Federal Judge Limits DHS Laptop Border Searches 359

Declan McCullogh is reporting at CNET that a federal district court judge has rebuked the Department of Homeland Security, "which had claimed it can seize a traveler's laptop and search it six months later without warrant." As described in the article, DHS policies have been stacked against travelers entering the US, including citizens returning from abroad: "There's no requirement that they be returned to their owners after even six months or a year has passed, though supervisory approval is required if they're held for more than 15 days. The complete contents of a hard drive or memory card can be perused at length for evidence of lawbreaking of any kind, even if it's underpaying taxes or not paying parking tickets." This ruling does not address immediate searches at the border, but says that DHS cannot hold computers for indefinite searching, as in the case to hand, concerning a US citizen returning from a trip to Korea, whose laptop was seized and held for months before a search was even conducted on it.

Privacy Machiavellis 206

Chris Jay Hoofnagle has a piece up at SFGate.com on what he calls the "privacy Machiavellis," which are exemplified by Google and Facebook. (The article is adapted from a longer treatment published last year, called "Beyond Google and Evil.") Hoofnagle heads the privacy foundation set up with money collected from settlements of privacy lawsuits against Facebook. From SFGate: "... you have no way to ask Google to stop this tracking. Instead, you can merely opt out of the targeted advertising — the product recommendations. Exercising your privacy options creates a worst-case-scenario outcome: If you opt out, you are still tracked, but you do not receive the putative benefit of targeted ads. An illusory opt-out system is just one of the increasingly sophisticated sleights of hand in the privacy world. Consider Facebook's privacy options. ... Facebook can proudly proclaim that it offers ... more than 100 [choices]. Therein lies the trick; by offering too many choices, individuals are likely to choose poorly, or not at all. Facebook benefits because poor choices or paralysis leads consumers to reveal more personal information. In any case, the fault is the consumer's, because, after all, they were given a choice. Reader Kilrah_il sends word that Google has just released a tool that could alleviate some of the above worries: it stops tracking by Google Analytics for users of IE7+, Firefox 3.5+, and Chrome 4+. Perhaps Hoofnagle will comment on it here or elsewhere.

Do Build Environments Give Companies an End Run Around the GPL? 374

Malvineous writes "I have two devices, from two different companies (who shall remain nameless, but both are very large and well-known) which run Linux-based firmware. The companies release all their source code to comply with the GPL, but neither includes a build environment or firmware utilities with the code. This means that if you want to alter the free software on the device, you can't — there is no way to build a firmware image or install it on the devices in question, effectively rendering the source code useless. I have approached the companies directly and while one of them acknowledges that it is not fully GPL-compliant, due to other license restrictions it cannot make the build environment public, and the company does not have the resources to rewrite it. I have approached the FSF but its limited resources are tied up pursuing more blatant violations (where no code at all is being released.) Meanwhile I am stuck with two devices that only work with Internet Explorer, and although I have the skills to rewrite each web interface, I have no way of getting my code running on the devices themselves. Have these companies found a convenient way to use GPL code, whilst preventing their customers from doing the same?"

FCC To Make Move On Net Neutrality 232

GrApHiX42 writes "The FCC will announce on Thursday it plans to pursue a 'third way' forward in the fight for tough net neutrality rules, opening a new front in an ongoing legal battle that could come to define the commission under Chairman Julius Genachowski. A senior FCC official said Wednesday that the chairman 'will seek to restore the status quo as it existed' before a federal court ruled it lacked the authority to regulate broadband providers and set rules that mandate open Internet. The goal is to 'fulfill the previously stated agenda of extending broadband to all Americans, protecting consumers, ensuring fair competition, and preserving a free and open Internet,' the FCC official said."

Virgin Promises 100Mbps Connections To UK Homes 247

registerShift writes "Virgin said it will roll out 100 megabit-per-second broadband connections to homes in the UK. The company said users will experience speeds 'very close' to what's advertised as it plans to deploy cable instead of ADSL used by competitors. 'There is nothing we can't do with our fiber optic cable network, and the upcoming launch of our flagship 100mbps service will give our customers the ultimate broadband experience,' Virgin Media's chief executive officer, Neil Berkett, said. This is just days after the FCC announced aims of 100Mbps by 2020, and companies panned it as unrealistic."

I'm sympathetic to the cries of those who say a corporation is not an individual. But it seems like the people who say that always follow up with, "therefore we should get to screw companies any way we want". Just because a corporation is not truly an individual does not mean that they don't deserve protections under the law. And anyway, there's some extent to which trampling on corporations becomes trampling on the people who own or operate the corporations. If the CEO wants to give money to a candidate, and his or her board agrees and the company's bylaws don't prevent it, then who's to say the CEO can't do that?

Cytalk writes "A Maine legislator wants to make the state the first to require cell phones to carry warnings that they can cause brain cancer, although there is no consensus among scientists that they do and industry leaders dispute the claim. The now-ubiquitous devices carry such warnings in some countries, though no US states require them, according to the National Conference of State Legislators. A similar effort is afoot in San Francisco, where Mayor Gavin Newsom wants his city to be the nation’s first to require the warnings."

Virtual Money For Real Lobbying 85

ogaraf writes "Silicon Alley Insider is reporting that health-insurance industry group 'Get Health Reform Right' paid Facebook users with virtual currency to be used in Facebook games in exchange for lobbying their Congressional Rep. 'Instead of asking the gamers to try a product the way Netflix would, "Get Health Reform Right" requires gamers to take a survey, which, upon completion, automatically sends the following email to their Congressional Rep: "I am concerned a new government plan could cause me to lose the employer coverage I have today. More government bureaucracy will only create more problems, not solve the ones we have."'" Relatedly, Trailrunner7 illustrates growing concern over realistic spammer profiles in social networking sites and their potential to wreak havoc, especially if these two methods were combined. "Many spammers now have large staffs of people working on nothing but building out completely fake personas for non-existent users on social networking sites and blog networks. The spammers use these personas to create accounts on Twitter, Facebook, Blogspot and other sites that have high levels of user interaction."

Scientific Journal Nature Finds Nothing Notable In CRU Leak 736

eldavojohn writes with an update to the CRU email leak story we've been following for the past two weeks. The peer-reviewed scientific journal Nature has published an article saying the emails do not demonstrate any sort of "scientific conspiracy," and that the journal doesn't intend to investigate earlier papers from CRU researchers without "substantive reasons for concern." The article notes, "Whatever the e-mail authors may have said to one another in (supposed) privacy, however, what matters is how they acted. And the fact is that, in the end, neither they nor the IPCC suppressed anything: when the assessment report was published in 2007 it referenced and discussed both papers." Reader lacaprup points out related news that a global warming skeptic plans to sue NASA under the Freedom of Information Act for failing to deliver climate data and correspondence of their own, which he thinks will be "highly damaging." Meanwhile, a United Nations panel will be conducting its own investigation of the CRU emails.

MIT and the DARPA Network Challenge 68

mit_team writes "As you might have heard, DARPA has announced a network challenge in the vein of the DARPA Grand Challenge. In this challenge, participants are tasked with finding 10 red weather balloons distributed throughout the continental US for 8 hours on December 5. The idea is to get this to be a crowd-sourcing kind of activity, where people will use social media tools to solve this problem. Our group, the MIT Red Balloon Challenge Team, based out of the MIT Media Lab, has created a system where you get money not just for finding balloons, but for getting people to join the hunt who find the balloons, or for getting people who get people who find balloons, etc. First you have to sign up. Then you can send invitations to others to join through your own unique URL, crediting you with recruiting them.
