Where does this legend about the "European model of unlocked phones" come from? Here in Germany, most people I know get the same 2 year contracts with a phone bundled, like you do. There sure are prepaid phones, contracts without phones, and all kinds of phones without contract on the eBay. But last time I checked, the contract+phone bundle made the most economic sense. Guess it is the same in the USA. Anyways, a contract with or without a phone costs €20-€60, I don't think it is kind of money you should get upset about, much less running news on Slashdot daily about consumers being "raped" by the carriers.

It's all part of the Political Correctness movement. It started by convincing people certain words (gay, fagot, indian, handicapped, etc.) were at their very core evil (they use the word hateful because the word evil is also evil). It so happens I read the best definition of PC I have ever heard today. It was the winning submission to an annual contest (2007 if sources are accurate) Texas A&M holds to define popular terminology. It defines Political Correctness as:

"Political Correctness is a doctrine, fostered by a delusional,
illogical minority, and rabidly promoted by an unscrupulous mainstream
media, which holds forth the proposition that it is entirely possible
to pick up a turd by the clean end."

This story is kinda like getting arrested for yelling FIRE in a crowded parking lot full of empty cars next to a movie theater full of people.

Yeah, except that simple possession is illegal, so they could prosecute you if they wanted to. Lazy cops would rather just shoot the messenger than actually track down the people who made it. They'd rather spend their time tracking down evil speeders and prosecuting people for downloading music and movies from the internet.

Incorrect. Fascism is simply a "third way" that is neither private ownership (capitalism) nor government ownership (communism), but instead private ownership with government CEOs pulling the strings. It's intended to prevent the abuses. It's also sometimes called corporatism.

That's the economic part of it. The political dimension is strong authoritarian and nationalist leadership and the strong being allowed to assert their superiority over the weak (social darwinism.) It's this latter part I was referring to, the idea some people are weak willed and should be lead not included.

I agree completely people shouldn't vote blindly but should know the issues. That's why personally I'm for mandatory voting. It's the only system that provides an incentive for all parties to make sure the populace is as informed as possible.

Yes, it is. Apple's attorneys would have an enormous uphill battle fighting against centuries of common law, precedent, and the Uniform Commerical Code to establish that title to those copies did not transfer at each step of the distribution chain from Apple to Psystar.

Did any of those transactions involve a signed lease indicating that the transaction was not a purchase at all, but rather a transferable lease to a copy that was owned by a third party?

Apple owns the copyright, not the copy. Nor do they have any basis for the claim that they have title to copies that they delivered indefinitely in exchange for good money upfront. Nor do they have a basis for the claim that a shrinkwrap "license" is an enforceable license that governs the use of something the customer already owns. No one needs a license to use a copy they own - unless Apple owns the copy they cannot set the terms of its use beyond what is regulated by copyright.

It is worth noting here that generally speaking a license can be retracted on demand. That is why it is a license, not a contract. If I say you can use my swimming pool, that is a license. If I change my mind, I revoke that license. Only if consideration is involved does that license become a contract. "Purchasing a license" is an oxymoron. So is "consideration free contract".

You are wrong. It's a model. It's working because it moves. Therefore, it's a working model train.

Models can be stationary, propelled by a tether, propelled by an external force, or self-propelled with onboard machinery. Examples of such models:

  • Stationary: Tester's plastic model car. Model of a city building in development. Diorama. Figurine.
  • Propelled by a tether or platform: Model plane swung with a cord. Boat pulled by a string. Model of the solar system attached base assembly.
  • Propelled by external force (on-board motor powered by external source): Slot cars. Electric trains such as HO gauge and Lionel. Model sailboat.
  • Self propelled or self powered (both energy and motor on-board): RC plane. RC car. Battery powered trains. CO2 rocket car. Estes rocket. Model cannon.

This model would fall under tethered.

A model is simply a reproduction of the original, generally on a miniature scale. There are no requirements for mobility or accuracy of internal machinery and external appearance to be called a model.
