Well, it's not exactly a burst speed - I can run flat out at 3MB/s all day long. I see your point though - with the cap it amounts to a much slower overall rate if I want to stay off my limit.

Yeah, my cable modem is stupid fast....only problem is, running full tilt I can go through my monthly bandwidth cap in eleven and a half hours.
Fortunately, for the moment, the overage cap is $50 so if you download a bunch some month you just say, "Woohoo, unlimited bandwidth." For example, in January I downloaded 750MB which put me 625MB over my cap and would have cost an extra $780. Ridiculous no? And now the CRTC (equivalent of FTC) has ruled that the major ISPs are allowed to pass usage based billing fees onto third party providers which means there will be no more unlimited plans and the billing cap will likely go away.
Basically, Rogers and Bell want you to watch their channels, not use Netflix, AppleTV, etc. And the wretched hive of scum and villany known as the CRTC is letting them do it.
Not much point in fast internet if you can't use it.
Xbox Modding Trial Dismissed 179
It seems the harsh words from District Court Judge Philip Gutierrez on Wednesday had their intended effect; prosecutors in Matthew Crippen's Xbox modding case have now dismissed the indictment. Quoting Wired:
"Witness No. 1, Tony Rosario, was an undercover agent with the Entertainment Software Association. He told jurors Wednesday that he paid Crippen $60 in 2008 to modify an Xbox, and secretly videotaped the operation. Rosario had responded to Crippen’s advertisement on the internet and met Crippen at his Anaheim house. All of that had been laid out in pretrial motions. But during his testimony, Rosario also said Crippen inserted a pirated video game into the console to verify that the hack worked. That was a new detail that helped the government meet an obligation imposed by the judge that very morning, when Gutierrez ruled that the government had to prove Crippen knew he was breaking the law by modding Xboxes. But nowhere in Rosario’s reports or sworn declarations was it mentioned that Crippen put a pirated game into the console. ... [Prosecutor Allen Chiu] conceded he never forwarded that information to the defense."
Former Exec Says Electronic Arts "Is In the Wrong Business" 180
Mitch Lasky was the executive vice president of Mobile and Online at Electronic Arts until leaving the publisher to work at an investment firm. He now has some harsh things to say about how EA has been run over the past several years, in particular criticizing the decisions of CEO John Riccitiello. Quoting:
"EA is in the wrong business, with the wrong cost structure and the wrong team, but somehow they seem to think that it is going to be a smooth, two-year transition from packaged goods to digital. Think again. ... by far the greatest failure of Riccitiello's strategy has been the EA Games division. JR bet his tenure on EA's ability to 'grow their way through the transition' to digital/online with hit packaged goods titles. They honestly believed that they had a decade to make this transition (I think it's more like 2-3 years). Since the recurring-revenue sports titles were already 'booked' (i.e., fully accounted for in the Wall Street estimates) it fell to EA Games to make hits that could move the needle. It's been a very ugly scene, indeed. From Spore, to Dead Space, to Mirror's Edge, to Need for Speed: Undercover, it's been one expensive commercial disappointment for EA Games after another. Not to mention the shut-down of Pandemic, half of the justification for EA's $850MM acquisition of Bioware-Pandemic. And don't think that Dante's Inferno, or Knights of the Old Republic, is going to make it all better. It's a bankrupt strategy."
PlayStation Network Expanding To Involve Other Devices 63
At CES, Sony's Kaz Hirai confirmed that the company will build out its PlayStation Network for use with other devices, such as televisions, Blu-ray players, and PCs. Quoting:
"... the expansion starts next month with the availability of the PSN video store on these other devices, and Hirai explained they are constructing a mechanism to create a single user ID across the entire network (if you have a PSN account, it's good to go on any other applicable Sony device, and if you create one on another device, it'll work on PSN). And finally, Hirai also announced the formation of a new Sony division — called Sony Network Entertainment, Inc. — to drive this expansion of the PSN service into a Sony-wide network."
