As IBM put it in its motion papers, SCO will not be allowed to 'litigate by ambush.' This motion was regarding SCO's expert reports, where SCO attempted to insert new evidence after discovery had ended via their expert reports. Wells' ruled directly from the bench, and finished by telling SCO to 'take it up with Judge Kimball' if they had a problem. This really hasn't been a good week for SCO."

Not a bad start for the challenger to the iPod throne. As others have pointed out the Amazon sales rank may have been thrown off by Zune sales being divided between the three colors."

In the words of Universal Music's Doug Morris, 'These devices are just repositories for stolen music, and they all know it. So it's time to get paid for it.' Does Microsoft's precedent mean the start of a slippery slope that will add a 'pirate tax' to every piece of hardware that touches digital music?"

philba writes to tell us that home theaters may become the new jurisdiction of our MPAA overlords. The MPAA is lobbying to make sure that home users authorize their entertainment systems before any in-home viewings. From the article: "The MPAA defines a home theater as any home with a television larger than 29" with stereo sound and at least two comfortable chairs, couch, or futon. Anyone with a home theater would need to pay a $50 registration fee with the MPAA or face fines up to $500,000 per movie shown."

The wireless emanations, parents fear, may be the root cause of a host of problems from simple fatigue to the possibility of cancer. A few scientists think younger humans may be more vulnerable to the transmissions, because of thinner skulls. From the article: "Vivienne Baron, who is bringing up Sebastian, her ten-year-old grandson, said: 'I did not want Sebastian exposed to a wireless computer network at school. No real evidence has been produced to prove that this new technology is safe in the long term. Until it is, I think we should take a precautionary approach and use cabled systems.'"

phil reed writes "University of Washington physicist John Cramer is attempting to send a signal back through time." From the article: "We're going to shoot an ultraviolet laser into a (special type of) crystal, and out will come two. lower-energy photons that are entangled," Cramer said. For the first phase of the experiment, to be started early next year, they will look for evidence of signaling between the entangled photons. Finding that would, by itself, represent a stunning achievement. Ultimately, the UW scientists hope to test for retrocausality — evidence of a signal sent between photons backward in time. The test will involve sending one of the photons down 10 miles of fiber optic cable, delaying it by 50 microseconds, then testing a quantum-mechanical aspect of the delayed photon. Due to quantum entanglement, the non-delayed photon would need to reflect the measurement made 50 microseconds later on the delayed photon. In order for this to happen, some kind of signal would need to be sent 50 microseconds back in time from the delayed photon to the non-delayed photon. (Confusing? Quantum physics is like that.)

Warren Ellis is reporting that many Second Life vendors are closing up shop due to the recent explosion of a program called "Copybot," designed to clone other people's possessions. From the article: "The night before last, I was looking around a no-fire combat sandbox, where people design and test weapons and vehicles, when an argument broke out; a thing going by the name Nimrod Yaffle was cloning things out of other people's inventories, and claiming he could freely do it because he'd been playing with Copybot with employees of SL creator/operators Linden Lab. All hell broke loose, in the sort of drama you can only find on the internet. Linden Lab's first official response? If you feel your IP has been compromised by Copybot, we'll sort of help you lodge a DCMA complaint in the US. Businesses started shutting down moments later."
