual Motor drive on Model S. We recently decided to build in significantly more validation testing time to achieve the best Model X possible. This will also allow for a more rapid production ramp compared to Model S in 2012." During Tesla's subsequent earnings conference call, Tesla CEO Elon Musk shed a bit more light on all things Model X, including the fact that if you order one today, it won't arrive until early 2016.
