Amazon's AI Cameras Are Punishing Drivers For Mistakes They Didn't Make (vice.com) 154

In February, Amazon announced that it would install cameras made by the AI-tech startup Netradyne in its Amazon-branded delivery vans as an "innovation" to "keep drivers safe." As of this month, Amazon had fitted more than half of its delivery fleet nationwide with this technology, an Amazon spokesperson told Motherboard. Motherboard spoke to six Amazon delivery drivers in California, Texas, Kansas, Alabama, and Oklahoma, and the owner of an Amazon delivery company in Washington who said that rather than encourage safe driving, Netradyne cameras regularly punish drivers for so-called "events" that are beyond their control or don't constitute unsafe driving. The cameras will punish them for looking at a side mirror or fiddling with the radio, stopping ahead of a stop sign at a blind intersection, or getting cut off by another car in dense traffic, they said.

The Netradyne camera, which requires Amazon drivers to sign consent forms to release their biometric data, has four lenses that record drivers when they detect "events" such as following another vehicle too closely, stop sign and street light violations, and distracted driving. When the camera detects an "event," it uploads the footage to a Netradyne interface accessible to Amazon and its delivery companies, and in some instances, a robotic voice speaks out to the driver: "distracted driving" or "maintain safe distance." Each time the camera registers an event, footage is uploaded into a system, recorded, and affects a score drivers receive at the end of the week for safe driving. Amazon drivers believe that AI-powered surveillance cameras have served as a cost-saving measure for the company. Amazon delivery drivers and delivery companies, known as "delivery service partners," which contract with Amazon and employ drivers, have reported losing income from erroneous citations registered by Netradyne.

China Issues Draft Rules To Curb Unfair Competition, Restrict Use of User Data (reuters.com) 18

phalse phace writes: Chinese regulators on Tuesday issued a lengthy set of draft regulations for the internet sector, banning unfair competition and restricting the use of user data, the latest move in a crackdown on the country's powerful tech companies.

According to a document published on China's State Administration for Market Regulation (SAMR) website, business operators should not use data, algorithms or other technical means to hijack traffic or influence users' choices. They may also not use technical means to illegally capture or use other business operators' data.

The regulator also said firms cannot use technological means to maliciously impose incompatible barriers to other legal internet products and services. It added that in cases involving violations, third-party institutions may be hired to audit data. The proposed regulations come after SAMR imposed various restrictions and punishments on tech giants in an effort to restrict anti-competitive or monopolistic behaviour.

Popular VPN and Ad-Blocking Apps Are Secretly Harvesting User Data (buzzfeednews.com) 46

An anonymous reader quotes a report from BuzzFeed News: Sensor Tower, a popular analytics platform for tech developers and investors, has been secretly collecting data from millions of people who have installed popular VPN and ad-blocking apps for Android and iOS, a BuzzFeed News investigation has found. These apps, which don't disclose their connection to the company or reveal that they feed user data to Sensor Tower's products, have more than 35 million downloads. Since 2015, Sensor Tower has owned at least 20 Android and iOS apps. Four of these -- Free and Unlimited VPN, Luna VPN, Mobile Data, and Adblock Focus -- were recently available in the Google Play store. Adblock Focus and Luna VPN were in Apple's App Store. Apple removed Adblock Focus and Google removed Mobile Data after being contacted by BuzzFeed News. The companies said they continue to investigate.

Once installed, Sensor Tower's apps prompt users to install a root certificate, a small file that lets its issuer access all traffic and data passing through a phone. The company told BuzzFeed News it only collects anonymized usage and analytics data, which is integrated into its products. Sensor Tower's app intelligence platform is used by developers, venture capitalists, publishers, and others to track the popularity, usage trends, and revenue of apps.
Randy Nelson, Sensor Tower's head of mobile insights, said the company's apps do not collect sensitive data or personally identifiable information and that "the vast majority of these apps listed are now defunct (inactive) and a few are in the process of sunsetting." But, as BuzzFeed points out, most of the apps are no longer available "because they were removed due to policy violations."

Colorado's 'Open Internet' Bill Would Punish Internet-Providing Violators By Taking Their Grant Money Away (coloradosun.com) 85

Jared Polis for his certain signature. Keeping internet speeds consistent regardless of whether a customer is streaming video from Comcast or Netflix wasn't the only intent of the Senate Bill 78. The bill also makes internet service providers pay back state grants to build broadband infrastructure if those companies use paid prioritization to favor some internet traffic over others, or slow down speeds for some users.

The Colorado law is similar to the former federal one in that it would prohibit ISPs from prioritizing certain content. It would also force violating ISPs that benefited from state broadband grants to refund all money received in the previous 24 months. After the governor signs the bill into law, Colorado's attorney general would by Oct. 1 create guidelines on how consumers can file complaints about net neutrality violations.
"What I was really looking for in this year's bill was the appropriate nexus of action. A lot of the bills we saw getting in trouble in other states, or bills that were facing a lot of opposition, were more about sending a message of net neutrality instead of looking for a fulcrum point for state action," said Sen. Kerry Donovan, a Democrat from Vail who sponsored last year's bill and wrote this year's bill. "This bill says that if you're going to ask to be funded by the people in Colorado directly out of their paycheck then you need to adhere to these principles."

He Who Has No Name writes: Those who remember Cody Wilson and Defense Distributed -- the self-described cryptoanarchist and his organization that published plans for 3D printable firearm parts, respectively -- also remember that not long after the plans for the printable Liberator single-shot pistol hit the web, the Department of State seized the Defense Distributed website and prohibited Wilson from publishing 3D printable firearm plans, claiming violations of ITAR -- the International Traffic in Arms Regulation, a U.S. law taxing and restricting the distribution of a wide variety of physical goods listed as having military value. Slashdot covered the website seizure here (the Department of Defense was initially misreported in sources to have been the agency responsible).

In both a First and Second Amendment win, the Second Amendment Foundation has settled with the Department of State after suing on behalf of Defense Distributed. Slashdot reader schwit1 shares an excerpt from the report: "Under terms of the settlement, the government has agreed to waive its prior restraint against the plaintiffs, allowing them to freely publish the 3-D files and other information at issue. The government has also agreed to pay a significant portion of the plaintiffs' attorney's fees, and to return $10,000 in State Department registration dues paid by Defense Distributed as a result of the prior restraint. Significantly, the government expressly acknowledges that non-automatic firearms up to .50-caliber -- including modern semi-auto sporting rifles such as the popular AR-15 and similar firearms -- are not inherently military."

Google AdSense Banned a Random Webpage About a 32-Year-Old Bill Because It Was About Sexual Abuse (vice.com) 110

Google AdSense, Google's advertising program that makes up the bulk of the tech giant's advertising revenue, decided that a web page about a decades-old bill about sexual abuse was "adult content," and wasn't allowed to display ads anymore. The page, which is at least six years old and contains strictly legislative information about a bill called the "Child Sexual Abuse and Pornography Act of 1986" on free legislative research and tracking website GovTrack.us, tripped the AdSense algorithm that decides what pages are allowed to run ads. This single, very dry page being flagged as "adult content" is most likely a minor fluke in the AdSense algorithm, but it's a perfect example of how a tiny tweak in the way a platform uses automation to enforce policies can send a ripple through seemingly-unrelated parts of the internet. The page was flagged by Adsense as "policy non-compliant" on Monday, with Google citing the page's "violations" in a summary of the AdSense adult content policy. Here's what Google told GovTrack: "As stated in our program policies, we may not show Google ads on pages with content that is sexually suggestive or intended to sexually arouse. This includes, but is not limited to: pornographic images, videos, or games; sexually gratifying text, images, audio, or video; pages that provide links for or drive traffic to content that is sexually suggestive or intended to sexually arouse." The GovTrack page contains none of these, yet the page still can't run AdSense.

Ford Patents Driverless Police Car That Ambushes Lawbreakers Using AI (washingtonpost.com) 126

Ford has developed a patent for a police car that issues tickets without even pulling you over. The same car could also use artificial intelligence to find good hiding spots to catch traffic violators (Warning: source may be paywalled; alternative source) and identify drivers by scanning license plates, tapping into surveillance cameras and wirelessly accessing government records. The Washington Post reports: The details may sound far-fetched, as if they belong in the science-fiction action flick "Demolition Man" or a new dystopian novel inspired by Aldous Huxley's "Brave New World," but these scenarios are grounded in a potential reality. They come from a patent developed by Ford and being reviewed by the U.S. government to create autonomous police cars. Ford's patent application was published this month. Although experts claim autonomous vehicles will make driving safer and more rule-bound, Ford argues in its application that in the future, traffic violations will never disappear entirely. "While autonomous vehicles can and will be programmed to obey traffic laws, a human driver can override that programming to control and operate the vehicle at any time," the patent's application says. "When a vehicle is under the control of a human driver there is a possibility of violation of traffic laws. Thus, there will still be a need to police traffic."

The patent application says that autonomous police vehicles don't necessarily replace the need for human police officers for catching traffic scofflaws. Some "routine tasks," such as issuing tickets for failure to stop at a stop sign, can be automated, the patent says, but other tasks that can't be automated will be left to people. The application, which was filed in July 2016 and includes elaborate diagrams depicting the autonomous police car interacting with its environment, says officers could be inside the vehicle at all times and reclaim control of the car when necessary. But the application also shows how an autonomous police vehicle could be able to carry out many tasks we associate with human officers.

EFF: Accessing Publicly Available Information On the Internet Is Not a Crime (eff.org) 175

An anonymous reader quotes a report from EFF: EFF is fighting another attempt by a giant corporation to take advantage of our poorly drafted federal computer crime statute for commercial advantage -- without any regard for the impact on the rest of us. This time the culprit is LinkedIn. The social networking giant wants violations of its corporate policy against using automated scripts to access public information on its website to count as felony "hacking" under the Computer Fraud and Abuse Act, a 1986 federal law meant to criminalize breaking into private computer systems to access non-public information.

EFF, together with our friends DuckDuckGo and the Internet Archive, have urged the Ninth Circuit Court of Appeals to reject LinkedIn's request to transform the CFAA from a law meant to target "hacking" into a tool for enforcing its computer use policies. Using automated scripts to access publicly available data is not "hacking," and neither is violating a website's terms of use. LinkedIn would have the court believe that all "bots" are bad, but they're actually a common and necessary part of the Internet. "Good bots" were responsible for 23 percent of Web traffic in 2016. Using them to access publicly available information on the open Internet should not be punishable by years in federal prison. LinkedIn's position would undermine open access to information online, a hallmark of today's Internet, and threaten socially valuable bots that journalists, researchers, and Internet users around the world rely on every day -- all in the name of preserving LinkedIn's advantage over a competing service. The Ninth Circuit should make sure that doesn't happen.

Oregon Fines Man For Writing a Complaint Email Stating 'I Am An Engineer' (vice.com) 734

The email claimed that yellow traffic lights don't last long enough, which "puts the public at risk." "I would like to present these facts for your review and comments," he wrote. This email resulted not with a meeting, but with a threat from The Oregon State Board of Examiners for Engineering and Land Surveying [stating]: "ORS 672.020(1) prohibits the practice of engineering in Oregon without registration -- at a minimum, your use of the title 'electronics engineer' and the statement 'I'm an engineer' create violations." In January of this year, Jarlstrom was officially fined $500 by the state for the crime of "practicing engineering without being registered." Since the engineering board in Oregon said Jarlstrom should not be free to publish or present his ideas about the fast-turning yellow traffic lights, due to his "practice of engineering in Oregon without registration," he and the Institute for Justice sued them in federal court for violating his First Amendment rights. "I'm not practicing engineering, I'm just using basic mathematics and physics, Newtonian laws of motion, to make calculations and talk about what I found," he said. Sam Gedge, an attorney for the Institute for Justice, told Motherboard: "Mats has a clear First Amendment right to talk about anything from taxes to traffic lights. It's an instance of a licensing board trying to suppress speech."

The complaint says that Comcast excludes Stream TV traffic from its own data cap, which is both a violation of its merger agreement and counter to the FCC's Open Internet rules. Stream TV is a $15 per month offering for Xfinity internet customers. It includes local channels, some basic cable, HBO, and the use of a cloud DVR. Most content is streamed over the home network. Public Knowledge's senior staff attorney, John Bergmayer says, "Comcast's actions could result in fewer online video choices for viewers nationwide, while increasing its dominance as a video gatekeeper. If its behavior persists, prices will go up, the number of choices will go down, creators will have a harder time reaching an audience, and viewers will have a harder time accessing diverse and independent programming."

Judge Tosses Wikimedia's Anti-NSA Lawsuit Because Wikipedia Isn't Big Enough (arstechnica.com) 213

An anonymous reader writes: A federal judge has dismissed a lawsuit filed by the Wikimedia Foundation, Amnesty International, and others against the NSA and other U.S. intelligence agencies for their surveillance of internet communications. The judge used some odd reasoning in his ruling to absolve the NSA of any constitutional violations. He said that since the plaintiffs couldn't prove that all upstream internet communications were monitored, they didn't have standing to challenge whatever communications were monitored. This is curious, given that tech companies are known to be under gag orders preventing them from discussing certain types of government data collection. The judge also made a strange argument about Wikipedia's size: "For one thing, plaintiffs insist that Wikipedia's over one trillion annual Internet communications is significant in volume. But plaintiffs provide no context for assessing the significance of this figure. One trillion is plainly a large number, but size is always relative. For example, one trillion dollars are of enormous value, whereas one trillion grains of sand are but a small patch of beach."

'Aaron's Law' Introduced To Curb Overzealous Prosecutions For Computer Crimes 206

The legislation, inspired by the late Internet innovator and activist Aaron Swartz, who faced up to 35 years in prison for an act of civil disobedience, would reform the quarter-century old Computer Fraud and Abuse Act (CFAA) to better reflect computer and internet activities in the digital age. Numerous and recent instances of heavy-handed prosecutions for non-malicious computer crimes have raised serious questions as to how the law treats violations of terms of service, employer agreements and website notices.

Location data, which is routinely collected by GPS providers and makers of telematics systems, is among the most sensitive pieces of information that can be collected, according to Nate Cardozo, an attorney with the Electronic Frontier Foundation. "Not having knowledge that a third party is collecting that data on us and with whom they are sharing that data with is extremely troubling," Cardozo said. in-vehicle diagnostics data could also be used by government agencies to track driver behavior. Nightmare scenarios could include traffic violations being issued without law enforcement officers on the scene or federal agencies having the ability to track your every move in a car. That there could be useful data in all that personally identifiable bits made me think of Peter Wayner's "Translucent Databases."

Chicago Red Light Cameras Issue Thousands of Bogus Tickets 229

mpicpp points out a report in the Chicago Tribune saying that thousands of the city's drivers have been wrongfully ticketed for red light violations because of "faulty equipment, human tinkering, or both." The Tribune's investigation uncovered the bogus tickets by analyzing the data from over 4 million tickets issued in the past seven years. Cameras that for years generated just a few tickets daily suddenly caught dozens of drivers a day. One camera near the United Center rocketed from generating one ticket per day to 56 per day for a two-week period last summer before mysteriously dropping back to normal. Tickets for so-called rolling right turns on red shot up during some of the most dramatic spikes, suggesting an unannounced change in enforcement. One North Side camera generated only a dozen tickets for rolling rights out of 100 total tickets in the entire second half of 2011. Then, over a 12-day spike, it spewed 563 tickets — 560 of them for rolling rights. Many of the spikes were marked by periods immediately before or after when no tickets were issued — downtimes suggesting human intervention that should have been documented. City officials said they cannot explain the absence of such records.

While this raises a lot of questions about who is responsible to pay for a ticket issued to a speeding autonomous car – current California law would have the person in the driver's seat responsible, while Google has said the company that designed the car should pay the fine – it also hints at a future where local and state governments will have to operate without a substantial source of revenue.

Approximately 41 million people receive speeding tickets in the U.S. every year, paying out more than $6.2 billion per year, according to statistics from the U.S. Highway Patrol published at StatisticBrain.com. That translates to an estimated $300,000 in speeding ticket revenue per U.S. police officer every year. State and local governments often lean on this source of income when they hit financial trouble. A study released in 2009 examined data over a 13-year period in North Carolina, finding a 'statistically significant correlation between a drop in local government revenue one year, and more traffic tickets the next year,' Popular Science reported. So, just as drug cops in Colorado and Washington are cutting budgets after losing revenue from asset and property seizures from marijuana arrests, state and local governments will need to account for a drastic reduction in fines from traffic violations as autonomous cars stick to the speed limit."

Michigan Police Could Search Cell Phones During Traffic Stops 525

The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program. A US Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and videos off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections. 'Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags,' a CelleBrite brochure explains regarding the device's capabilities." Popular Mechanics has a short conversation with a 4th Amendment lawyer about the practice of slurping cellphone data, too, though it's unclear if the Michigan police are actually using these devices to their full potential.

Today, Judge Emory A. Pitt threw out the wiretapping charges against Graber, leaving only his traffic violations to be decided on his October 12 trial date. 'The judge ruled that Maryland's wire tap law allows recording of both voice and sound in areas where privacy cannot be expected. He ruled that a police officer on a traffic stop has no expectation of privacy.' A happy day for freedom-loving Marylanders and Americans in general."
