seriously writes "We've all heard about BitTorrent going legit this week with legal movie and TV show downloads. Ars Technica took a look at the service to see how usable it was and ran into a few snags, including not being able to download or even open the video files on some computers. However, the ones that they did manage to open varied a lot in quality. Overall, they blame DRM: 'Without knowing whether browser compatibility and dysfunctional video files are a rare occurrence or not, it's hard to say whether BitTorrent's service is a good one overall. Our initial experiences have been disappointing and frustrating, and guess what the culprit is once again? DRM. Why the DRM failed to work on 50% of our purchases is not clear, but whatever the cause, it's simply unacceptable.'"

cancan writes "The NY times is carrying an article about how the RIAA is hiring hip hop artists to make mix tapes, and then helping the police raid their studios. In the case of DJ Drama and DJ Don Cannon, they were raided by SWAT teams with their guns drawn. The local police chief said later that they were 'prepared for the worst.' Men in RIAA jackets helped cart away 'evidence'. Just the same, 'Record labels regularly hire mixtape D.J.'s to produce CDs featuring a specific artist. In many cases, these arrangements are conducted with a wink and a nod rather than with a contract; the label doesn't officially grant the D.J. the right to distribute the artist's songs or formally allow the artist to record work outside of his contract.' " This is more of the shenanigans that we've previously discussed on the site.

Patrick Robib, a blogger who wrote his own blogging engine called Forest Blog recently noticed that none other than the MPAA was using his work, and had completely violated his linkware license by removing all links back to the Forest Blog site, not crediting him in any way. The MPAA blog was using the Forest Blog software, but had completely stripped off his name, and links back to his site. He only found about it accidentally when he happened to visit the MPAA site.

An anonymous reader writes "On December 23, Amazon advertised a 'buy one get one free' sale on DVD box-sets, but apparently did not test the promotion before going live. When anyone placed two box-sets in their cart, the website gave a double discount — so the 'grand total' shown (before order submission) was $0.00 or some very small amount. Despite terms stating that Amazon checks order prices before shipping, Amazon shipped a large number of these orders. Five days later (December 28), after orders had been received and presumably opened, Amazon emailed customers advising them to return the box-sets unopened or their credit cards would be charged an additional amount (more threads). Starting yesterday, Amazon has been (re)charging credit cards, often without authorization. On Amazon's side, they didn't advertise any double discount, and the free or nearly-free box-sets must have cost them a mint. But with Amazon continually giving unadvertised discounts that seem to be errors, is 'return the merchandise or be charged' the new way that price glitches will be handled?"

MBrichacek writes "The Journal of Political Economy is running the results of a study into P2P file-sharing, reports Ars Technica. The study has found that, contrary to the claims of the recording industry, there is almost no effect on sales from file-sharing. Using data from several months in 2002, the researchers came to the conclusion that P2P 'affected no more than 0.7% of sales in that timeframe.' 803 million CDs were sold in 2002, according to the study, which was a decrease of about 80 million from the previous year. While the RIAA has been blaming that drop (and the drop in subsequent years) on piracy, given the volume of file-sharing that year the impact from file sharing could not have been more than 6 million albums total. Thus, 74 million unsold CDs from that year are 'without an excuse for sitting on shelves.'"

Clant writes "Google has been accused of benefiting from certain piracy websites because of the Adsense program, according to reports. Several major media companies have called on Google to properly screen their AdSense partners and stop supporting sites that are benefiting from piracy. 'Legal filings show that Google worked with EasyDownloadCenter.com and TheDownloadPlace.com from 2003 to 2005, generating more than $1.1 million in revenue for the sites through the AdSense program. Google reportedly noticed the amount of traffic and advertising served by the two websites and assigned them an account representative to help optimize their efforts.'"

lisah writes "Despite what looks like an organized effort to prevent it, OpenSSL has been revalidated by an independent testing agency for its ability to securely manage sensitive data and is ready for use by governmental agencies like the Department of Defense. According to the Open Source Software Institute, who has been overseeing the validation process for the last five years (something that typically only takes a few months), it seems that the idea of an open source SSL toolkit didn't sit right with proprietary vendors of similar products. A FUD campaign was launched against OpenSSL that resulted in a temporary suspension of its validation. Developers and volunteers refused to give up the ghost until the validation was reinstated, and Linux.com has the story of the project's long road to success."
