It IS true that one does not NEED the OGL to lawfully create works that use Dungeons and Dragons game mechanics. The fact that TSR may have been a vexatious litigant is not relevant to the law.

That being said, I'm not arguing that something like the OGL might give some confidence to move forward with creating products for D&D.

Right. But no one needs the OGL to make or sell companion material so long as they do not use copyrighted works (art, text, etc.) or trademarks beyond fair use (you canâ(TM)t claim your campaign is official D&D, but you can say it is compatible with D&D rules).

A couple things. Do you think the framers envisioned a scenario where a single state would have approximately 72x the population of another? Given that information, do you think they would have balanced the senate so heavily toward WY? Let us concede for a moment that it is beneficial to everyone if a thumb is placed on the scales for low population states in the senate. Does this mean that exactly equal representation between a state with 500k and a state with 36 million is the correct balance of power? Why not two for WY and eight for CA? Or six? Or ten? At some point the equal representation in the senate stops being a useful balance and becomes unjust. And I would also argue that the concerns of the people of CA are not all that different to those of the people of WY. CA is more than LA and Silicon Valley. There is a whole lot of agriculture being done there.

Yes. I would argue yes. California has a population of over 35 million, yet Wyoming can throw its lot in with just one other low-pop state and that caucus of two states with a total population of just a fraction of California will have twice the representation in the Senate. What is so special about people in Wyoming that their vote should count for more than mine?

No. 230 should protect them from content its users post. It should not protect them from liability regarding content they promote or recommend. A distinction can be made to allow search algorithms to function, while not holding them liable for defamation or the like based on results of a search that a user prompted. Google is lying when they say these distinctions are impossible.
