According to a report from Japanese publication Nikkei Net, Nintendo's New Super Mario Bros. Wii has now sold 10 million copies worldwide. The game needed only 45 days to pass the already impressive sales numbers of Super Mario Galaxy. Quoting Gamasutra: "NSMB Wii has sold 3 million units in Japan, where it launched on December 3; 3 million copies in Europe, where it launched November 20, and 4.5 million units in North America, where it launched November 15. Super Mario Galaxy has sold 4.1 million units in North America since 2007. The game's design hearkens back to the two-dimensional, side-scrolling style of earlier Mario titles ... The numbers would seem to suggest that these traits successfully generated more mass appeal for NSMB Wii than for the three-dimensional and far less familiar Super Mario Galaxy, which sent the plumber navigating more innovative spherical space environments."

Among the 94 discoveries were 65 arthropods, 14 plants, 8 fishes, 5 sea slugs, one coral, and one fossil mammal. Why does it matter? As Dr. David Mindell, Dean of Science and Research Collections at the Academy, explained, 'Humans rely on healthy ecosystems, made up of organisms and their environments. Creating a comprehensive inventory of life on our planet is critical for understanding and managing resources. Yet a great many life-forms remain to be discovered and described.'"

Researchers from the School of Medicine at the University of California have shown that the more germs a child is exposed to, the better their immune system in later life. Their study found that keeping a child's skin too clean impaired the skin's ability to heal itself. From the article: "'These germs are actually good for us,' said Professor Richard Gallo, who led the research. Common bacterial species, known as staphylococci, which can cause inflammation when under the skin, are 'good bacteria' when on the surface, where they can reduce inflammation."

NewYorkCountryLawyer writes "The US Court of Appeals for the First Circuit has overturned a lower court order permitting webcast of an oral argument in an RIAA case, SONY BMG Music Entertainment v. Tenenbaum, in Boston. As one commentator put it, the decision gives the RIAA permission to 'cower behind the same legal system they're using to pillory innocent people.' Ironically, the appeals court's own hearing had been webcast, via an mp3 file. The court admitted that this was not an appropriate case for a 'prerogative writ' of 'mandamus,' but claimed to have authority to issue a writ of 'advisory mandamus.' The opinion came as a bit of a surprise to me because the judges appeared, during the oral argument, to have a handle on the issues. The decision gave me no such impression. From where I sit, the decision was wrong in a number of respects, among them: (a) it contradicted the plain wording of the district court rule, (b) it ignored the First Amendment implications, and (c) there is no such thing as 'advisory' mandamus or 'advisory' anything — our federal courts are specifically precluded from giving advisory opinions."
