Spouses have a lot of legal rights and privileges under civil law, tax law, and even in some criminal law (spousal privilege in testimony comes to mind). If it were a purely religious institution, there'd be no reason for heterosexual couples to seek a state marriage license either, as there's no law against a man and a woman cohabitating or even raising a child.
