Hugh Pickens writes "The Fourth Circuit Court of Appeals has issued an opinion affirming a ruling that will be cheered by digital fair use proponents for allowing a fair use of students' work when their teachers electronically file students' written work with the turnitin.com Web site so that newly submitted work can be compared against Turnitin's database of existing student work to assess whether the new work is the result of plagiarism. The court stepped through the fair use analysis, dropping positive notes that affirm commercial uses can be fair uses, that a use can be transformative 'in function or purpose without altering or actually adding to the original work,' and that the entirety of a work can be used without precluding a finding of fair use. Techdirt suggests that all of these points could have been helpful to Google in defending its book scanning efforts, 'since it could make pretty much the identical arguments on all points.' Unfortunately Google caved in that lawsuit and settled, 'denying a strong fair use precedent and making Google look like an easy place for struggling industries to demand cash.'"

On Monday Bethesda announced a new title in the popular Fallout series called New Vegas, set for release sometime in 2010. It's planned for the PC, Xbox 360, and PS3. They said it wasn't a sequel to the highly-acclaimed Fallout 3, but rather a brand new game set in the same universe, though they confirmed that it will be similar in style to Fallout 3. The new game will be developed by Obsidian Entertainment, a studio containing members of the original Fallout team, which Bethesda's Pete Hines discussed in an interview with Shacknews. The Fallout series also made headlines earlier this week when Bethesda trademarked the name for TV and film.

DesScorp writes "The Wall Street Journal is reporting that Energy Secretary Steven Chu is endorsing 'clean coal' technology and research, and is taking a pragmatic approach to coal as an energy supply. '"It absolutely is worthwhile to invest in carbon capture and storage because we are not in a vacuum," Mr. Chu told reporters Tuesday following an appearance at an Energy Information Administration conference. "Even if the United States or Europe turns its back on coal, India and China will not," he said. Mr. Chu added that "quite frankly I doubt if the United States will turn its back on coal. We are generating over 50% of our electrical energy from coal."' The United States has the world's largest reserves of coal. Secretary Chu has reversed his positions on coal and nuclear power, previously opposing them, and once calling coal 'My worst nightmare.'"

machaut writes "Twitter, one of the highest profile Ruby on Rails-backed websites on the Internet, has in the past year started replacing some of their Ruby infrastructure with an emerging language called Scala, developed by Martin Odersky at Switzerland's École Polytechnique Fédérale de Lausanne. Although they still prefer Ruby on Rails for user-facing web applications, Twitter's developers have started replacing Ruby daemon servers with Scala alternatives, and plan eventually to serve API requests, which comprise the majority of their traffic, with Scala instead of Ruby. This week several articles have appeared that discuss this shift at Twitter. A technical interview with three Twitter developers was published on Artima. One of those developers, Alex Payne, Twitter's API lead, gave a talk on this subject at the Web 2.0 Expo this week, which was covered by Technology Review and The Register."

Jamie gave me a nice writeup of a mashup where the writer shares some random youtube mashup video that you maybe have seen before called the Mother of all Funk Chords. It's a pretty amazing artistic achievement and probably worth at least a quick glance of your time. But the larger point should be taken seriously. He says "If your reaction to this crate of magic is 'Hm. I wonder how we'd go about suing someone who "did this" with our IP?' instead of, 'Holy crap, clearly, this is the freaking future of entertainment,' it's probably time to put some ramen on your Visa and start making stuff up for your LinkedIn page.
