The reason they charge it is because they CAN charge it. It is called the Apple tax on top of the Better Beaches'n'beer tax.

That is part of the catch though isn't it. They don't necessarily have to prove you guilty like they would in a court situation. Instead, now you have to take them to court and prove your innocence.
