Comment Got to side with Apple on this one... (Score 5, Interesting) 980

They have a platform worth billions. Tens of billions. They have chosen to make it closed. You as a consumer can chose to use there platform or not, that is up to you. For them, to potentially put the fate of a multi-billion dollar product in the potential hands of a company that makes development content for this multi-billion dollar platform and not control it is suicide.

You can argue the merits of closed or open but in this case the point is moot. iPhone is closed and Apple wants it that way. They are not going to put their fate in the hands of Adobe. The only legs Adobe may have to stand on is if they were lead to believe that their platform was to be accepted (written contract or verbal) and then at the 11th hour to be shafted? Well then maybe they have a case.

Hey, I was the engineering dept. manager back at VLSI Tech back when chip sets was a good business. Intel decided, rightly so, that they could not put the fate of their CPU's in the hands of 3rd party chip set vendors. In ONE product cycle (after they finally figured out how to make them) they took 90% of the PC market with their chip sets. Did it hurt? Yea, it hurt. We went from $250M/yr to $25M/yr in 12 months. I lost my job along with a host of others. That being said, I still can't fault Intel for what they did. Quite frankly I'm surprised it took them as long as it did. The case in point with Apple and Adobe is no different.

No, I don't "..obviously do" I never said it was either decent nor acceptable but it is how business is done. To not recognize the fact is to be incredibly stupid.

I don't behave that way nor condone it but I also realized quite early on that not being in a position of power to stop it I may as well stand on the beach and ask the tide to not come in. You want to go fight windmills, knock yourself out.

Having worked at numerous high tech companies and been on both sides of the litigation fence you come to realize, it is simply part of your business. Plain and simple. There are some rules like:

1) Never sue someone who doesn't have money unless they are a blatant rip off stealing your business.

2) You wait until they are making money. Then you walk in with your 3 foot stack of patents and say "We believe you are infringing all of these patents, pay up and cross license or we will file suit on each and every one." Then they usually follow with.." this week we are running a special, $15K/inch of height with a 2% on your revenue, AND we will throw in a set of Ginsu Knives" You in turn gag, renegotiate, build your own portfolio and look forward to the day 5 years from now when you can do the same to another competitor.

Like on the Soporano's "It's not personal.. its just businss"

Yea, I remember Balmer dissing the iPhone. "So what so they sell a million phones. WE have the OS in millions of phones"

So we fast forward a few years and there are what, 30 million or so iPhones out there at $600 a crack to Apple and if I remember correctly iPhone installed base just surpassed phones with Windows Mobile in them. Yea.... right. Well they are not perfect but for me I think I would like Apple's revenue per phone much more than Windows Mobile but what the hell, gives Steve another reason to kick some more chairs.

Love their products in general. MacPro and MacBook user myself but I hate their mice and their keyboards. They both have always sucked.

The Lisa sucked big time. As did Newton but ... they paved the way for future products some by Apple some not that were quite successful.

No guts no glory. They at least stick their neck out there and try things. Sometimes it does not always work.

Having worked 28 some years in the semiconductor industry grinding out chips for PC's the story sounds SOOOooooo familiar.

"It's just this time...honest....just give up your entire personal life.... your wife and kids will love you for it cause we are just going to rain cash and kudo's on you"

Fast forward 2 years later...

"Ok, so my wife left me, my kids hate me and now your telling me my bonus went to the CEO and his butt buddies on the board because they needed something to light their cigars with and now your laying me off because we missed the market because you couldn't make up your friggin mind what you wanted and we all killed ourselves for you for nothing? Do I understand this right?"

Sux don't it?

I feel fortunate to have stashed just enough away to moon them all Ace Ventura style and walk away. Those in this kind of mess really have to ask themselves what is REALLY important. Those that run places like this which is 90% of corporate business these days don't give a rat's ass about you. Employees are an expense to be reduced not an asset to be valued. Think you are not replaceable. Put you hand into a bucket of water and pull it out and see how fast that hole fills up. That is the reality. If you really like that work more than life itself, then that is what you should do but if not..... you might just want to look around.
