Show me the failure here... The grand jury found no probably cause to proceed. That's the way the system works, all available evidence is reviewed and a decision is made. However if you are interested, it sounds like the unusual step of opening up the grand jury records will be taken in this case. So, keep up with it and read the transcript when it is available, and then see what you conclude.
