US District Judge Henry Kennedy Jr. signed an order (PDF) Friday requiring the department to produce the memos by the White House legal counsel's office by Nov. 17. He said he will review the memos in private to determine if any information can be released publicly without violating attorney-client privilege or jeopardizing national security. Kennedy issued his order in response to lawsuits by civil liberties groups in 2005 after news reports disclosed the wiretapping."

A refrigerator-sized tank of toxic ammonia, tossed from the international space station last year, is expected to hit earth tomorrow afternoon or evening. The 1,400-pound object was deliberately jettisoned — by hand — from the ISS's robot arm in July 2007. Since the time of re-entry is uncertain, so is the location. "NASA expects up to 15 pieces of the tank to survive the searing hot temperatures of re-entry, ranging in size from about 1.4 ounces (40 grams) to nearly 40 pounds (17.5 kilograms). ... [T]he largest pieces could slam into the Earth's surface at about 100 mph (161 kph). ...'If anybody found a piece of anything on the ground Monday morning, I would hope they wouldn't get too close to it,' [a NASA spokesman] said."

BostonBTS sends word that the French Constitutional Council has just made it illegal to film violence unless you are a professional journalist (or to distribute a video containing violence). The law was approved exactly 16 years after amateur videographer George Holliday filmed Los Angeles police officers beating Rodney King. The Council was tidying up a body of law about offenses against the public order, and wanted to ban "happy slapping." A charitable reading would be that the lawmakers stumbled into unintended consequences. Not according to Pascal Cohet, a spokesman for French online civil liberties group Odebi: "The broad drafting of the law so as to criminalize the activities of citizen journalists unrelated to the perpetrators of violent acts is no accident, but rather a deliberate decision by the authorities, said [Cohet]. He is concerned that the law, and others still being debated, will lead to the creation of a parallel judicial system controlling the publication of information on the Internet."

Legal Ethics writes "According to an article on Groklaw, Microsoft is misrepresenting what the Windows Genuine Advantage (WGA) tool is to pressure people into installing it. It comes with no uninstall, it fails to disclose many pieces of information it provides to Microsoft, and it misrepresents itself as a 'critical update' when it does not address any security vulnerability, although it remains to be seen if it can create one. ZDNet has a series of screenshots so that you can see exactly how badly it misrepresents itself. Oh, and it also checks for updates, so Microsoft can presumably execute arbitrary code on any machine with it installed, merely by making that code part of a WGA update."
