I think CBS is somewhat doing this with Jericho. They are offering the whole season free in many places like Veoh to generate hype for Season 2.

Artists are only compensated for post-recoup sales. 0% of this lawsuit money is trickled down to the artist. So basically, if you're not one of these companies, you can't win.
