..That's called a taking, and the ex-patent holders would be able to sue the government for the value of the patents. It would be a massive litigation and cost the tax payer an enormous amount of money.

You're obviously a lawyer and I'm guessing there is a precedence for this 'taking'. Well think outside the box, maybe A) this precedence doesn't apply or B) the precedence is crap to begin with and should be ignored. I hate how lawyers rely on precedence so much. If it's not precedence, it's a law that can be repealed.
To be honest, I don't think it's so much a court system problem but with the patent system itself and idiotic patent examiners who don't know jack about software/technology and a patent office that prefers to generate revenue as opposed to doing their job.

App Store Piracy Losses Estimated At $459 Million 202

An anonymous reader passes along this quote from a report at 24/7 Wall St.: "There have been over 3 billion downloads since the inception of the App Store. Assuming the proportion of those that are paid apps falls in the middle of the Bernstein estimate, 17% or 510 million of these were paid applications. Based on our review of current information, paid applications have a piracy rate of around 75%. That supports the figure that for every paid download, there have been 3 pirated downloads. That puts the number of pirate downloads at 1.53 billion. If the average price of a paid application is $3, that is $4.59 billion dollars in losses split between Apple and the application developers. That is, of course, assuming that all of those pirates would have made purchases had the application not been available to them for free. This is almost certainly not the case. A fair estimate of the proportion of people who would have used the App Store if they did not use pirated applications is about 10%. This estimate yields about $459 million in lost revenue for Apple and application developers." A response posted at Mashable takes issue with some of the figures, particularly the 75% piracy rate. While such rates have been seen with game apps, it's unclear whether non-game apps suffer the same fate.

Former Exec Says Electronic Arts "Is In the Wrong Business" 180

Mitch Lasky was the executive vice president of Mobile and Online at Electronic Arts until leaving the publisher to work at an investment firm. He now has some harsh things to say about how EA has been run over the past several years, in particular criticizing the decisions of CEO John Riccitiello. Quoting: "EA is in the wrong business, with the wrong cost structure and the wrong team, but somehow they seem to think that it is going to be a smooth, two-year transition from packaged goods to digital. Think again. ... by far the greatest failure of Riccitiello's strategy has been the EA Games division. JR bet his tenure on EA's ability to 'grow their way through the transition' to digital/online with hit packaged goods titles. They honestly believed that they had a decade to make this transition (I think it's more like 2-3 years). Since the recurring-revenue sports titles were already 'booked' (i.e., fully accounted for in the Wall Street estimates) it fell to EA Games to make hits that could move the needle. It's been a very ugly scene, indeed. From Spore, to Dead Space, to Mirror's Edge, to Need for Speed: Undercover, it's been one expensive commercial disappointment for EA Games after another. Not to mention the shut-down of Pandemic, half of the justification for EA's $850MM acquisition of Bioware-Pandemic. And don't think that Dante's Inferno, or Knights of the Old Republic, is going to make it all better. It's a bankrupt strategy."

Doom-Like Video Surveillance For Ports In Development 56

oranghutan writes "A research and development group down under is working to develop an advanced video surveillance system for ports around the world that uses video superimposed onto a 3D map. With 16-megapixel high-definition cameras on a distributed (cabled) network and a proprietary system written in a variety of languages (C++, Python, SQL, etc.), the group from NICTA is aiming to allow security teams at the Port of Brisbane — which is 110km long — to monitor shipping movements, cargo and people. By scrolling along a 3D map, the security teams can click on a location and then get a real-time video feed superimposed onto the map. Authorities from around the world with the right permissions can then access the same system. The main difference from regular surveillance systems is the ability to switch views without having to know camera numbers/locations and the one screen view."

sympleko writes "Zynga has the lion's share of traffic in Facebook applications, and Mafia Wars is one of their most popular social games. Collapsing under the weight of over 26 million users, Zynga has been scrambling to thwart hard-core gamers who reverse-engineer URLs or script the game to optimize their enjoyment. Many of the workarounds have annoyed users who were accustomed to various game features, and even worse, the hastily-deployed changes have resulted in many players losing access to the game, in-game prizes, or statistics. Fed up with a software company seemingly bent on discouraging people from enjoying their product, a number of tagged players have organized a boycott of all Zynga games. The first 24-hour boycott on Sunday 12/13 resulted in an 11% decline in Daily Active Users, and an emergency thread on Zynga's forums (from which most of the flames were deleted). The current boycott, extending Wednesday through Sunday is being supported by a 428K strong Facebook group. At issue is the social contract between software companies and their devoted user base, as well as the nefarious tactics Zynga has used to raise cash."

An anonymous reader writes "Researchers at the California Academy of Sciences traversed four continents and two oceans to uncover 94 new species in 2009, proving that while sometimes in this digital age the world can feel like a small place, much of it has yet to be explored. Among the 94 discoveries were 65 arthropods, 14 plants, 8 fishes, 5 sea slugs, one coral, and one fossil mammal. Why does it matter? As Dr. David Mindell, Dean of Science and Research Collections at the Academy, explained, 'Humans rely on healthy ecosystems, made up of organisms and their environments. Creating a comprehensive inventory of life on our planet is critical for understanding and managing resources. Yet a great many life-forms remain to be discovered and described.'"

iamapizza writes "New Scientist reports on the quest of two math boffins for the perfect way to slice a pizza. It's an interesting and in-depth article; 'The problem that bothered them was this. Suppose the harried waiter cuts the pizza off-center, but with all the edge-to-edge cuts crossing at a single point, and with the same angle between adjacent cuts. The off-center cuts mean the slices will not all be the same size, so if two people take turns to take neighboring slices, will they get equal shares by the time they have gone right round the pizza — and if not, who will get more?' This is useful, of course, if you're familiar with the concept of 'sharing' a pizza."

How Apple's App Review Is Sabotaging the iPhone 509

snydeq writes to recommend Peter Wayner's inside look at the frustration iPhone developers face from Apple when attempting to distribute their apps through the iPhone App Store. Wayner's long piece is an extended analogy comparing Apple to the worst of Soviet-era bureaucracy. "Determined simply to dump an HTML version of his book into UIWebView and offer two versions through the App Store, Wayner endures four months of inexplicable silences, mixed messages, and almost whimsical rejections from Apple — the kind of frustration and uncertainty Wayner believes is fast transforming Apple's regulated marketplace into a hotbed of bottom-feeding mediocrity. 'Developers are afraid to risk serious development time on the platform as long as anonymous gatekeepers are able to delay projects by weeks and months with some seemingly random flick of a finger,' Wayner writes of his experience. 'It's one thing to delay a homebrew project like mine, but it's another thing to shut down a team of developers burning real cash. Apple should be worried when real programmers shrug off the rejections by saying, "It's just a hobby."'"
