NBC News spoke to 21 people who said they were hooked on casino-style apps and had spent significant sums of money. The industry is almost entirely unregulated. From a report: Shellz, 37, a nurse from Houston, spends at least two hours a day with her husband playing a casino-style smartphone game called Jackpot Magic. The app offers a variety of typical casino games to play, including their favorite, called Reel Rivals, a game in which players accrue points by playing a virtual slot machine. As in a real casino, players exchange money for coins to bet. Unlike in a real casino, there is no way to win money back or earn a payout on coins. But that has not stopped Shellz and her husband from spending about $150,000 in the game in just two years. She asked to use her in-game username so her family does not find out how much money they have spent on the game. "We lie in bed next to each other, we have two tablets, two phones and a computer and all these apps spinning Reel Rivals at the same time," she said. "We normalize it with each other." Jackpot Magic is an app made by Big Fish Games of Seattle, one of the leaders in an industry of "free-to-play" social games into which some people have plowed thousands of dollars. Big Fish Games also operates a similar app, Big Fish Casino. Both are labeled as video games, which allows the company and others like it to skirt the tightly regulated U.S. gambling market. But unlike the gambling market, apps like Jackpot Magic and Big Fish Casino are under little oversight to determine whether they are fair or whether their business practices are predatory.

NBC News spoke to 21 people, including Shellz and her husband, who said they were hooked on the casino-style games and had spent significant sums of money. They described feelings of helplessness and wanting to quit but found themselves addicted to the games and tempted by the company's aggressive marketing tactics. Most of the 21 players wished to remain anonymous, as they were ashamed of their addictions and did not want their loved ones to find out about their behavior. A 42-year-old Pennsylvania woman said she felt saddened that she spent $40,000 on Big Fish Casino while working as an addiction counselor. "The whole time I was working as an addiction counselor, I was addicted to gambling and with no hope of winning any money back," she said. Big Fish Games did not make anyone available for an interview, nor did the company respond to detailed questions. The company has said in previous court filings that only a fraction of the game's players actually spend money. In a response to NBC News' inquiries, the company issued a statement saying its games are not gambling and should not be regulated as such.

Console Options Without Disc Drives Could Be GameStop's Final Death Knell (arstechnica.com) 79

An anonymous reader quotes a report from Ars Technica: The latest quarterly earnings report from GameStop doesn't show much sign of a turnaround for the long-troubled game retailer. Sales were down 26.7 percent year over year for the April through June quarter. Even accounting for permanent store closures and COVID-related reduced operating hours, so-called comparable "same-store" sales were still down 12.7 percent year over year. GameStop's already depressed stock is down nearly 8 percent on the news, as of this writing. GameStop still publicly sees an "opportunity to capitalize" on the upcoming release of new Sony and Microsoft consoles, which could help turn its business around in the short term. But there's some reason to believe the coming generation of consoles could actually make GameStop's long-term prospects worse, thanks to console options that get rid of disc drives entirely.

In an earnings call, GameStop CEO George Sherman acknowledged that "there has been growth in digitally downloaded games" and said GameStop is "not debating the growth of digital gaming." But he also tried to put a positive spin on the fate of GameStop's physical game sales going into the next generation of consoles. "First, new consoles have a disc drive," Sherman said. "So for the next seven years, the consoles will play both the physical and digital software that we sell." That's only partially true, though. Both the Xbox Series S and the PlayStation 5 Digital Edition actually won't have a disc drive. And while GameStop does sell some digital software, the bulk of its business comes from the sale of new physical games and high-margin pre-owned games. We don't know what percentage of consumers will opt for these disc-free consoles, of course. Still, lower hardware costs could definitely make discless consoles an attractive option to many potential customers this generation. The Xbox Series S is $200 cheaper than the more-powerful, disc-drive-equipped Series X, a sum that could go toward a lot of digital game purchases...

Xbox All Access Seems Like One of the Best Deals In Gaming (arstechnica.com) 141

An anonymous reader quotes a report from Ars Technica: Today, Microsoft revealed prices for its next-gen consoles: $299 or $499 for an Xbox Series S or Xbox Series X, respectively, starting November 10. But Microsoft is also talking up a smartphone-style program that lets players get either system for no money upfront as part of a subscription plan called Xbox All Access. With Xbox All Access, you make a two-year commitment to pay $24.99/month (for the Xbox Series S) or $34.99/month (for the Xbox Series X). In exchange for that commitment, you get the relevant hardware upfront, to keep, as well as a two-year subscription to Xbox Game Pass Ultimate. Game Pass Ultimate usually costs $14.99/month, so your All Access monthly payments end up a bit higher to make up for that "free" upfront hardware. But in addition to not having to spend hundreds of dollars in one lump sum, All Access subscribers can actually come out ahead at the end of two years.

For the Xbox Series S:
- With All Access: $0 upfront + $24.99/month * 24 months = $599.67
- Without All Access: $299 upfront + $14.99/month * 24 months = $658.76
- All Access savings: $59.09

For the Xbox Series X:
- With All Access: $0 upfront + $34.99/month * 24 months = $839.76
- Without All Access: $499 upfront + $14.99 * 24 months = $858.76

So All Access subscribers save a lot of money upfront and a little money in the long run over players who buy their console and Game Pass separately. Not a bad deal, all things considered.
Some things to note: you should be interested in Microsoft's Game Pass Ultimate subscription in the first place and know that it locks you in to that subscription for a full two years. It's also subject to a credit check and approval of a line of credit from Citizens One bank, which is partnering with Microsoft for the program.

Xbox Series X Launches Nov. 10 for $499 (polygon.com) 68

Microsoft's next-generation consoles, the Xbox Series X and Xbox Series S, will be released on Nov. 10, Microsoft announced on Wednesday. Microsoft also confirmed the price of Xbox Series X: $499. Pre-orders will open on Sept. 22. From a report: As part of Wednesday's announcement, Microsoft also said it will expand Xbox All Access program to 12 countries. This program essentially allows players to purchase a console and Xbox Game Pass on a monthly payment program -- $24.99 a month. Xbox All Access will be available in Australia, Canada, Denmark, Finland, France, New Zealand, Norway, Poland, South Korea, Sweden, United Kingdom, and United States. Microsoft's localized Xbox Twitter accounts have also been tweeting regional pricing: In the U.K., the Xbox Series X will cost $499 and the Xbox Series S will cost $299. This holiday Xbox Game Pass Ultimate and Xbox Game Pass for PC members get an EA Play membership at no additional cost.

'PUBG Mobile' Will Escape India Ban By Cutting Out Tencent (engadget.com) 30

Last week, India banned another 118 apps with links to China. PUBG Mobile Lite and PUBG Mobile Nordic Map were included in that sweeping ban. Now, PUBG Corporation says it's looking for ways to bring the apps back to India. Engadget reports: The South Korean company was included in the ban because the mobile games are published by China's Tencent. In a statement shared today, PUBG Corporation said it will no longer use Tencent Games to publish the PUBG Mobile franchise in India. According to TechCrunch, prior to the ban, PUBG Mobile had more than 40 million monthly active users in India, so there's a strong incentive to restore the game.

"Moving forward, PUBG Corporation will take on all publishing responsibilities within the country," it said. "As the company explores ways to provide its own PUBG experience for India in the near future, it is committed to doing so by sustaining a localized and healthy gameplay environment for its fans."

Microsoft Confirms Compact, $299 Xbox Series S Next-Gen Game Console (techcrunch.com) 57

Microsoft has confirmed via its official Xbox Twitter account that a discless, tiny Xbox called the Series S will be released alongside its forthcoming Xbox Series X. From a report: The Series S was initially leaked late Monday, first by Brad Sams on Twitter, and also by Walking Cat. The Xbox account tweeted an image fo the same small design dominated by a large, round vent grill, and said that the estimated retail price at launch for the new version of the console will be $299. The original leak from Sams also includes the $299 price, and Walking Cat's leaked trailer video inlaid more details -- including noting that the console is 60% smaller than the forthcoming Series X, but that it includes a high-speed 512GB NVMe SSD, with performance offering up to 1440p resolution at 120FPS, along with 4K upscaling. It'll also support DirectX ray tracing.

EA Pulls Ads from 'UFC 4' Replays After Widespread Complaints (engadget.com) 37

EA's UFC 4 is off to a rough start. From a report: The developer told Eurogamer it had removed commercials from the MMA game's replays and overlays after many fans complained about the experience. These weren't small, unintrusive promos -- one commonly-cited example was a full-screen video ad for Amazon's second season of The Boys. UFC 3 players have reported similar ads. The company said it turned the ads on in early September, but that it was "abundantly clear" from the backlash that ads in replays and overlays were "not welcome." These commercials "will not be reappearing in the future," EA said. It added that ads weren't new to the UFC series, but were typically reserved for main menu titles or Octagon logo placements. Critics complained not just that they were seeing ads in a paid game, but that the timing was dishonest. The ads appeared roughly two weeks after UFC 4's launch, or well after initial reviews. If you were an early adopter, you wouldn't have realized you were in store for a marketing blitz.

Beginning today, Animal Crossing: New Horizons players can add official Biden-Harris campaign signs to their island yards. Engadget reports: At the moment, there are four sign designs -- the official Biden-Harris logo, the Team Joe logo, a "Joe" Pride logo and an image of red, white and blue aviators. To add the signs to their yards, players will scan QR codes through the Nintendo Switch Online app. The campaign has also sent the signs to a handful of gaming influencers, who will share them throughout the day tomorrow. Campaign staffer Christian Tom said this is just the beginning. The team is planning more "digital swag," voter education tools and organizing efforts for Animal Crossing and other platforms. That makes sense considering Animal Crossing's popularity -- the game has sold more than 22 million units.

Nvidia's RTX 3090 Demo Emphasizes the Absurdity of 8K Gaming (venturebeat.com) 142

Jeff Grubb, writing for VentureBeat: One of the things I would like you to associate with me is a skepticism of 4K gaming. I play in 4K on my PC using a 32-inch monitor that I sit a few feet away from, and that is great. But outside of that scenario, the 2160p resolution is wasted on our feeble human eyes -- especially when it comes with a sacrifice to framerate and graphical effects. And yet, I admit that Nvidia's marketing got to me when it showed gamers playing 8K games using the new RTX 3090. The idea of gaming at such fidelity is exciting. One of the elements that makes exploring 3D worlds so enthralling are the details, and -- well, you can get a lot of that at 4320p. But 8K gaming is still, of course, absurd. And the lengths that Nvidia had to go to show it off is evidence of that.

In its RTX 3090 promotional video, Nvidia had a number of livestreamers and influencers sit down to experience gaming at 4320p. The results seemed to impress everyone involved. The participants provided a lot of gasps and exclamations. But to get that reaction, the event had those influencers sitting just feet away from an 80-inch 8K LG OLED. And it takes something that extreme to get even the minimal benefits of that resolution. Even at 80 inches, you'd have to sit within 3 feet of the panel to notice a difference in pixel density between 4K and 8K. Now, I'm not saying I don't want to play games this way. I'd love to try it. And if I had an unlimited budget, maybe I'd dedicate a room in my manor to something like this. But even then, I would know that is silly.

Sony Ponders Potential PS To PC Ports (arstechnica.com) 41

An anonymous reader quotes a report from Ars Technica: Horizon: Zero Dawn probably won't be the last former PlayStation exclusive to make the jump to PC. In its 2020 corporate report published late last week, Sony says that it "will explore expanding our 1st party titles to the PC platform, in order to promote further growth in our profitability." The "explore" wording there is a little bit couched, suggesting that Sony still hasn't completely made up its mind on the specifics of further PC game publishing. And the report doesn't go into detail on which games, if any, Sony considers ripe for porting. And even if Sony does continue publishing on PC, we shouldn't necessarily expect major PlayStation titles to hit Steam on the same day as the coming PS5. In Horizon's case, Sony waited a full 1,256 days between the game's February, 2017 launch on PS4 and its PC launch earlier this month.

All that said, explicitly mentioning the potential for PC ports in its annual report is the latest sign that Sony continues to slowly loosen its tight, walled-garden approach to game hardware and software. [...] It all speaks to a company that's more aware that "competition from online PC games and players from other industries is expected to continue to intensify," as it says in its annual report. Even as Sony pushes hard for the exclusive "speed, haptics, and sound" improvements of the upcoming PlayStation 5 this year, it is hedging its bets somewhat with support for non-Sony hardware as well.

Pandemic Sends Videogame Museum Into Two-Year Shutdown (gamesindustry.biz) 25

Oakland's nonprofit "Museum of Art and Digital Entertainment" housed 40,000 historic pieces of videogame memorabilia — including 11,000 playable games. In 2017 they were the ones urging America's copyright office to allow museums and libraries to circumvent DRM to preserve abandoned online games like FIFA World Cup, Nascar and The Sims. The museum's sponsors include GitHub, Google, PlayStation, and Dolby Digital.

But now the MADE is "set to close its doors, with uncertainty ahead about whether it'll ever be able to reopen," reports GamesIndustry.biz: Founder and director Alex Handy said in an interview with GamesBeat that the group managing the museum couldn't reach an agreement on rent for the place during the COVID-19 crisis... 80% of its budget comes from admissions, its website says, and since it's been closed since March due to the pandemic, it's now forced to shut down and move its collections to storage.

Storage will be paid for thanks to donations — still open on this page and will also go towards eventually finding a new space for the museum. "The current plan is to stay in storage for two years while we raise the funds and make plans to create our dream video game museum," the museum's website reads. "When we're ready, we will be back and better than ever, mark our words."

Players have been flying directly through the eye of the storm, around the outer edges, and even so far up that planes have frozen over and needed to be de-iced. The virtual views have allowed players to track Hurricane Laura during the moments before it made landfall as a category 4 hurricane with 150mph winds. A YouTube user also captured the virtual experience of flying through Hurricane Laura, showing just how well the storm cloud formations are depicted in the game.

Nintendo plans to debut an upgraded model of its Switch console next year along with a lineup of new games, Bloomberg reported Tuesday, citing people familiar with the matter said, ceding 2020's holiday spotlight to rival devices from Sony and Microsoft. From the report: The specifications of the new machine have yet to be finalized, though the Kyoto-based company has looked into including more computing power and 4K high-definition graphics, people briefed on the strategy told Bloomberg News, asking not to be identified because it's private. Nintendo faces stiff competition for gamers' attention this fall as the PlayStation 5 and Xbox Series X are set to arrive in time for the shopping season. The release of the upgraded Switch would be coupled with, or followed by, a slew of games from Nintendo itself and related outside studios, the people said. Those games would address a wide range of players, from casual gamers seeking small doses of escapism to more devoted fans putting in marathon gaming sessions. The focus on next year's pipeline explains Nintendo's relatively quiet software release schedule so far this year, the people said.

Nintendo Copyright Infringement Threats Shut Down Switch Payload Injector (torrentfreak.com) 40

Nintendo has targeted the developer of an open-source Switch payload injector with a cease and desist notice (PDF). Faced with copyright infringement threats, the DragonInjector developer decided to shut the project down. While he doesn't agree with the allegations, an expensive legal battle is not an option. TorrentFreak reports: DragonInjector is a small piece of hardware that fits in the Switch game card slot. It allows users to install and load custom firmware on their console. While it's not advertised as a pirate tool, with third-party code it can be used to play pirated games on older Switch models. A few days ago, DragonInjector's developer formally announced the end of the project. In a message on Discord, a Nintendo cease-and-desist order is cited as the main reason. MatinatorX doesn't agree with the gaming company's copyright infringement claims but he doesn't want to fight them either.

"While I don't believe the project was or is unlawful in any way, I do not have the resources to go to court to prove that for a hobby, especially considering the project netted a loss of a few thousand dollars overall," he writes. The cease-and-desist notice was sent by Nintendo's Canadian lawyers a few weeks ago. It accuses the developer of copyright infringement by advertising and selling the DragonInjector. According to the notice, this breaks the Switch's technical protection measures. "Your unlawful manufacture, advertisement, distribution, offering for sale and sale of the DragonInjector via the Dragon Injector Website infringes our client's rights," the lawyers write.

The developer was urged to immediately stop any infringing activities. If not, Nintendo reserves the right to take further action, the notice warns, adding that the company previously won $12 million CAD in damages in a 'similar' case. The threat comes with a list of additional requests. Among other things, MatinatorX must hand over all related accounting, including the number of devices sold as well as any profits that were made.
The report notes that while Dragoninjector.com is gone, the developer registered Draconicmods.com to sell a custom Switch kickstand and other legitimate accessories.

'GamerGate' Proponent Kills Ex-Girlfriend, Commits Suicide (wired.com) 308

41-year-old Rudy Ferretti "was known in the male-dominated retro gaming community as a champion gamer — and as a raging misogynist who ferociously harassed women," writes blogger David Futrelle. "He once made a homebrew game in which the goal was to kill women.

"Last week, he allegedly gunned down his former girlfriend Amy Molter before turning his gun on himself."

Wired reports: Longtime members of the retro and arcade gaming scene say they warned community leaders and even police about Ferretti's threatening behavior for years. For close to a decade, they say, Ferretti had harassed, stalked, and threatened gamers, particularly women, pushing some out of the niche gaming scene entirely... Arcade game collector and researcher Catherine DeSpira and video game historian and storage auction buyer Patrick Scott Patterson — two of Ferretti's most public targets — say they collectively contacted police in different states a half-dozen times to report Ferretti's threats against themselves and others. They say those attempts ultimately had no effect.

All the while, clusters of retro gamers across the country egged Ferretti on in private messages and on forums, leveraging his apparent instability and misogynist inclinations against women they didn't want in the scene... "They were emboldening it, pushing him, giving him a support system," says Patterson.... The rise of the GamerGate campaign in 2014 gave Ferretti new fodder to fuel his idea that women — specifically "radical feminists," as he wrote in multiple blog posts and said in YouTube videos — were out to destroy the purity of the arcade gaming scene... Ferretti believed that his gaming acumen justified his stewardship of the community. "I can be an asshole. You know why? Because I'm a world champion. I'm a gamer," he once said in a video. As recently as April 2020, Ferretti described himself in a YouTube video as "the savior of the community..."

[I]t was a network of institutional failures — from forums to expos to law enforcement — that allowed Ferretti to continue his campaigns for over a decade. "I was trying to tell people this guy Rudy was dangerous and capable of doing exactly what he ended up doing," says Patrick Scott Patterson.

Burger King Brags About Exploiting Twitch To Advertise To Kids For Cheap (arstechnica.com) 29

An anonymous reader quotes a report from Ars Technica: Earlier this week, an advertising agency emerged with a video bragging about an ad-campaign concept: We'll invade gaming-filled Twitch chat rooms and post ads for your brand for cheap. The attached video was exactly the kind of cringe you might expect from "brand engages with video game culture," with edgy yet inoffensive quotes, footage of fake games, and digitally altered voices. But what looked like a fake ad concept has turned out to be very real -- and after examining how Twitch works, the whole thing looks like a possible FTC violation.

The ad campaign, run by the Ogilvy agency on behalf of Burger King, relied on a common Twitch trope of donating to game-streaming hosts. "Affiliate" Twitch users are eligible to receive cash from viewers, either in the form of flat-rate subscriptions or variable one-time donations, and hosts often encourage this by adding text-to-voice automation to the process. So if you pay a certain amount, a voice will read your statement out loud -- and hosts usually retroactively react to weird and offensive statements made by these systems instead of pre-screening them. (They're busy playing a game, after all.) Ogilvy's promotion revolved around the low cost of entry for these text-to-voice prompts. Their ads, written to promote a fast-food chain, were attached to specific dollar amounts. One example, as explained by Twitch streamer Ross "RubberNinja" O'Donovan (not to be confused with that other Ninja), went as follows: "I just donated $5 to tell you that you can spend $5 and get [a combined meal on our app]. It seems like a twisted strategy." O'Donovan went on to post his disdain for American fast food and compared it to what he ate when he lived in Australia, which prompted Ogilvy's "THE_KING_OF_STREAM" account to donate another $5 and make a joke about Australian food. Ogilvy had described the ad campaign as run by a "bot," implying automation, but O'Donovan's example implies some form of human control and curation in terms of reacting to Twitch host pushback.

In a Thursday report, Kotaku's Nathan Grayson went sniffing around to discover many other examples of Ogilvy's ads playing out on real Twitch channels over the course of the week -- and the Kotaku report quoted pretty much all of those hosts decrying this practice. [...] More crucially for Ogilvy and Burger King, however, is the matter of how those ads appeared: as sneaky "fan" declarations in chat rooms. Though the campaign was largely run by the aforementioned "THE_KING_OF_STREAM" account and appeared as such in Twitch chat rooms, it wasn't in any way represented by Twitch as a sponsor's account, nor were the posts labeled as "#ad" or other clear markings. As O'Donovan and other streamers have made clear, that kind of transparency would have gotten such chat statements instantly deleted or modded for violating individual channel rules. While the Federal Trade Commission (FTC) has clear guidance about "deceptive" online advertising, and it demands that channel hosts comply with FTC guidance to make sure sponsored statements are easily identified, Ogilvy may have slipped through the FTC's current guidance cracks.

Fortnite-maker Epic Games and Apple are currently embroiled in a public battle over Apple's App Store policies, and in the latest move in the dispute, Epic has announced a Fortnite tournament taking place August 23rd where players can compete to win anti-Apple prizes. From a report: Last week, Epic added a new direct payment system to Fortnite in violation of Apple's policies. Apple removed Fortnite from the App Store the same day, and shortly after, Epic launched a campaign against Apple by suing the company, releasing a "Nineteen Eighty-Fortnite" video mocking Apple's famous "1984" ad, and promoting the hashtag #FreeFortnite. Players who compete in the tournament have the opportunity to win an in-game skin of the evil-looking apple featured in Epic's "Nineteen Eighty-Fortnite" video (cheekily dubbed the "Tart Tycoon"), a "Free Fortnite" hat, and even non-iOS gaming hardware, including an Alienware laptop, a Galaxy Tab S7, a OnePlus 8 phone, a PlayStation 4 Pro, an Xbox One X, or a Nintendo Switch.
