The student asserted a First Amendment right of privacy on the Internet, in addition to a fair-use right to the six music tracks in question. The appeals court ruled in the RIAA’s favor (PDF) after balancing a constitutional right to remain anonymous against a copyright owner’s right to disclosure of the identity of a possible “trespasser of its intellectual property interest."'"

Hugh Pickens writes "Fox News reports that the Boy Scouts of America — a group founded on the principles of building character and improving physical fitness — have introduced merit pins for academic achievement in video gaming, a move that has child health experts atwitter. 'It could be quite visionary and exciting or it could be a complete sellout,' says Dr. Vic Strasburger. 'I don't see anything wrong with that as long as they're not playing first-person shooter games, violent games, games with a lot of sexual or drug content. The question is, who's going to supervise the scouts?' Tiger Cubs, Cub Scouts, and Webelos Scouts can earn their pins by spending an hour a day playing games, teaching others how to play better, and researching the best price for games they'd like to buy."

It was only a matter of time before ISPs began doing more than just redirecting failed DNS requests to their own pages. An anonymous reader writes "It looks like the largest ISP in Hong Kong has started bypassing search results from Firefox's location bar (which typically uses Google), forcing their own search provider (yp.com.hk) onto their users. ... Can an ISP just start re-directing search traffic at will?"

krou writes "Buried within the New Start treaty, which saw the decommissioning of nuclear warheads, was an interesting provision as a result of Russian demands: the US must 'decommission one nuclear missile for every one' of a new type of weapon called Prompt Global Strike 'fielded by the Pentagon.' The warhead, which is 'mounted on a long-range missile to start its journey,' would be 'capable of reaching any corner of the earth from the United States in under an hour. ... It would travel through the atmosphere at several times the speed of sound, generating so much heat that it would have to be shielded with special materials to avoid melting. ... But since the vehicle would remain within the atmosphere rather than going into space, it would be far more maneuverable than a ballistic missile, capable of avoiding the airspace of neutral countries, for example, or steering clear of hostile territory. Its designers note that it could fly straight up the middle of the Persian Gulf before making a sharp turn toward a target.' The new weapon is in line with Obama's plans 'to move towards less emphasis on nuclear weapons,' and rather focus on conventional ones. The idea is not new, having been first floated under the Bush administration, but was abandoned, mainly because 'Russian leaders complained that the technology could increase the risk of a nuclear war, because Russia would not know if the missiles carried nuclear warheads or conventional ones.'"

Yesterday we mentioned the controversy facing Matt Stone and Trey Parker after last week's South Park (episode 200) depicted Muhammad, founder of Islam, concealed in a bear suit. Today, penguinman1337 writes "Apparently, all is not well over at Comedy Central. The heavily censored version of episode 201 that aired last night has a lot of people angry, including the show's creators." From their note: "In the 14 years we've been doing South Park we have never done a show that we couldn't stand behind. We delivered our version of the show to Comedy Central and they made a determination to alter the episode. It wasn't some meta-joke on our part. Comedy Central added the bleeps."

hansamurai writes "After being asked about the App Store's recent ban on 'sexy apps,' Steve Jobs responded, 'We do believe we have a moral responsibility to keep porn off the iPhone. Folks who want porn can buy an Android phone. You know, there's a porn store for Android, you can download nothing but porn. You can download porn, your kids can download porn. That's a place we don't want to go, so we're not going to go there.' Apps such as Playboy's and the Sports Illustrated Swimsuit Edition are still available on the App Store, however, as they come from 'more reputable companies.'"

Roger Ebert has long held the opinion that video games are not and can never be considered an art form. After having this opinion challenged in a TED talk last year, Ebert has now taken the opportunity to thoughtfully respond and explain why he maintains this belief. Quoting: "One obvious difference between art and games is that you can win a game. It has rules, points, objectives, and an outcome. Santiago might cite an immersive game without points or rules, but I would say then it ceases to be a game and becomes a representation of a story, a novel, a play, dance, a film. Those are things you cannot win; you can only experience them. She quotes Robert McKee's definition of good writing as 'being motivated by a desire to touch the audience.' This is not a useful definition, because a great deal of bad writing is also motivated by the same desire. I might argue that the novels of Cormac McCarthy are so motivated, and Nicholas Sparks would argue that his novels are so motivated. But when I say McCarthy is 'better' than Sparks and that his novels are artworks, that is a subjective judgment, made on the basis of my taste (which I would argue is better than the taste of anyone who prefers Sparks)."

A few days after an untimely leak on Xbox Live, Epic Games has now officially announced Gears of War 3 for next April. Details are scant (though Edge speculates on possible new gameplay features), but it will contain 4-player co-op and be an Xbox 360 exclusive. A trailer was released for the game, and designer Cliff Bleszinski had this to say: "When we released Gears of War more than three years ago, we set out to tell the world an unforgettable story of bravery and sacrifice in the face of insurmountable odds, and a year from now, players will get the chance to experience the final chapter in the story of Marcus Fenix and his companions in Delta Squad. This is definitely the biggest and most dramatic chapter yet in the Gears of War saga, and we can't wait to deliver it."

angry tapir writes "Nokia has launched a version of its Comes With Music download service without digital rights management (DRM) for the Chinese market. Currently, the service is available in about 30 countries, but in those countries the music, unlike in China, is copy-protected."

Crazzaper writes "I have been using Firefox for many years, and the war of the browsers has been around for longer than that. It just so happens that now we have a lot of options out there: IE, FF, Chrome, Opera, Safari, and others. People are always talking about how one browser is going to take down another, but maybe that's not the issue at all. It seems very possible that one browser, like Firefox, can be taken down by multiple browsers at once, whether or not there was any intention to compete specifically with Firefox. I hadn't seen it this way, but I do now."

krou writes "Jordanian mayor Mohammed Mleihan has taken a dim view of local newspaper Al-Ghad's April Fools prank, which saw a front page story claiming that 'flying saucers flown by 3m (10ft) creatures had landed in the desert town of Jafr.' The paper claimed that communication networks had gone down, and people were fleeing the area. The mayor called the local security authorities, who combed the area, but they were unable to find any evidence of the aliens. Mr Mleihan is now considering suing because of the distress it caused to residents: 'Students didn't go to school, their parents were frightened and I almost evacuated the town's 13,000 residents. People were scared that aliens would attack them.'" I guess they've never heard of Orson Welles in Jordan.
