Your whole post is a huge slam at D&D 4th, and I have one thing to say: a massive portion of the D&D population has stayed with 3.5 (or earlier!), and have no intention of moving on, for the exact reasons you mentioned. "If I wanted to play WoW, I'd play WoW. I want to play D&D."

So I'd like to know the definition of "other restaurants" that plaintiff claims are serving cooler coffee. It is very telling that they do not cite any coffee- or restaurant-industry standard for coffee serve temperature.
So, to use your logic just a bit further, it would be OK for McDonalds to serve coffee far too hot to be safe, if only it was an industry standard?

Knowing what is quality and producing something that is quality are completely unrelated skills.
Running on my netbook right now:
1) Firefox
2) Tagaini Jisho (Japanese Dictionary client)
3) miniAim (AIM client)
4) Skype
5) Unlocker (never leave home without it!)
6) Hamachi (so I can access my home network)
7) Foobar2000 (listen to various types of audio)
8) Proxy Switcher (required for my university's network to not infuriate me)
9) Avast! Antivirus (wouldn't count towards the limit, thankfully)
10) Orbit Downloader (grab youtube videos, etc)
11-12) A couple of random dell utilities that are marginally useful and take up about 0% CPU time.
And that's just what gets left open. And it still run fine (Dell Mini 9, gig of ram). I may not be the typical user, but I'd simply rather not have to make the sacrifice of which 8 of those I want to cut out (9 if I ever want to do anything else, like watch a movie file, or use my flashcard program, or play a game, or check my mail with thunderbird, or...). That sucks.
Actually, doing those things is akin to running cheat programs or hacks. Buying gold in a boring MMO is completely unlike your two examples. I am only mildly surprised you got modded up, however.
