I had the same initial reaction then I actually read the article...

It is not as clear cut as it seems. The man is able to map most commenters to identified customers but the seven identified in the suit are exceptions. His contention is that they are NOT customers and are making fraudulent statements bringing it under libel law instead of free speach. Apparently he was able to provide convincing evidence to the judge.

While I am not anti-vaccination -- yet. I have started to question the "conventional wisdom" of vaccinations in general and influenza in particular. Unfortunately, while I have started to read some of the pro and con information out there I do not have enough knowledge to make a reasonable conclusion. I USED to believe what you do, now I am not so sure. I am skeptical by nature and do not trust "journalists" or reporters to get most things accurate so prefer to find source material but it can be time consuming. There is a lot of material out there that seems logical on both sides. There is also quite a bit of money to be made on the pro side, which is always a concern, particularly when you look at the steep rise in "mandatory" vaccinations for school and some claimed projections of future requirements.

For 10 years while in the military I was required to receive the vaccine, then for about 5 years I did not get it. A new job that offered free shots and kids that started going to school convinced me to get it again. Left that job and went without for a year or two until my current gig made it available again for free. So, while I did get it again this year I debated and came close to taking a pass.

Then you can come to that conclusion WITHOUT jumping over opinion and wishful thinking.

What about the deserving green technology companies that MIGHT have done well but for having to compete with a government subsidized failure?

Yeah, I gotta call BS on this one. The lawyers "agreed she had a valid claim", but it would cost her $50,000 in legal fees so it wasn't worth it? For $2,000,000? Let's see, $50K from $2 mil leaves... 1.95 MILLION DOLLARS! I guess the lawyers didn't want the money either? Give me a break.

Just because she has a "valid claim" does not mean that she will win. Nor does it mean that by the time she does win that the 10% share would be of $20M. What if her litigation causes the sale to fall through? What if she does win but it takes 5 years and by that time there is nothing left of the company? What if the 10% she was given 5 years ago has now been diluted by the next 10 people after her that were each given 10%?

Lots of reasons a 100k payout now on a "valid claim" to a possible future 2M might be the better choice.
