Cisco Slaps Arista Networks With Suit For "Brazen" Patent Infringement 96

alphadogg writes Cisco has filed two lawsuits against data center switch competitor Arista Networks for allegedly violating its intellectual property. One suit is for patent infringement, which charges Arista with violating 14 Cisco patents for 12 features in the Arista EOS operating system. The second suit is for extensive copying of Cisco's user manuals and command line structures, right down to the grammatical errors within them. "This is not an accident but a strategy," says a source familiar with the matter. "It was a deliberate, brazen and blatant intellectual property violation in order to gain competitive advantage in the marketplace. Arista's shortcutting to get to market and win share."

Overly Familiar Sci-Fi 368

An anonymous reader writes: Science fiction author Charlie Stross has a thoughtful post about an awkward aspect of the genre: too often, books set in the distant future seem far too familiar to us. Our culture evolves quickly — even going back 100 years would be a difficult transition to get used to. But when we're immersed in a culture 500 years ahead of us, everything's pretty much the same, but with spaceships. He says, "You can make an argument for writing SF in this mode in that it allows the lazy reader to ignore the enculturation issue and dive straight into the adventure yarn for which the SFnal trappings are just a brightly-colored wrapper. But I still find it really weird to read a far-future SF story that doesn't deliver a massive sense of cultural estrangement, because in the context of our own history, we are aliens." Some authors put more effort into this than others, but Stross points out that most just use it as a backdrop to tell a particular story. He concludes, "if you're not doing it to the cultural norms as well as the setting and technology, you're doing it wrong."

Neglecting the Lessons of Cypherpunk History 103

Nicola Hahn writes Over the course of the Snowden revelations there have been a number of high profile figures who've praised the merits of encryption as a remedy to the quandary of mass interception. Companies like Google and Apple have been quick to publicize their adoption of cryptographic countermeasures in an effort to maintain quarterly earnings. This marketing campaign has even convinced less credulous onlookers like Glenn Greenwald. For example, in a recent Intercept piece, Greenwald claimed:

"It is well-established that, prior to the Snowden reporting, Silicon Valley companies were secret, eager and vital participants in the growing Surveillance State. Once their role was revealed, and they perceived those disclosures threatening to their future profit-making, they instantly adopted a PR tactic of presenting themselves as Guardians of Privacy. Much of that is simply self-serving re-branding, but some of it, as I described last week, are genuine improvements in the technological means of protecting user privacy, such as the encryption products now being offered by Apple and Google, motivated by the belief that, post-Snowden, parading around as privacy protectors is necessary to stay competitive."

So, while he concedes the role of public relations in the ongoing cyber security push, Greenwald concurrently believes encryption is a "genuine" countermeasure. In other words, what we're seeing is mostly marketing hype... except for the part about strong encryption.

With regard to the promise of encryption as a privacy cure-all, history tells a markedly different story. Guarantees of security through encryption have often proven illusory, a magic act. Seeking refuge in a technical quick fix can be hazardous for a number of reasons.

Sony Employees Receive Email Threat From Hackers: 'Your Family Will Be In Danger 184

MojoKid writes: Things are going from bad to worse when it comes to the recent Sony Pictures Entertainment breach. Not only has sensitive financial information been released — including the salaries of high-ranking Sony executives — but more damaging personal information including 47,000 Social Security numbers of employees and actors have been leaked to the internet. We're now learning some even more disturbing details, unfortunately. Guardians of Peace (GOP), the hackers claiming responsibility for infiltrating Sony's computer network, are now threatening to harm the families of Sony employees. GOP reportedly sent Sony employees an email, which just so happened to be riddled with spelling and grammatical errors, that read in part, "your family will be in danger."

nbauman writes Programmer David Auerbach is dismayed that, at a critical developmental age, his 4-year-old daughter wants to be a princess, not a scientist or engineer, he writes in Slate. The larger society keeps forcing sexist stereotypes on her, in every book and toy store. From the article: "Getting more women into science and technology fields: Where’s the silver bullet? While I might get more hits by revealing the One Simple Trick to increase female participation in the sciences, the truth is there isn’t some key inflection point where young women’s involvement drops off. Instead, there is a series of small- to medium-sized discouraging factors that set in from a young age, ranging from unhelpful social conditioning to a lack of role models to unconscious bias to very conscious bias. Any and all of these can figure into why, for example, women tend to underrate their technical abilities relative to men. I know plenty of successful women in the sciences, but let’s not fool ourselves and say the playing field in the academic sciences or the tech world is even. My wife attributes her pursuit of programming to being a loner and pretty much ignoring wider society while growing up: 'Being left alone with a computer (with NO INTERNET TO TELL ME WHAT I COULDN’T DO) was the deciding factor,' she tells me."

You're Doing It All Wrong: Solar Panels Should Face West, Not South 327

HughPickens.com writes In the U.S., a new solar project is installed every 3.2 minutes and the number of cumulative installations now stands at more than 500,000. For years, homeowners who bought solar panels were advised to mount them on the roof facing south to capture the most solar energy over the course of the day. Now Matthew L. Wald writes in the NYT that panels should be pointed west so that peak power comes in the afternoon when the electricity is more valuable. In late afternoon, homeowners are more likely to watch TV, turn on the lights or run the dishwasher. Electricity prices are also higher at that period of peak demand. "The predominance of south-facing panels may reflect a severe misalignment in energy supply and demand," say the authors of the study, Barry Fischer and Ben Harack. Pointing panels to the west means that in the hour beginning at 5 p.m., they produce 55 percent of their peak output. But point them to the south to maximize total output, and when the electric grid needs it most, they are producing only 15 percent of peak.

RegularDave writes: I'm a recent grad from a master's program in a potentially worthless social science field, and I've considered getting into iOS development. Several of my friends who were in similar situations after grad school have done so and are making a healthy living getting contract work. Although they had CS and Physics degrees going into iOS, neither had worked in objective C and both essentially went through a crash courses (either self-taught or through intensive classes) in order to get their first gigs. I have two questions. First, am I an idiot for thinking I can teach myself either objective C or Swift on my own without any academic CS background (I've tinkered in HTML, CSS, and C classes online with some success)? Second, if I'm not an idiot for attempting to learn either language, which should I concentrate on?

Security Experts Believe the Internet of Things Will Be Used To Kill Someone 165

Or someone who hacks into a connected insulin pump and changes the settings in a lethal way. Or maybe the hacker who accesses a building's furnace and thermostat controls and runs the furnace full bore until a fire is started. Those may all sound like plot material for a James Bond movie, but there are security experts who now believe, as does Jeff Williams, CTO of Contrast Security, that "the Internet of Things will kill someone". Today, there is a new "rush to connect things" and "it is leading to very sloppy engineering from a security perspective," said Williams. Similarly, Rashmi Knowles, chief security architect at RSA, imagines criminals hacking into medical devices, recently blogged about hackers using pacemakers to blackmail users, and asked: "Question is, when is the first murder?"

Mathematicians Study Effects of Gerrymandering On 2012 Election 413

HughPickens.com writes Gerrymandering is the practice of establishing a political advantage for a particular party by manipulating district boundaries to concentrate all your opponents' votes in a few districts while keeping your party's supporters as a majority in the remaining districts. For example, in North Carolina in 2012 Republicans ended up winning nine out of 13 congressional seats even though more North Carolinians voted for Democrats than Republicans statewide. Now Jessica Jones reports that researchers at Duke are studying the mathematical explanation for the discrepancy. Mathematicians Jonathan Mattingly and Christy Vaughn created a series of district maps using the same vote totals from 2012, but with different borders. Their work was governed by two principles of redistricting: a federal rule requires each district have roughly the same population and a state rule requires congressional districts to be compact. Using those principles as a guide, they created a mathematical algorithm to randomly redraw the boundaries of the state's 13 congressional districts. "We just used the actual vote counts from 2012 and just retabulated them under the different districtings," says Vaughn. "If someone voted for a particular candidate in the 2012 election and one of our redrawn maps assigned where they live to a new congressional district, we assumed that they would still vote for the same political party."

The results were startling. After re-running the election 100 times with a randomly drawn nonpartisan map each time, the average simulated election result was 7 or 8 U.S. House seats for the Democrats and 5 or 6 for Republicans. The maximum number of Republican seats that emerged from any of the simulations was eight. The actual outcome of the election — four Democratic representatives and nine Republicans – did not occur in any of the simulations. "If we really want our elections to reflect the will of the people, then I think we have to put in safeguards to protect our democracy so redistrictings don't end up so biased that they essentially fix the elections before they get started," says Mattingly. But North Carolina State Senator Bob Rucho is unimpressed. "I'm saying these maps aren't gerrymandered," says Rucho. "It was a matter of what the candidates actually was able to tell the voters and if the voters agreed with them. Why would you call that uncompetitive?"

Renewables Are Now Scotland's Biggest Energy Source 235

AmiMoJo writes Government figures revealed that Scotland is now generating more power from "clean" technologies than nuclear, coal and gas. The combination of wind, solar and hydroelectric, along with less-publicized sources such as landfill gas and biomass, produced 10.3TWh in the first half of 2014. Over the same period, Scotland generated 7.8TWh from nuclear, 5.6TWh from coal and 1.4TWh from gas, according to figures supplied by National Grid. Renewable sources tend to fluctuate throughout the year, especially in Scotland where the weather is notoriously volatile, but in six-month chunks the country has consistently increased its renewable output.

Hacker Threatened With 44 Felony Charges Escapes With Misdemeanor 219

An anonymous reader writes: It's no secret that prosecutors usually throw every charge they can at an alleged criminal, but the case of Aaron Swartz brought to light how poorly-written computer abuse laws lend themselves to this practice. Now, another perfect example has resolved itself: a hacker with ties to Anonymous was recently threatened with 44 felony counts of computer fraud and cyberstalking, each with its own 10-year maximum sentence. If the charges stuck, the man was facing multiple lifetimes worth of imprisonment.

But, of course, they didn't. Prosecutors struck a deal to get him to plead guilty to a single misdemeanor charge, which carried only a $10,000 fine. The man's attorney, Tor Eklund, said, "The more I looked at this, the more it seemed like an archetypal example of the Department of Justice's prosecutorial abuse when it comes to computer crime. It shows how aggressive they are, and how they seek to destroy your reputation in the press even when the charges are complete, fricking garbage."

"Advanced Life Support" Ambulances May Lead To More Deaths 112

HughPickens.com writes Jason Kane reports at PBS that emergency treatments delivered in ambulances that offer "Advanced Life Support" for cardiac arrest may be linked to more death, comas and brain damage than those providing "Basic Life Support." "They're taking a lot of time in the field to perform interventions that don't seem to be as effective in that environment," says Prachi Sanghavi. "Of course, these are treatments we know are good in the emergency room, but they've been pushed into the field without really being tested and the field is a much different environment." The study suggests that high-tech equipment and sophisticated treatment techniques may distract from what's most important during cardiac arrest — transporting a critically ill patient to the hospital quickly.

Basic Life Support (BLS) ambulances stick to simpler techniques, like chest compressions, basic defibrillation and hand-pumped ventilation bags to assist with breathing with more emphasis placed on getting the patient to the hospital as soon as possible. Survival rates for out-of-hospital cardiac arrest patients are extremely low regardless of the ambulance type with roughly 90 percent of the 380,000 patients who experience cardiac arrest outside of a hospital each year not surviving to hospital discharge. But researchers found that 90 days after hospitalization, patients treated in BLS ambulances were 50 percent more likely to survive than their counterparts treated with ALS. Not everyone is convinced of the conclusions. "They've done as much as they possibly can with the existing data but I'm not sure that I'm convinced they have solved all of the selection biases," says Judith R. Lave. "I would say that it should be taken as more of an indication that there may be some very significant problems here."
