RIAA Argues That MP3s From CDs Are Unauthorized 668

NewYorkCountryLawyer writes "In an Arizona case against a defendant who has no legal representation, Atlantic v. Howell, the RIAA is now arguing — contrary to its lawyers' statements to the United States Supreme Court in 2005 MGM v. Grokster — that the defendant's ripping of personal MP3 copies onto his computer is a copyright infringement. At page 15 of its brief (PDF) it states the following: 'It is undisputed that Defendant possessed unauthorized copies... Virtually all of the sound recordings... are in the ".mp3" format for his and his wife's use... Once Defendant converted Plaintiffs' recordings into the compressed .mp3 format and they are in his shared folder, they are no longer the authorized copies...'"

Submission + - Gamespot editor fired over review of Eidos game 2

PocketPick writes: Kotaku is reporting that following a unflatering review of the game Kane & Lynch: Dead Men, long-time editor Jeff Gerstmann is no longer under the employment of video gaming website Gamespot and it's parent, CNET. Kane & Lynch, a game published by Eidos for the Xbox 360, PS3 & PC, has been heavily featured in flash, image and text advertisments on Gamespot's website since the release on November 13th, inevitably leading to questions whether or not Mr. Gerstmann's firing was motivated by pressure from Eidos.

Pentagon Reveals News Correction Unit 757

Jonas Wisser writes "BBC is reporting that a newly created Pentagon unit has a mandate to fight 'inaccurate' news stories. From the article: 'The Pentagon has set up a new unit to focus on promoting its message across 24-hour rolling news outlets, and particularly on the internet. [...] A Pentagon memo seen by the Associated Press news agency said the new unit will "develop messages" for the 24-hour news cycle and aim to "correct the record". A spokesman said the unit would monitor media such as weblogs and would also employ "surrogates", or top politicians or lobbyists who could be interviewed on TV and radio shows.'"

Pact Not to Use Image Constraint Token Until 2010? 285

Devlin C. writes "Ars Technica reports that many major movie studios and several consumer electronics companies have an unofficial pact not to use the controversial Image Constraint Token in movies until at least 2010, presumably in an effort to spur early adoption. As the article at Ars notes, this would explain why both the low-end PS3 and the Xbox360 lack HDMI. The companies think it's not necessary to have right now, and they would rather shave costs than sell future-proof hardware."

An anonymous reader writes "WSJ reports on a new MPAA estimate losses due to piracy. "The study, by LEK Consulting LLC, was completed last year, and people familiar with it say it reached a startling conclusion: U.S. movie studios are losing about $6.1 billion annually in global wholesale revenue to piracy, about 75% more than previous estimated losses of $3.5 billion in hard goods. On top of that, losses are coming not only from lost ticket sales, but from DVD sales that have been Hollywood's cash cow in recent years."

Snarfed has an interesting review on Gmail vs Pine. From the article: "I've used Pine as my email client for, well, pretty much forever. I use it because it's fast, powerful, stable, and very keyboardable. (I hate the mouse.) However, since I work at Google, I'm constantly bombarded with people who ask me why I don't use Gmail. After hearing the nth person brag about how much it increased their productivity, I finally broke down and tried it. I didn't expect much, since I've never liked web-based email clients. However, I made myself use it as my only email client, for a month, to give it a fair shot."
