lpress writes "Yesterday, Judge Alison Nathan of the United States District Court in Manhattan denied a request for a temporary injunction stopping Aereo from streaming local over-the-air television in New York.

The suit against Aereo claims that they are rebroadcasting copyrighted material. Aereo counters that they have developed technology enabling them to assign each user his or her own dime-sized antenna, either permanently or dynamically when they log in. It is as if the user had mounted their antenna at Aereo’s location instead of on their own rooftop.

The case hinges on Aereo's claim that they have designed an array of dime-sized TV antennas, which seems like a daunting task. They've filed four patent applications and their expert testified that the antennas work and are independent of each other. The plaintiff's experts disagree, stating that the entire array acts as one big antenna.

Win or lose, Aereo's solution is a kludge, but, if their antennas work, it will push local stations to stream their video online — and I want one for my home."
