Daniel_Stuckey writes: The war between New York City and Airbnb is raging on, and the future of the hospitality business hangs in the balance.

The city is fighting the startup for breaking local laws against operating an illegal hotel out of your home, worried that hustlers are abusing the online service to turn a profit. To that end, New York Attorney General Eric Schneiderman just slapped the company with a subpoena to hand over the user data of all New Yorkers who've listed their apartment on the site, the New York Daily News reported today. That's about 225,000 users.

Roku Finally Gets a 2D Menu System 80

Finally, in conjunction with the release of the new Roku 3 model, the Linux-based media streaming player is getting a two-dimensional facelift, making it quicker and easier to access favorite channels and find new ones. Current Roku users, who will now begin suffering from UI-envy, will be glad to learn that Roku plans to push out a firmware update next month to many earlier models, including the Roku LT, Roku HD (model 2500R), Roku 2 HD, Roku 2 XD, Roku 2 XS, and Roku Streaming Stick. FIS scans every click on Facebook for patterns that could suggest something malicious is spreading across the social network.

Atari Loses Copyright Suit Against RapidShare 198

Video game publisher Atari Europe recently became concerned that copies of its game Alone in the Dark were floating around one-click file-hosting service RapidShare, so it took the hosting company to court. While they won the initial case, the decision was overturned on appeal, finding that RapidShare is doing nothing wrong."

Zynga and Blizzard Sued Over Game Patent 179

eldavojohn writes "Thinking about developing a game involving a 'database driven online distributed tournament system?' Well, you had better talk to Walker Digital or risk a lawsuit, because Walker Digital claims to have patented that 'invention' back in 2002. The patent in question has resulted in some legal matters for the makers of 'Call of Duty: Modern Warfare 1 and 2, Call of Duty: Black Ops, Call of Duty: World at War, Blur, Wolfenstein, DJ Hero 2, Golden Eye 007, World of Warcraft and its expansions, Mafia Wars, and many others.' Walker Digital (parent company of Priceline.com) said it's not sure how much damages are going to be, and requested that through discovery in the court. If you think Walker Digital is not a patent troll, check out their lawsuit from two months ago against Facebook for using privacy controls Walker Digital claims to have patented. It would seem that any online competitive game that uses a database to select and reward contestants in a tournament could potentially fall under this patent — of course, those with the deepest coffers will be cherrypicked first."

By doing this, he comes up with a list of lessons that any game developer creating a sequel should follow, if at all possible, to ensure that the new game is a step up, rather than a step sideways or, as in some cases, a step down. The criteria include ensuring the game does not spend too much time in development, updating technology, and trying not to change the development team, as well as being wary of changing the basic formula so much that fans of the franchise are alienated."

Swiss Bank Has 43-Page Dress Code 212

Tasha26 writes "The HR of Swiss bank UBS AG came up with an innovative 43-page document (French) to establish fashion 'dos' and 'don'ts' in their retail branches. Among the rules are such things as: 'neither sex should allow their underwear to appear,' perhaps Dilbert was a bit ahead of them on that. The document also mentions smells and 'avoid garlic and onion-based dishes.'"

Survey Shows That Fox News Makes You Less Informed 1352

A survey of American voters by World Public Opinion shows that Fox News viewers are significantly more misinformed than consumers of news from other sources. One of the most interesting questions was about President Obama's birthplace. 63 percent of Fox viewers believe Obama was not born in the US (or that it is unclear). In 2003 a similar study about the Iraq war showed that Fox viewers were once again less knowledgeable on the subject than average. Let the flame war begin!

John Carmack Not Enthused About Android Marketplace 163

'...I'm honestly still a little scared of the support burden and the effort that it's going to take for our products, which are very graphics-intensive.'"

Have I Lost My Gaming Mojo? 418

danabnormal writes "Increasingly I'm being frustrated in my attempts to find a game I want to play. In an effort to catch up, I've been using my bog standard Dell laptop to dig out treasures I have missed, such as American McGee's Alice, Grim Fandango and Syberia. I don't often get the time to play games, so I like to have the opportunity to dip in and out of a title without feeling like I'm losing something by not playing it for periods of time. But when I find a title I like, I make the time. Heavy Rain is the last game that gripped me, that truly engaged me and made me want to complete it in a single sitting. I'm tired of the GTA formulas, bored of CoDs and don't have the reaction time to think on my feet for AOE III. Is it about time I tossed in the controller and resigned myself to the fact that the games I want only come out once in a blue moon? Or have I just not found that one great title that will open me up to a brand new genre? Lords of Ultima is going OK at the moment — is there anything of that ilk I've missed? What are your thoughts? Do you stick to a particular genre? Are you finding it harder, as you get more mature, to find something you want to play?"

Xbox Live Enforcement — No Swastika Logo 473

itwbennett writes "It's one of those questions that really should never come up, but as blogger Peter Smith points out, Stephen Toulouse, the head of Xbox Live enforcement, is used to fielding all sorts of strange questions. Recently, one of those questions was apparently 'Can I use a Swastika as my logo in Call of Duty: Black Ops?' When Toulouse responded with the obvious answer ('No, of course you can't, we'll ban you.') he was met with some pushback by people he refers to as 'contrarians' and 'internet pundits' who decided to educate him on the long and storied history of the swastika as a symbol of good fortune and how just because the Nazis used it, it doesn't make the symbol itself a bad thing. Toulouse covers the topic on his blog in a post titled Context and it's an interesting read if for no other reason than to get a peek inside the day-to-day issues the Xbox Live Enforcement team deals with."

Why Don't We Finish More Games? 341

IGN has an opinion piece discussing why, as video games get shorter, we seem less likely to finish them than in the past. For example, BioWare said only 50% of Mass Effect 2 players finished the campaign. The article goes into several reasons gamers are likely to drop games without beating them, such as lowered expectations, show-stopping bugs, and the ease with which we can find another game if this one doesn't suit us. Quoting: "... now that gamers have come to expect the annualized franchise, does that limit the impetus to jump on the train knowing another one will pull up to the station soon enough? ... In the past, once you bought a game, it was pretty much yours unless you gave it to somebody else or your family held a garage sale. The systemic rise of the used games market now offers you an escape route if a game just isn't your bag. Is the middle of a game testing your patience? Then why not sell it back to your local game shop, get money back in your pocket, or trade it in for a game that's better – or at least better suited for your tastes? After all, the sooner you ditch it either at a shop or on an online auction site, the more value you stand to get in return."
