Blizzard Suing Creators of StarCraft II Hacks 385

An anonymous reader writes with this excerpt from Rock, Paper, Shotgun: "Blizzard have taken the extremely peculiar decision to ban players from playing StarCraft II for using cheats in the single-player game. This meant that, despite cheating no one but themselves, they were locked out of playing the single-player game. Which is clearly bonkers. But it's not enough for the developer. Blizzard's lawyers are now setting out to sue those who create cheats. Gamespot reports that the megolithic company is chasing after three developers of hacks for 'destroying' their online game. It definitely will be in violation of the end user agreement, so there's a case. However, it's a certain element of their claim that stands out for attention. They're claiming using the hacks causes people to infringe copyright: 'When users of the Hacks download, install, and use the Hacks, they copy StarCraft II copyrighted content into their computer's RAM in excess of the scope of their limited license, as set forth in the EULA and ToU, and create derivative works of StarCraft II.'" Blizzard used similar reasoning in their successful lawsuit against the creators of a World of Warcraft bot.

Why Warhammer Online Failed — an Insider Story 235

sinij writes "An EA insider has aired dirty laundry over what went wrong with Warhammer and what could this mean for the upcoming Bioware Star Wars MMORPG. Quoting: 'We shouldn't have released when we did, everyone knows it. The game wasn't done, but EA gave us a deadline and threatened the leaders of Mythic with pink slips. We slipped so many times, it had to go out. We sold more than a million boxes, and only had 300k subs a month later. Going down ever since. It's 'stable' now, but guess what? Even Dark Age and Ultima have more subs than we have. How great is that? Games almost a decade [old] make more money than our biggest project." The (unverified) insider, who calls himself EA Louse (named after the EA Spouse who brought to light the company's excessive crunchtime practices) says similar trouble is ahead for the development of Star Wars: The Old Republic. EA has not commented yet. God of War creator David Jaffe has criticized the insider for having unrealistic expectations of working in the games industry.

RockDoctor writes "'A Massachusetts man who was rushed to hospital with a collapsed lung came home with an unusual diagnosis: a pea plant was growing in his lung.' Just that summary should tell you enough to work out most of the rest of the details, but it does raise a number of questions unaddressed by the article: How did the pea roots deal with the patient's immune system? What would have happened if the situation had continued un-treated? I bet the guy has a career awaiting him in PR for a pea-growing company."

EVE Player Loses $1,200 Worth of Game Time In-Game 620

An anonymous reader writes "Massively.com has reported that an EVE Online player recently lost over $1,200 worth of in-game items during a pirate attack. The player in question was carrying 74 PLEX in their ship's cargo hold — in-game 'Pilot's License Extensions' that award 30 days of EVE Online time when used on your account. When the ship was blown up by another player, all 74 PLEX were destroyed in the resulting blast, costing $1,200 worth of damage, or over 6 years of EVE subscription time, however you prefer to count it. Ow."

alphadogg writes: All of us get unsolicited commercial e-mail --spam — and often curse the senders, right? Sometimes the senders of spam get their comeuppance through retaliation from their victims.

One notorious case of immediate, disastrous retaliation against a USENET spammer was described in a December 1994 article http://www.networkworld.com/newsletters/sec/2001/00408507.html in Network World in which M.E. Kabay summarized in a column in 1991. The twit who inadvertently posted the same message on multiple USENET groups advertising his company's products got a flood of abusive e-mail, but much worse was that someone posted the company's 800 number on an alt.sex group as if it were a free phone-sex line.

However, Kabay now warns readers that retaliating against the people named in spam is not necessarily a good idea. Sometimes these folks are actually the victims of spammers even more than we recipients are. The senders of these (sometimes intercontinental) misguided missives are actually the victims of criminals who have lied to them. The victims are naïve, unsophisticated business people --sometimes hardworking owners of small U.S. businesses, sometimes bewildered managers of Chinese factories — who have accepted wonderful offers of cheap marketing via e-mail to enormous numbers of willing participants eager to hear from them and carefully filtered to maximize their rate of return on their investment.

The finding should help further our understanding of how the brain generates the internal maps that help us remember where we have been and how to get to where we want to go.

Tara Fitzgerald couldn't find the nude pictures she planned on sending to her boyfriend, but instead of just taking more, she decided to see if a Dell tech support call could fix her problem. Apparently the tech support guy found them. Unfortunately, he then put them up on a site called "bitchtara."

California Legislature Declares "Cuss-Free" Week 262

shewfig writes "The California legislature, which previously tried to ban incandescent light bulbs, just added to the list of banned things ... swear words! Fortunately, the measure only applies for the first week of March, and compliance is voluntary — although, apparently, there will be a 'swear jar' in the Assembly and the Governor's mansion. No word yet on whether the Governator intends to comply."

US Grants Home Schooling German Family Political Asylum 1324

A US judge has granted political asylum to a family who said they fled Germany to avoid persecution for home schooling their children. Uwe Romeike and his wife, Hannelore, moved to Tennessee after German authorities fined them for keeping their children out of school and sent police to escort them to classes. Mike Connelly, attorney for the Home School Legal Defence Association, argued the case. He says, "Home schoolers in Germany are a particular social group, which is one of the protected grounds under the asylum law. This judge looked at the evidence, he heard their testimony, and he felt that the way Germany is treating home schoolers is wrong. The rights being violated here are basic human rights."

BioWare Targeting Spring 2011 For Star Wars: The Old Republic Launch 82

MTV's Multiplayer blog reports on comments from BioWare employee Sean Dahlberg, which indicate that they are aiming to release the game in spring 2011. He said, "While we have not announced a specific date, we can confirm that we are targeting a spring 2011 release for Star Wars: The Old Republic. We've got a lot of exciting updates and reveals planned throughout 2010, including the first-ever hands-on testing for the game. ... We can't wait to share more about the game with you as we progress through the year, so make sure you stay tuned to the official website for details." Recent posts to the game's developer blog provide details on the Imperial Agent and the Jedi Knight. They also released a video which gives insight into their design process for the Dark Side.

As supposedly informed gatekeepers, we sadly earthbound Santas are reduced to scouring the back pages of gaming review sites and magazines, trying to evaluate whether the tot at home is ready for Big Bird's Egg Hunt or Bayonetta. Luckily, The New York Times is here to help. In a recent article provokingly titled 'Ten Games to Cross off Your Child's Gift List,' the NYT names its list of big bads — the video games so foul, so gruesome, so perverse that we'd recommend you buy them immediately — for yourself. Alternatively, if you need gift ideas for the surly, pale teenager in your home whose body contains more plastic then your average d20, this is the newspaper clipping to stuff in your pocket. In other words, if you need a list like this to understand what games to not stuff little Johnny's stocking with this holiday season, you've got larger issues you should concern yourself with. We'd suggest picking up an auto-shotty and taking a few rounds against the horde — it's a wonderful stress relief and you're probably going to need it."

New WoW Patch Brings Cross-Server Instances 342

ajs writes "World of Warcraft's Wrath of the Lich King expansion was staggered into 4 phases. The fourth and final phase, patch 3.3, was released on Tuesday. This patch is significant in that it will be the first introduction of one of the most anticipated new features in the game since PvP arenas: the cross-realm random dungeon, as well as the release of new end-game dungeons for 5, 10 and 25-player groups. The patch notes have been posted, and so has a trailer. The ultimate fight against the expansion's antagonist, the Lich King a.k.a. Arthas, will be gated as each of the four wings of the final dungeon are opened in turn — a process that may take several months. The next major patch after 3.3 (presumably 4.0) will be the release of Cataclysm, the next expansion."

The Struggle For Private Game Servers 125

A story at the BBC takes a look at the use of private game servers for games that tend not to allow them. While most gamers are happy to let companies like Blizzard and NCSoft administer the servers that host their MMORPGs, others want different rules, a cheaper way to play, or the technical challenge of setting up their own. A South African player called Hendrick put up his own WoW server because the game "wasn't available in the country at the time." A 21-year-old Swede created a server called Epilogue, which "had strict codes of conduct and rules, as well as a high degree of customized content (such as new currency, methods of earning experience, the ability to construct buildings and hire non-player characters, plus 'permanent' player death) unavailable in the retail version of the game." The game companies make an effort to quash these servers when they can, though it's frequently more trouble that it's worth. An NCSoft representative referenced the "growing menace" of IP theft, and a Blizzard spokesperson said,"We also have a responsibility to our players to ensure the integrity and reliability of their World of Warcraft gaming experience and that responsibility compels us to protect our rights."
