zacharye writes with an excerpt from BGR: "The new 'six strikes' anti-piracy policy soon to be implemented by a number of major Internet service providers in the United States will reportedly stumble out of the gate. The policy, which is set to be adopted by Comcast, Cablevision, Verizon, Time Warner Cable, and other ISPs, will see action taken against users caught downloading pirated files in six steps, ultimately resulting in bandwidth throttling or even service suspensions. The system responsible for managing the new policy may not be ready on schedule, however, and the targeted launch date of July 12th may slip back as a result..."

NewYorkCountryLawyer writes "In one of the mass 'John Doe' cases based on single BitTorrent downloads of films, Malibu Media v. Does 1-13, a pro se litigant made a motion to quash the subpoena. The Court granted a stay of the subpoena, pending its decision on the motion to quash. Unfortunately for John Doe, Verizon had turned over its subscribers' identities 5 days BEFORE the response was due, thus possibly mooting both the stay and the motion to quash. Fortunately for John Doe, the Judge wasn't too happy about this, ordered the information sealed, directed plaintiff's lawyers to destroy any copies, and ruled that they can't use the information unless and until the Court denies the motion to quash."

Hugh Pickens writes "Steve Blank, a professor at Berkeley and Stanford and serial entrepreneur from Silicon Valley, says that the the Facebook IPO is the beginning of the end for Silicon Valley as we know it. "Silicon Valley historically would invest in science, and technology, and, you know, actual silicon," says Blank. "If you were a good venture capitalist you could make $100 million." But there's a new pattern emerging created by two big ideas that will lead to the demise of Silicon Valley as we know it. The first is putting computer devices, mobile and tablet especially, in the hands of billions of people and the second is that we are moving all the social needs that we used to do face-to-face onto the computer and this trend has just begun. "If you think Facebook is the end, ask MySpace. Art, entertainment, everything you can imagine in life is moving to computers. Companies like Facebook for the first time can get total markets approaching the entire population." That's great for Facebook but it means Silicon Valley is screwed as a place for investing in advanced science. "If I have a choice of investing in a blockbuster cancer drug that will pay me nothing for ten years, at best, whereas social media will go big in two years, what do you think I'm going to pick?" concludes Blank. "The headline for me here is that Facebook's success has the unintended consequence of leading to the demise of Silicon Valley as a place where investors take big risks on advanced science and tech that helps the world. The golden age of Silicon valley is over and we're dancing on its grave.""

Dolby's TrueHD 96K Upsampling To Improve Sound On Blu-Rays 255

Stowie101 writes in with a story about your Blu-ray audio getting better. "The audio on most Blu-ray discs is sampled at 48kHz. Even the original movie tracks are usually only recorded at 48kHz, so once a movie migrates to disc, there isn't much that can be done. Dolby's new system upsamples that audio signal to 96kHz at the master stage prior to the Dolby TrueHD encoding, so you get lossless audio with fewer digital artifacts. The 'fewer digital artifacts' part comes from a feature of Dolby's upsampling process called de-apodizing, which corrects a prevalent digital artifact known as pre-ringing. Pre-ringing is often introduced in the capture and creation process and adds a digital harshness to the audio. The apodizing filter masks the effect of pre-ringing by placing it behind the source tone — the listener can't hear the pre-ringing because it's behind the more prevalent original signal."

The disruptive technology at hand is an ad-eraser, embedded in new digital video recorders sold by Charles W. Ergen's Dish Network, one of the nation's top distributors of TV programming. Turn it on, and all the ads recorded on most prime-time network shows are automatically skipped, no channel-flipping or fast-forwarding necessary. Some reviewers have already called the feature, called the Auto Hop, a dream come true for consumers. But for broadcasters and advertisers, it is an attack on an entrenched television business model, and it must be strangled, lest it spread elsewhere."

From the article: 'Speaking at the J.P Morgan Technology Media and Telecom conference today, Verizon Communications CFO Fran Shammo told investors that the company's 3G unlimited data plans that customers were allowed to hang onto last year when Verizon switched to a tiered offering will soon go away entirely. Instead, the company will migrate its existing and new 4G LTE customers to a new "data share plan." The company has yet to announce the details of this new plan, but it has said previously that the data share plan will be introduced in midsummer. The plan will allow people on the same family plan to share buckets of data each month, much like they share voice minutes and text messaging. It will also allow individuals to share data across different 4G LTE devices.'"

As an article on TorrentFreak notes, only a week ago The Pirate Bay scolded Anonymous for its attack on ISP Virgin Media, and now the site is currently the victim of a DDoS attack that is effectively keeping people from viewing the site. There is a lot of speculation as to whether this is retaliation from Anonymous, the work of an agency such as the RIAA and their associates, or an anti-pirate company such as PiratePay." Cyberwarfare? Pimple-faced teenagers? Someone screwed up the routing tables?

However, in a statement, they just announced that 'it's simply not working.' That's a bit of bad news just prior to the Facebook IPO — and while Daniel Knapp tries to sweeten the news, he probably makes it even more bitter by commenting 'Advertising on Facebook has long been funded by marketing budgets reserved for trying new things. But as online advertising investments in general are surging and starting to cannibalize spend on legacy media, advertisers are rightfully asking whether the money spend is justified because it has reached significant sums now.'"

Fluffeh writes "In Australia, we have the right to record TV and play it back at a later date; we also have the right to transcode from one format to another, so anyone with a media server can legally back up their entire DVD collection and watch it without all those annoying warnings and unskippable content — as long as we don't break encryption (please stop laughing!). Optus, Australia's second largest Telco, has been raising ire though with the new TV Now service they are offering and Big Media is having a hissy fit. The service does the recording on behalf of the customer. Seems like a no-brainer right? Let the customer do what they are allowed to legally do at home, but charge them for it. Everybody wins! Not according to Sports Broadcasters, who made this statement when Optus said they would appeal their recent loss in an Australian Court to the highest court in the land: 'They are a disgusting organization who is acting reprehensibly again and now putting more uncertainty into sports and broadcast rights going forward I'm really disappointed and disgusted in the comments of their CEO overnight.' Is this yet another case of Big Media clutching at an outdated business model, or should consumers be content with just doing their own work?"

Thompson's likely replacement on an interim basis will be Yahoo's global media head, Ross Levinsohn, who most recently also ran its Americas unit, including its advertising sales."

Now the Pirate Bay has criticized Anonymous, saying it doesn't support DDoS as a form of protest. The statement is interesting, given that Anonymous has been attacking music industry sites and other targets for some years, saying it is in support of the Pirate Bay."

Israel Passes Photoshop Law To Combat Anorexia 488

Hugh Pickens writes "The Atlantic reports that the Israeli parliament has passed legislation that prohibits fashion media and advertising with models who fall below the World Health Organization's standard for malnutrition banning underweight models as determined by Body Mass Index. The new law also stipulates that any ad which uses airbrushing, computer editing, or any other form of Photoshop editing to create a slimmer model must clearly state that fact. Advertising campaigns created outside of Israel must comply with the legislation's standards in order to appear in Israel. 'I realized that only legislation can change the situation,' says Rachel Adato, an Israeli parliament member with a background in medicine. 'There was no time to educate so many people, and the change had be forced on the industry. There was no time to waste, so many girls were dieting to death.' The measure has been controversial within Israel for raising the question of where free speech bumps up against the fashion industry's responsibility — and its possible harm — to its customers' psychological well-being. Donald Downs, a professor at the University of Wisconsin and an expert on the First Amendment, says that it would be very tough to pass something like Israel's law in the US Congress. 'In the US, it would be hard to justify this type of law on either legal or normative policy grounds,' says Downs. 'The Israeli law is paternalistic in that it prohibits something because of the effect it might have on others in the longer term.'"

But with Google's newly-patented technology for the Collaborative Rejection of Media for Physical Establishments, you no longer need to resort to violence to prevent Elton John Songs from being played on jukeboxes in bars. Its invention, boasts Google, 'enables customers of an establishment to collaboratively reject a media file that is currently playing and/or pending to be played within that establishment by entering data into a personal wireless portable computing device on their person, for example a cellular telephone.' But don't get your hopes up too high, kids. Much like Google's dual-tier stock plan, the patent calls for 'customer status levels including a premium status and a standard status,' so a premium customer will be able to veto attempts by lowly standard customers to kill his requests to play MC Hammer's 'Can't Touch This'. The patent comes from a quirky Outland Research IP portfolio acquired by Google; its inventor is Louis B. Rosenberg, a Stanford PhD and professional film maker."

MrSeb writes "This story began as an investigation into why Cyberlink's Media Espresso software produced video files of wildly varying quality and size depending on which GPU was used for the task. It then expanded into a comparison of several alternate solutions. Our goal was to find a program that would encode at a reasonably high quality level (~1GB per hour was the target) and require a minimal level of expertise from the user. The conclusion, after weeks of work and going blind staring at enlarged images, is that the state of 'consumer' GPU transcoding is still a long, long way from prime time use. In short, it's simply not worth using the GPU to accelerate your video transcodes; it's much better to simply use Handbrake, which uses your CPU."

rrossman2 writes "With the birth of our son (who is now just over two), we have snapped and accumulated a ton of pictures — on Panoramio, Picasa, Facebook, etc. What is the best option for bulk printing the photos to a physical format? We all know how fast technology advances, as well as how fast sites come and go; I want a way to have these pictures for my son when he is older... just like my grandfather has photos of himself from World War II, my parents have photos of me when I was little, etc. Are there any affordable services that you can upload the photos to that print and deliver long-lasting pictures? How well do today's photo ink jets last, and what's the best type of paper? I do have a cheaper Samsung color laser printer, but color lasers don't make the most color-rich prints, and using normal photo paper you can find in big box stores doesn't work out too well, as the laser toner seems to peel off on the rollers and gum things up. (Is there a good long lasting paper that seems to work well with laser printers?) I can see what's going to happen in the future: all of the digital photos people take now are going to either end up on a website that won't be around in 20+ years, or get stuck on disks or flash memory that won't last, or for which interfacing with the media will become difficult or impossible."

Among other nefarious techniques, Adscend would overlay Facebook 'like' buttons with provocative photos to spread links to ads from which Adscend would earn referral fees. Adscend also settled out of court with Facebook for an undisclosed amount."

They organize an annual get-together of like minded folk and talk trash about environmental change. 'The people who still believe in man-made global warming are mostly on the radical fringe of society.' (That's from a press release!). Recently, when they were tricked by a researcher into sending him a lot of internal documents, they decided to go on the offensive and also get some more media attention. After all, any story is a good story, right? Launching a billboard with the Unabomber on it with the slogan 'I still believe in Global Warming. Do You?' was just the start, with the institute planning Fidel Castro, Charles Manson and possibly even Osama Bin Laden. That's when even their stout backers threatened to walk away, backing started to dry up — and it seems that common sense started to prevail — but only so far as to stop them from making their message too public."
