Kernel modules have definitely been a contentious issue vis-a-vis the GPL. That being said I believe you are 100% correct. Although MadWifi is dual license, in this case linking to the kernel provides the GPL infection to force the decision. Well again they have not yet replied to me as of yet so let's hope they also come to this conclusion and release this code.

There is even a nice link, "tell us what to do with your photos". So I click on the link expecting to be taken to a page where I can do a few clicks and easily move my photos to Flickr. To my disappointment the page I am presented with is his some useless text, a link to Flickr and a link "take me to my photos" which takes me to another useless page. Yahoo! way to build up my expectations, then quickly bring me back down to earth.
