Journal Journal: Bush Literally Stealing From Orphans & Widows 15

I had already heard on Air America that Bush's latest budget proposed eliminating the vestigial $255 "death benefit" from Social Security(one commentator noted the irony of cutting this while at the same time wanting to make the elimination of the Inheritance Tax (which the GOP incorrectly call the "Death Tax" - a levy that soley effects the estates of multimillionaires). Well today I see that is not the only cut he has planned for Social Security, he also plans to eliminate survivor benefits for teenagers that drop out of school.

Long-time readers of this journal might be aware that we have close friends who lost the father/husband in their family about two years ago. Such a loss has long-term emotional effects on kids, emotional effects that may contribute to problems in school. The thirteen-year-old daughter in this family is currently having some academic problems, and I don't know if she will be able to stay in school through graduation. So this change could have a direct effect on them.

I also find it yet another ironic proposal from the President that brought us "No Child Left Behind" because it seems directly targetted to leave behind some of the most vulnerable children in our society.

I had an idea this morning regarding "human-animal hybrids" so I called it into the Stephanie Miller Show.

Here was my question/comment:

I'm wondering if the Human-Animal Hybrid thing is a backdoor way to kill stem-cell research as the only approved stem-cells are grown with mouse cells and therefor could be considered "human-animal hybrids."

Stephanie's response was something about Bush's record on anything science related, then a question about the noise on the phone which I said was my kids watching Barney - possibly a dinosaur-animal hybrid. (I meant to say human-dinosaur hybrid, but oh well.

I forgot to set my computer to record the live stream, but I may be able to get it tonight when it is re-broadcast on an Arizona station, but it's possible that station has dropped its Progressive Talk Radio format.

Journal Journal: Is Sensenbrenner's PATRIOT Act Power Play Tom DeLay's Obit? 1

I'm too busy to research a timeline right now, but my understanding was that for DeLay to have a shot at returning to his leadership post next year, the House needed to remain out of session until his case came to trial at the very end of January. If the PATRIOT Act must now be addressed in January, I take it that the House must come back into session sometime in mid- to late January, sometime before DeLay is set to go to trial.

The AP has a little personal interest story about Bush's Asian trip. It notes that Bush "drank fermented mare's milk -- sometimes likened to a mix of warm beer and buttermilk" what it doesn't seem to put together from that statement is that this is the first reputable report of Bush drinking alcohol since he says he became a teatotaller after finding Jesus.

Oddly it's not the first case of Bush being mentioned in connection with horse's milk. His wife was famously quoted at a press club gala for telling a joke involving George being so unaquainted with the life of a true cowboy, that he once tried to milk a horse - and worse - it was a male horse.

I was pointed to the issue by a comment on Think Progress blog entry. The commenter noted that it looks like Miers has been claiming her Dallas home as her "residence" and thus claiming what ends up to be a reduction of over $3,000 for her Real Estate tax. Since she has been working (well over) fulltime in DC since at least January 20th, 2001, it seems a pretty long commute to have her residence in Dallas still after all this time.

Of course this is exactly unusual, George H. W. Bush claimed a TX apartment as his residence for tax purposes thereby avainding DC's Income tax. Has Miers also been avoiding her DC Income Tax? Anyway, here is more info on her Real Estate exemption:

Here's a direct link to the Homestead Exemption History for Miers' Dallas residence. It certainly does look like she has been claiming the exemption each year. per the rules for the general Homestead Exemption (the only one she could be eligible for as a never-married women under age 65) I can only assume that she makes sure she flies down there every New Year's Day as that is the only day during the year she is required to "reside there" to obtain the exemption.

        To qualify, the property must be designed or adapted for human residence and the homeowner must own the property on January 1 of the year application is made. this has been bouncing around the blogosphere today and after tracking it back to DailyKos I found a link to the actual legislation [214Kb PDF] - which seems to not yet have been laughed out of committee. Aparently there is an epidemic of unmarried women seeking to get pregnant in Indiana and GOP instends to ensure that if any babies are going to made out of wedlock in the state it's going be done the old fashioned way whether or not that is how the woman wants to conceive (Mike Tyson could not be reached for comment). I'm assuming the main motivation is to prevent Lesbians from becoming parents - but also have to remember that Dan Quayle was from Indiana and he had a lot of problems with sitcom character Murphy Brown's out of wedlock motherhood.

Another angle that I haven't seen brought up yet regarding the legislation, is that married couples seeking to get donor sperm/egg/embryos must be evaluated for their suitability as if they were adopted parents - something which to some extent makes sense but which also includes providing information on their fertility history and "pregnancy history and response to pregnancy losses of the woman" which I interpret as meaning they want to know if you've ever had an abortion.

Indiana - keeping the lock in wedlock since 1916!

The legislatrix that proposed the bill has decided to shelve the idea at least until January because "the issue has become more complex than anticipated."

Anonymous Sources: Their Use in a Time of Prosecutorial Interest
How are decisions made about publishing information from confidential sources?

The traditional government concern
about leaks of information
has taken a new turn. Journalists,
including me, have been put in the
middle of highly publicized criminal
investigations and civil cases based on
leaks. On July 12, 2003, an administration
official, who was talking to me
confidentially about a matter involving
alleged Iraqi nuclear activities, veered
off the precise matter we were discuss-
ing and told me that the White House
had not paid attention to former Ambassador
Joseph Wilson's CIA-sponsored
February 2002 trip to Niger because it
was set up as a boondoggle by his wife,
an analyst with the agency working on
weapons of mass destruction.
I didn't write about that information
at that time because I did not believe it
true that she had arranged his Niger trip.
But I did disclose it in an October 12,
2003 story in The Washington Post. By
that time there was a Justice Department
criminal investigation into a leak to columnist
Robert Novak who published it
on July 14, 2003 and identified Wilson's
wife, Valerie Plame, as a CIA operative.
Under certain circumstances a government
official's disclosure of her name
could be a violation of federal law. The
call with me had taken place two days
before Novak's column appeared.
I wrote my October story because I
did not think the person who spoke to
me was committing a criminal act, but
only practicing damage control by trying
to get me to stop writing about Wilson.
Because of that article, The Washington
Post and I received subpoenas last
summer from Patrick J. Fitzgerald, the
special prosecutor looking into the
Plame leak. Fitzgerald wanted to find
out the identity of my source.
I refused. My position was that until
my source came forward publicly or to
the prosecutor, I would not
discuss the matter. It turned
out that my source, whom I
still cannot identify publicly,
had in fact disclosed to the
prosecutor that he was my
source, and he talked to the
prosecutor about our conversation.
(In writing this
story, I am using the masculine
pronoun simply for
convenience). My attorney
discussed the matter with his
attorney, and we confirmed that he had
no problem with my testifying about
our conversation.
When my deposition finally took
place in my lawyer's office last September,
Fitzgerald asked me about the
substance of my conversation about
Wilson's wife, the gist of which I had
reported in the newspaper. But he
did not ask me to confirm my source's
identity, which was my condition for
being deposed. My original understanding
with my source still holds--to
withhold his identity until he makes it
public, if ever.
Confidential Sources
Protecting confidential sources, who
provide me with material for many of the
intelligence stories I write, is a key factor
that enables me to write the stories I do
about national security. Sometimes I am
given or sent a document that is classi-
fied, or sources--either on their own or
through answering questions--provide
information that is classified.
How do I decide when to publish
such information provided by a confi-
dential source?
Protecting confidential sources, who
provide me with material for many
of the intelligence stories I write,
is a key factor that enables me to
write the stories I do about national
security.
There are at least three issues involved,
and they include:
1. Determining whether the information
is credible and verifiable.
The most important issue involves my
analysis of why the source provided
the information in the first place
and, of course, verifying its accuracy.
Many times during the past 40 years,
a source wanting confidentiality has
provided information and sometimes
even documents that have proven to
be untrue or taken out of context.
Information that is to be attributed
to anonymous sources has to be
checked more closely than any other
type of material.
2. Determining whether the material
is newsworthy. Just because it appears
to be a secret and the source
wants anonymity doesn't mean it is
worth printing.
3. Determining whether in the case
of classified information it truly
harms national security. And based
on that analysis, there have been
times at The Washington Post when
we have decided not to publish such
information.
When we do publish stories based
on leaks, we risk getting subpoenaed.
If that occurs, a reporter might have to
confront questions about the nature
of the reporter's privilege. It is called a
reporter's privilege, but once I publish
information from a confidential source
who has risked firing or even jail to
give me the information, I believe the
privilege of keeping his or her name
secret belongs both to the source and
to me. That source, after getting a confi-
dentiality pledge from me, can disclose
that same information within hours to
another reporter for attribution. The
source could also go to a prosecutor
in private, disclose that he or she has
talked to me and provide the substance
of the conversation. I could hardly claim
the privilege to that same prosecutor, if
I am directly assured that the source is
releasing me from my pledge.
In states in which shield laws apply,
reporters may not have to face questions
about revealing sources, and sources
may be protected. This includes
even those who pass along
wrong or inaccurate information,
and I am concerned about
that possibility--which exists in
other privileges recognized by
law to serve the public interest.
Shield laws do prevent lawyers
from freely subpoenaing reporters
to do their investigative
work for them. And such laws
certainly prevent harassment
of journalists.
But no matter what legal protections
exist, journalists should pause before
handling information received from
people who demand anonymity. Reporters
should avoid promising anonymity
to sources if it is being offered simply to
encourage the source to say something
in a dramatic or damaging way that the
source would not say on the record.
This use of anonymity harms the profession
and diminishes the value of the
confidentiality given to those who are
whistleblowers--people who risk their
jobs and jail for what they may believe
is a higher cause.

I heard this on C-SPAN this morning but so far the rest of the media hasn't seemed to get around to actually correcting themselve. The Seattle Times has the story.

Does this change my views on Roberts - I don't know whether it shows that he isn't the ideologue some fear (and that others desire), but it may also be sign that he really is the perfect stealth nominee and has been EXTREMELY careful to never do anything that might hurt his chances at getting confirmed. The latter seems in the realm of tinfoil-hat conspiracy theory, but given the administration's record I won't write-off the possibility just yet.

I'm looking forward to We're About 9's Columbia Lakefront show Wednesday. Anyone within the greater DC, Baltimore, or Frederick area should think about attending this show - it's a wonderful 'natural' ampitheatre with the lake in the background.
