Jackson Browne has sued the Republican National Committee, the Ohio Republican Party, and John McCain for unlawful use of his song and recording, "Running On Empty" in an Ohio ad criticizing Barrack Obama's energy policy.

Jackson Browne is a long-time supporter of the Democratic Party, as well as an activist for liberal causes, and is claiming trademark infringement under the The Lanham Act, because it infers a false association to the McCain campaign. He is also suing under California's Right of Publicity Law.

The McCain campaign claims they are being improperly targeted, because they were completely unaware that the Ohio Republican party was making the ad. The Washinton Post reports that Browne's attorney, Lawrence Y. Iser, said, "we have been informed and believe that McCain and his campaign were well aware of the ad".

Not a proper target, just because the McCain campaign was ignorant that the song would be used in an advertisement for it? It seems that Senator McCain is getting introduced to the DMCA, up close and personal.

Making a List, Checking it Twice; Going to Find Out Who's Naughty and Nice...

January 17, 2007, the US Senate Committee on Commerce, Science and Transportation conducted a hearing: Aviation Security - Reviewing the Recommendations of the 9/11 Commission. At the hearing, Edmund S. "Kip" Hawley, Director of the Transportation Security Administration (TSA) testified. From Hawley's prepared statement:

"TSA is firmly committed to protecting the privacy and civil liberties of travelers. After completing a vulnerability assessment of the Secure Flight program and after considering feedback from the Congress and the Government Accountability Office (GAO), as well as DHS evaluations of the program, I announced to this Committee that TSA was re- baselining the program. At that time, we undertook this effort to assure privacy and information security in Secure Flight by making sure the foundation of the program was strong and that it will be successful upon implementation. That work has now been completed.

I am pleased to update you that we are currently working with the DHS Screening Coordination Office (SCO) toward achieving DHS certification and demonstrating satisfaction of the ten areas of Congressional direction to GAO. We are working closely with GAO to facilitate their review of the program's development. In addition, through regularly scheduled meetings with U.S. Customs and Border Protection (CBP), we are coordinating airline industry needs with CBP and the airlines with the intent of providing a single DHS system interface to the industry. Key to our efforts in improving passenger pre-screening has been the tremendous undertaking to systematically review names on the No Fly List. The purpose of the review is to remove, or downgrade to the Selectee List, individuals that do not meet the established criteria for the No Fly List. The review implements new guidance for the No Fly and Selectee Lists ratified in July 2006 by the Terrorist Screening Center's (TSC) Governance Board. Just as the threat environment is fluid, so must the No Fly List be maintained as a true list of individuals who currently pose a threat, rather than maintaining on the list those who were feared to have presented a threat in the past, but no longer do. TSA and the TSC, in collaboration with all the nominating agencies responsible for compiling the No Fly List, are in the process of a thorough, name-by- name review of that list. We expect that by the time the review is completed in mid- February, the No Fly List should be reduced by approximately 50%. A similar review will be undertaken with respect to the Selectee List.

"Integral to the successful execution of our passenger pre-screening efforts is our redress system, by which travelers who either previously have been misidentified or believe they are on the No Fly or Selectee List in error may apply to have that error corrected. We have significantly modified the process in response to customer feedback that the process was too cumbersome and expensive. Now an applicant need submit only a single document--a United States Passport--to verify his or her identity. Approximately 70% of applicants have this document and are therefore able to apply for relief without submitting other documentation. We have also eliminated the requirement that identity documents be notarized and we allow electronic submission of the application and supporting documentation. Finally, TSA introduced an automated Redress Management System (RMS). After assuring the privacy of users and the security of the system, RMS was launched on October 6, 2006, enabling travelers to submit and check the status of their applications electronically via the internet.

The real news is that the head of the TSA admitted that the No Fly List had a 50% false positive rate. Does anyone believe that there is not a commensurable false negative rate too?

Tom DeLay has entered the blogoshpere...sort of. It seems to be in name only, as Mr. DeLay admitted it is ghost-written during an appearance on MSNBC's Hardball, Dec. 11, 2006:

It's that pesky ghost blogger who must have also written DeLay's opening statement about why he started a blog, even though he's not blogging.

Quote, "I did not fully realize the impact or potential of the blogosphere until very recently, when Red State gave me the opportunity to post some of my observations in the wake of the recent midterm elections. The response I received was overwhelming, and I would like to again thank the fine people at that site. Most are far too blue for us to repeat. We don't mean that in blue-versus-red. But we can quote a few, and now you tell it all (ph).

The "sharp-eyed blogger" is named James J. Risser. Risser archived 111 comments at DeLay's blog before they were taken down, and placed them on a new blog: tomdelaydotcom.blogspot.com.

Realists, employing Machiavellian machinations jacked conservatism from its righteous practitioners and wrapped themselves in its stolen mantle, a long time ago, and the GOP never looked back. One can find theocons, paleocons, hypocrittercons, moronicons, Imperialcons, imperilingcons, fascistcons geldedcons, derelictcons, impeachacons, and yes, of course, those preponderate renunciators and betrayers of their past claimed political affiliations, the NeoConnivers, who presently still hold an extremely limited ascendancy within the Party. The GOP is chasmaniacally schismatical, approaching critical mass, in danger of becoming a major humpty-dumptied clusterfuck capable of causing mayhem if it blows. Even though Conservatism is fractured and headless, it still continues to grow, and revisionaries within the GOP's Little Shop of Manufactured Terror keep coming up with even more phantasmagorical depictions of the Big Circus Tent of GOP Inclusiveness, as the Republican Party lumbers on as the Party of Nothing for Everybody. It is like the cockroach that has been smashed and bisected into two parts by the bottom of your shoe, which still manages to get both of itselves under the refrigerator before you can grab a paper towel to pick up its guts, and frightfully these brain dead Neoconnivers, running only on instinct, whilst foully oozing a poisonous dark grey/green ichor still seem to be in semiauto control. With lurching jerks, they continue pulling America inexorably into its setting sun.

The Republican descent into situationalism occurred just prior to the historical primary purveyors of Americanised Moral Relativism's abrupt 180° polarity shift within the common misConceptualised Linear Political Scale from left to right, and concomitant NeoConnivers' conversion from Trotskyite Hawks and the NewLeft's PolitiqueChic into the Gimper's FauxCon, The Apostolic ReaganComics, who were also multivalent apostates: Stalinists, who had fled the purges into Troskyite Ideologues - into Rabidly AntiNaziLeftists - into CIA paid Stooge Providers of Americanised Individualist ArtForms as a foil to Stalinist Realism in the Post WWII EuroTheatre of Cold War. A convergence did began to appear in th early 70's. Maybe this isn't as great of a strectch as it seems, since both sides seemed desirous of assuaging any guilt of, and deflecting any blame from former associations by expressing AntiSoviet fervency laid out in terms couched in the lingo of radicalised religiosity.

The rabid blind-feith belief in fallacy by the GOP Base of the Rank and Defiled: that Reagan epitomised core conservatism, should be seen as the spin that it is. Trotskyites, and Democratic Scoop Jackson hawks, limp wristed slcialistic libs, the whole lot of them, were appointed to primary positions inside the Asleep at the Wheel Presidency of Reagan, who upon rational reflection, had by this time, transparently begun his long goodbye as a tenacious rogue protein resolutely worked its way up through Reagans' brainstem, into his cerebellum and on through his cerebrum. Too many unseen hands were in actuality working policy within the Reagancomedy. Too few were held accountable for their actions in the ongoing criminal enterprise commonly referred to as "Iran/Contra".

Reagan was certainly no real conservative, but without a doubt was the consummate Post WWII Pitchman for American media. Reagan was capable of walking directly out of a Hollywood TV producer's office onto the sound stage where B-grade cowboy TV shows were being made, and with cum acquired during his previous scheduled appointment still running down his cheeks, pitching the inane product of a soap additive to the public so effectively, its manufacturer became a Corporate powerhouse.

The NeoConnivers just packed up and walked away from Iran/Contra, just as some are doing this very day from bushido imperialism, and will gladly hide under a rock provided by some right-sided policy tank until time and neocon circlejerking self-referencing publications clean their public image into acceptability again.

A post of mine was modded as flamebait, that just asked for citations to back up the parent's claims. Admittedly, it was a harsh request, but anyone can see that citations were not proffered in response.

Why has "evidence" become an obscence concept to the right-side of America's political bipolarity?

• He has excited religious zealotry amongst the world, and through his waging of indefensible war, has greatly increased the probability that our inhabitants will once again have to face merciless terrorists, whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions.
• In every stage of these Oppressions He has been Petitioned by Allied Leaders from abroad, and citizenry from within. The repeated Petitions have been answered only by repeated tergiversations.
• A President, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free People.

The Legion Antithetical to Bush Bellicosity,
appeal to the Supreme Judge of the World
for the rectitude of our intentions,
do, in the Name, and with the Authority invested by
Freepersons Still Willfully Possessing Honour,
solemnly publish and declare,
That these United States,
ought to be Free and Independent from;
and Absolved of all Allegiance to
George Walker Bush, the Forty-Third President
of the United States of America.
