Since you didn't post to my Apple bashing anonymously, I will explain myself...

My impression and limited experience of Mac users has been folks who genuinely think Apple is innovative. I believe they are not. They take existing technology and perhaps make it more mature by adding a good interface to it. I give them credit for making things like mp3 players more mainstream but they did it by trying to pushing their own format. In the end they are bad for the industry and I am glad their strategy of keeping everything closed failed the last time around they were a heavy player.

Very simply, if "Apple" in the article was replaced with the less word hip "Sony" all the Apple fans would not be happy.

I am afraid you are incorrect. Intent is very relevant for crimes.

If someone kills someone accidentally, say for example in a car accident they are not guilty of a crime (for example someone jay walking and jumping in front of your car). However, if someone kills someone while drunk driving or say robbing a bank, they are. This is the gray area that exists but basically in the 2 latter situations it would be criminal and the punishment would be penal NOT civil or monetary (though you can have a civil penalty as well). A mens rea (guilty mind) standard is applied which goes to intent.

Furthermore, the implied warranty is uniform commercial code and NOT criminal. There is no penalty of loss of freedom (ie jail) in the UCC and neither should there be.

Crimes require intent. AKA a guilty mind (mens rea). I assume the majority of the updates were successful which would make it hard to prove they intentionally wanted to brick units to charge repairs.

I wonder if just modified units were bricked (in Apple's grand tradition).

I think the point is that you cannot do with an iPhone what I can do with my WM device without jailbreaking it (and I can still do more with my pro2 even then). And most "apple fanboi's" support and are proponents of Apple regardless of how closed they are. They follow them no matter how Apple treats their customers. They are no different than M$ and in my opinion worse.

I do like their interface. Probably their only real contribution.

They are not the police and they shouldn't be trying to police what bad things can come from good things. They should be selling software. The reason is more likely that they are control freaks and not noble. Apple the spoiled preferred child really IMHO is as bad if not worse than MS in having a closed system. Their sheep of users always give them a free ride.
